    Troopers Arrest Pair for Felony Drug Offenses Following Traffic Stop in Newark

    Delaware State Police arrested 42-year-old Brandon Wright and 38-year-old Jaclyn Ortega, both of Elkton, Maryland, for felony drug offenses following a traffic stop that occurred on Tuesday evening in Newark.

    On July 23, 2024, at approximately 6:25 p.m., a trooper on patrol in the area of Pulaski Highway and the Delaware/Maryland state line observed a silver Dodge Avenger improperly change lanes as it turned right from Pulaski Highway to Perch Creek Road. The Avenger then entered a Wawa parking lot as the trooper conducted a computer inquiry of the Avenger’s Maryland registration and discovered the registration was expired. Less than a minute later, the Avenger exited the Wawa parking lot at a high rate of speed and briefly traveled on Pulaski Highway before it turned into a Walgreens parking lot. The trooper conducted a traffic stop in the parking lot, and the driver of the Avenger, later identified as Brandon Wright, immediately exited the car. Wright proceeded to disregard multiple verbal commands to get back into the car and was subsequently taken into custody without incident. While the trooper made contact with the Avenger’s passenger, he observed a clear knotted bag containing an off-white rock-like substance suspected to be crack cocaine on the driver floorboard. The passenger, later identified as Jaclyn Ortega, refused to provide her name to the trooper and was taken into custody without incident. A computer inquiry revealed Ortega had a capias for her arrest issued by Justice of the Peace Court 11.

    During a search of the Avenger, troopers recovered the clear bag, which contained approximately 14.57 grams of crack cocaine, and a broken glass pipe with burn marks. Wright and Ortega were taken to Troop 2, where they were both charged with multiple crimes.


    Wright was charged with the offenses listed below, arraigned by Justice of the Peace Court 2, and committed to Howard R. Young Correctional Institution on a $8,300 secured bond.

    Troopers Arrest Man Following Road Rage Incident in Hockessin

    Delaware State Police arrested 37-year-old Steven Wright of Wilmington, Delaware, for aggravated menacing and related charges stemming from a road rage incident that occurred Sunday night in Hockessin.

    On July 21, 2024, at approximately 7:17 p.m., troopers responded to the area of Limestone Road and Brackenville Road for a report of a collision. While responding, troopers were notified of an unrelated road rage incident between a white Chevrolet Uplander and a black Chrysler Voyager in which the driver of the Chevrolet displayed a black handgun multiple times. Both of the minivans stopped at the collision scene. Upon arriving, troopers made contact with the Chevrolet’s driver, identified as Steven Wright, and took him into custody without incident. A subsequent search of the minivan led to the discovery of a loaded black handgun in a bag between the driver and passenger seats.

    During the investigation, troopers learned Wright had arrived at a party in Hockessin and displayed a black handgun. The driver of the Chrysler, a 23-year-old man, and his passengers were leaving the party as Wright arrived. Wright then followed the Chrysler as it drove away from the residence. The driver of the Chrysler did not know Wright or why he was following him. Wright drove recklessly as he continued to follow the Chrysler. He drove next to the minivan multiple times and displayed the black handgun. In one instance, Wright slammed on his brakes while in front, causing the Chrysler to hit the rear of his van. The Chrysler stopped upon seeing Fire Police officers at the collision scene on Limestone Road and informed them of the road rage incident. The Chevrolet also stopped. No injury was reported.

    A computer inquiry revealed Wright is a convicted felon who is prohibited from possessing a firearm or ammunition. Wright was taken to Troop 2, where he was charged with the crimes listed below, arraigned by Justice of the Peace Court 11, and committed to Howard R. Young Correctional Institution on a $32,600 cash bond.

    State Police Detectives Investigating Shots Fired at a Lincoln Residence

    The Delaware State Police are investigating a shooting that occurred last night in Lincoln.

    On July 25, 2024, at approximately 10:37 p.m., troopers responded to a home on the 10000 block of Cedar Creek Road in Lincoln for a report of shots fired. When troopers arrived, they learned that an unknown suspect fired several shots that hit an occupied house. There were three adults in the home at the time of the shooting. No one was injured, and the incident remains under investigation.

    Troop 4 Criminal Investigations Detectives continue to investigate this incident. Detectives are asking anyone who witnessed or has information regarding this case to contact Detective R.     State Police Detectives Investigating Stabbing of a Child in Ellendale

    The Delaware State Police have arrested 40-year-old Darris McGlotten and his mother, 54-year-old Jamesneta McGlotten, both of Ellendale, for attempted murder and related charges after a stabbing that has left a child in critical condition.

    On July 25, 2024, at approximately 10:51 a.m., troopers responded to Bayhealth – Sussex Campus, for a possible stabbing. When troopers arrived, they learned that a 12-year-old victim had been brought to the hospital, by a family member, after being stabbed at a home on the 18000 block of Sharon’s Road in Ellendale. During the investigation, detectives learned that the suspect, Darris McGlotten, stabbed the victim in the chest while the victim was sleeping. Detectives also learned that Jamesneta McGlotten was aware that the victim had been seriously injured yet failed to seek medical or police assistance.

    Darris McGlotten was arrested and taken to Troop 4 where he was charged with the crimes listed below, arraigned by Justice of the Peace Court 2, and committed to Sussex Correctional Institution on $420,000 cash bond.

    State Police Announce Dates for Fall Citizens Police Academy in Kent County

    The 2024 Fall Delaware State Police Citizens Police Academy will start on Thursday, September 5, 2024. The academy will consist of nine two-hour sessions on Thursday nights, with the final session on Tuesday, October 29, 2024. Most classes will take place at Delaware State Police Troop 3, located at 3759 South State Street, Camden, Delaware.

    Participants will learn about a wide range of intriguing police activities consistent with the experiences of the Delaware State Police today. The Academy includes, but is not limited to, classroom instruction on evidence processing, criminal and traffic investigations, tours of DSP facilities, familiarization with special units, and other topics. Additionally, participants will have the opportunity to ride with patrol troopers.

    Class size will be limited to 25 participants, and background checks will be conducted on all applicants.

    Applications can be submitted online through the Citizens Police Academy website from now until August 16, 2024.

    * Update – Suspect Arrested * Delaware State Police Investigating a Homicide in Ellendale

    The Delaware State Police have arrested 14-year-old Angelo Rodriguez of Millsboro, Delaware, for murder following a homicide that occurred in Ellendale last month.

    On June 9, 2024, at approximately 4:30 p.m., troopers responded to the 12000 block of North Old State Road, for a shooting. When troopers arrived, they learned that 17-year-old Ahniya Coverdale had been shot and taken to the Ellendale Fire Company. She was taken by ambulance to an area hospital, where she died. A second victim, a 19-year-old man, later responded to an area hospital with a gunshot wound to the leg and was treated for non-life-threatening injuries.

    Through investigative means, the Delaware State Police Homicide Unit identified Angelo Rodriguez as the suspect. On July 22, 2024, he was indicted by a Sussex County Grand Jury.

    On Tuesday, July 23, 2024, detectives arrested Rodriguez, he was charged with the crimes listed below, arraigned by Justice of the Peace Court 3, and committed to Stevenson House Detention Center on a $300,000 cash bond.

  • FTC and Justice Department to Host First Public Strike Force on Unfair and Illegal Pricing Meeting

    The Federal Trade Commission and the Department of Justice (DOJ) will virtually cohost the first public meeting of the Strike Force on Unfair and Illegal Pricing (Strike Force) on Thursday, August 1, 2024, to discuss Strike Force enforcement actions taken to lower prices for Americans.

    The meeting will convene with an open-press session with remarks by FTC Chair Lina M. Khan, Associate Attorney General Benjamin C. Mizer, Assistant Attorney General for the Antitrust Division Jonathan S. Kanter, and Principal Deputy Assistant Attorney General for the Civil Division Brian M. Boynton. Senior officials from other agencies will then offer remarks as well. The remainder of the meeting will move to a closed-door, private discussion of enforcement-related matters.

    The Strike Force meeting’s open session will begin at 3:30pm ET. The agenda for the public portion of the event will be posted on the FTC’s website prior to the event. A link to view the open virtual meeting will be posted on the FTC’s website the day of the event.

    In March 2024, at the sixth meeting of the White House Competition Council, President Biden announced the launch of the Strike Force to strengthen interagency efforts to root out and stop illegal corporate behavior that hikes prices on American families through anti-competitive, unfair, deceptive, or fraudulent business practices.

    The Strike Force’s membership also includes the Department of Agriculture, Department of Health and Human Services, Department of Transportation, Securities and Exchange Commission, Federal Communications Commission, and the Consumer Financial Protection Bureau.

    *Update – Suspect Arrested* Delaware State Police Investigating a Shooting That Occurred Near Milton

    Delaware State Police Detectives have arrested 24-year-old Timmarus Perry of Milton, Delaware for felony assault and gun charges following a shooting near Milton.

    On July 14, 2024, at approximately 7:49 p.m., troopers responded to Cool Spring Road near Fisher Road, for a Ford Explorer that crashed into a utility pole. When troopers arrived, they learned that the driver, a 27-year-old man from Laurel, Delaware, had been shot in the back. He was taken to an area hospital with critical injuries. The preliminary investigation revealed that the victim was driving on West Springside Drive when the suspect fired several rounds at the Explorer, hitting the victim. After the shooting, the Explorer drove away and hit a utility pole a short distance away.

    Through investigative means, detectives identified the suspect responsible for the shooting as 24-year-old Timmarus Perry of Milton, Delaware, and obtained a warrant for his arrest.

    On July 24, 2024, detectives arrested Perry. He was taken to Troop 4, charged with the crimes listed below, arraigned by Justice of Peace Court 2, and committed to Sussex Correctional Institution on a $105,000 secured bond.

    State Police Arrest Man for Organized Retail Theft from Wegmans

    Delaware State Police arrested 52-year-old Thomas Hetzler, of Wilmington, Delaware, for organized retail theft charges stemming from multiple shopliftings that occurred at the Wegmans in Wilmington.

    On July 23, 2024, at approximately 11:23 p.m., troopers responded to the Wegmans, located at 371 Buckley Mill Road in Wilmington, for a report of a habitual shoplifter that trespassed on the property and shoplifted. Wegmans employees and troopers were familiar with the suspect, identified as Thomas Hetzler, from previous shoplifting investigations. Upon arriving, troopers learned Hetzler placed several food items in a basket and walked out of the grocery store without paying. After a brief search of the area, troopers found Hetzler with the stolen items and took him into custody without incident.

    A computer inquiry revealed Hetzler had an active No Contact Order with Wegmans issued by the New Castle County Court of Common Pleas. Additionally, Hetzler had warrants for his arrest for two prior shopliftings of a similar nature from Wegmans. One of the prior shopliftings occurred on July 12, 2024, and the other prior shoplifting occurred on May 16, 2024, however, was reported to troopers by Wegmans Loss Prevention in July 2024. Hetzler was taken to Troop 1, where he was charged with the crimes listed below, arraigned by Justice of the Peace Court 11, and committed to Howard R. Young Correctional Institution on a $5,100 cash bond.

    • Organized Retail Theft (Felony) – 3 counts
    • Criminal Trespass 3rd Degree – 2 counts
    • Breach of Release – 2 counts

  • FTC Announces Tentative Agenda for August 1 Open Commission Meeting

    Today, Federal Trade Commission Chair Lina M. Khan announced that an open meeting of the Commission will be held virtually on Thursday, August 1, 2024. The open meeting will commence at 10 a.m. ET and will begin with time for members of the public to address the Commission.

    The following items will be on the tentative agenda for the August 1 Commission meeting:

    Business Before the Commission:

    Pharmacy Benefit Managers Report: Staff from the Office of Policy Planning will provide a presentation on the Interim Report on Pharmacy Benefit Managers (PBMs). This Interim Report is part of the Federal Trade Commission’s ongoing study of PBMs and explores their potential impact on access and affordability of medicines and examines how increasing vertical integration and concentration may have enabled PBMs to inflate drug costs and squeeze Main Street pharmacies.

    Presentation on Military Consumer Protection: To close out Military Consumer Month, staff from the Bureau of Consumer Protection’s Division of Consumer and Business Education will provide a presentation on the FTC’s work to protect servicemembers, veterans, and their families. It will address the FTC’s consumer outreach and education efforts, network of partnerships with military organizations, and recent enforcement work.   

    At the start of the meeting, Chair Khan will offer brief remarks and will then invite members of the public to share feedback on the Commission’s work generally and bring relevant matters to the Commission’s attention. Members of the public must sign up for an opportunity to address the Commission virtually at the August 1 event.

    Each commenter will be given two minutes to share their comments. Those who cannot participate during the event may submit written comments or a link to a prerecorded video through a webform. Speaker registration and comment submission will be available through Tuesday, July 30, 2024 at 8 pm ET.

    A link to view the meeting will be available on the day of the event, shortly before is starts via FTC.gov. The event will be recorded, and the webcast and any related comments will be available on the Commission’s website after the meeting. The Commission retains discretion to make public comments available following the event on FTC.gov.

    State Police Issue Gold Alert for Missing Middletown Woman

    Delaware State Police Troop 9 has issued a Gold Alert for 29-year-old Jade Miller of Middletown, Delaware. She was last seen at her residence around 4:00 p.m. on July 24, 2024. Attempts to contact or locate her have been unsuccessful, and there is a concern for her safety and well-being.

    Jade is described as a white female, approximately 5’5” tall, weighing approximately 128 pounds with brown eyes and black hair. She was last seen wearing a pink T-shirt with cream colored jogger pants. Her direction of travel is unknown.

    *Update – Suspect Arrested* State Police Investigating Concord Mall Shoplifting Turned Robbery

    Delaware State Police arrested Itaijiyah Clark of Wilmington, Delaware, for robbery and theft-related offenses stemming from multiple investigations, including a shoplifting turned robbery that occurred last month at a Sunglass Hut kiosk within the Macy’s at Concord Mall.

    On June 17, 2024, at approximately 5:40 p.m., troopers responded to a shoplifting turned robbery at the Sunglass Hut kiosk located within the Macy’s at 580 Concord Mall in Wilmington. The investigation revealed that 5 unknown suspects approached the kiosk and grabbed several pairs of eyeglasses. As the suspects fled towards the exit of the store with the unpaid merchandise, they were confronted by an employee. During the confrontation, one of the female suspects dropped a bag containing some of the stolen eyeglasses and pepper sprayed the employee in the face. The suspects then fled in a silver sedan with several pairs of eyeglasses.

    Through investigative means, troopers identified one of the suspects as Itaijiyah Clark, who was wanted for multiple felony theft-related charges stemming from three shopliftings that occurred between April 12, 2024, and May 4, 2024. Two of the prior shopliftings occurred at the Concord Mall Sunglass Hut kiosk within the Macy’s, and the third shoplifting occurred at DTLR, located at 611 Governors Place in Bear.

    On July 22, 2024, Clark was taken into custody at the New Castle County Court of Common Pleas without incident. Clark was transported to Troop 1, where she was charged with the crimes listed below, arraigned by Justice of the Peace Court 2, and committed to Delores J.     State Police Arrest Man for Hockessin Area Shell Gas Station Robbery

    Delaware State Police arrested 24-year-old Brandon Robertaccio of Hockessin, Delaware, for a robbery that occurred yesterday morning at a Shell gas station in Hockessin.

    On July 23, 2024, at approximately 11:49 a.m., troopers responded to the Shell gas station, located at 7441 Lancaster Pike, Hockessin, for a report of a robbery. The preliminary investigation revealed that a white male suspect approached the checkout counter, where a cashier and two children were present. At the counter, the suspect, with his hand concealed under his shirt implying a weapon, demanded the cashier give him money from the cash register. The victim did not comply, and the suspect fled in a gray SUV without any proceeds.

    Through investigative means, Troop 2 Robbery Detectives identified the suspect’s vehicle as a gray GMC Terrain with Delaware registration. Detectives subsequently located the SUV and the suspect, identified as Brandon Robertaccio, near the SUV’s registered address. The suspect was taken into custody without incident and transported to Troop 2, where he was charged with the crimes listed below, arraigned by Justice of the Peace Court 2, and committed to Howard R. Young Correctional Institution on a $22,000 cash bond.

    Delaware State Police Homicide Unit Continues Investigation of Susan Ledyard’s 2019 Homicide

    The Delaware State Police Homicide Unit continues to investigate the 2019 murder of Susan Ledyard, 50, of Wilmington, Delaware.

    On July 23, 2019, at 7:39 a.m., Susan Ledyard’s body was recovered from the Brandywine River near Northeast Boulevard in Wilmington. She had visible injuries, and a post-mortem examination by the Division of Forensic Science determined the cause of death to be blunt force trauma and drowning. The manner of death was ruled a homicide. At the time of her death, Susan was 5’4″, weighed 130 pounds, had shoulder-length brown hair, and was wearing a purple tank top.

    Later that morning, at 8:54 a.m., Susan’s black 2016 Honda Civic was found parked near the Rising Sun Lane Bridge over the Brandywine River, approximately three miles upstream from where her body was recovered. Based on the timeline and the river’s course, detectives do not believe Susan entered the river where her vehicle was parked.

    Detectives established a partial timeline of Susan’s activities through video surveillance and cell phone records. She was active on her cell phone throughout the night, texting and calling friends until 2:45 a.m. At 3:02 a.m., her car was seen leaving her driveway and was parked on Walkers Mill Road approximately two minutes later. Detectives believe the car was driven directly from her house to where it was found, given the time elapsed.

    Data from Susan’s Fitbit confirmed she was alive until approximately 7:00 a.m., but her whereabouts between 3:00 and 7:00 a.m. remain unknown. Detectives also have not determined why she left her residence.

    The Delaware State Police Homicide Unit has received assistance from multiple law enforcement agencies and civilian experts throughout this investigation. Detectives continue to seek public assistance to gather more information about Susan’s murder and her activities in the hours leading up to her death.

    The Morrissey family, Susan’s parents, and her siblings have been supportive of this investigation. In partnership with Delaware Crime Stoppers, they are offering a $50,000 reward for information leading to an arrest.     *Update – One Arrested; Second Suspect Remains At-Large* Detectives Investigating Armed Robbery in Smyrna

    Delaware State Police arrested a 17-year-old male of Middletown, Delaware, for several felony charges stemming from an armed robbery that occurred earlier this month in Smyrna. Detectives are seeking assistance in locating his coconspirator (pictured above), 19-year-old Terence Smith of Smyrna, Delaware, who remains at-large.

    On July 6, 2024, at approximately 9:26 p.m., troopers responded to a report of an armed robbery that occurred at the intersection of Joseph Wick Drive and Willowwood Drive in Smyrna. The preliminary investigation revealed that the 17-year-old victim was walking home when he was approached by 2 unknown black male suspects. A physical altercation ensued between the suspects and the victim, during which one of the suspects struck the victim in the back of the head with a handgun. After the altercation ended, one of the suspects threatened to shoot the victim as he attempted to retrieve his personal property from the street.

    Through investigative means, Troop 3 Criminal Investigations Detectives identified the 17-year-old male and Terence Smith as the suspects involved in the robbery. On July 22, 2024, the 17-year-old male turned himself in at Troop 3 on a felony warrant for his arrest. Smith has not been located at this time. Detectives are seeking the public’s assistance in their on-going efforts to locate Smith, who has a warrant for his arrest for robbery-related charges.


    At Troop 3, the 17-year-old male was charged with the crimes listed below, arraigned by Kent County Family Court, and released to a guardian on a $6,000 unsecured bond.

    Delaware State Police Homicide Unit continues to investigate a shooting that occurred in Milton yesterday morning that left a man dead.

    On July 22, 2024, at approximately 4:47 a.m., troopers responded to the 14000 block of Collins Street in Milton for a report of a shooting. When troopers arrived, they found a 19-year-old man that had been shot in the upper torso and began life-saving efforts. The victim was taken by ambulance to an area hospital with life-threatening injuries.

    On July 23, 2024, the 19-year-old victim died as a result of injuries from the shooting. His name is being withheld until his family is notified.

    Dover Police Investigate Officer-Involved Firearms Discharge

    The Dover Police Department is investigating an Officer-involved firearms discharge that occurred Monday afternoon during an arrest. The investigation began on Monday, July 22nd, 2024, at 2:21 p.m., when members of the Dover Police Department’s Special Operations Response Team were attempting to contact Millard Richardson, 22, of Smyrna, inside of a vehicle in the parking lot of the Sleep Inn Hotel. Officers were attempting to arrest Richardson as the result of a firearm and gang investigation and had information that he currently had a firearm, which he is prohibited from possessing.

    When Officers contacted him, he attempted to drive away, causing his vehicle to hit a Dover Police vehicle. After causing the collision, Richardson continued to refuse to exit his vehicle. Officers broke the driver-side window to gain access to the car and due to the vehicle having dark window tint. During this time, a departmentally issued rifle discharged. Richardson and an Officer both sustained injuries to their hands during this incident. Richardson was taken into custody without further incident and transported to Bayhealth Kent Campus for treatment. The Officer involved was also transported to Bayhealth Kent Campus and was treated and released.

    The exact cause of the injury to Richardson and the cause of the firearms discharge is currently under investigation by the Dover Police Criminal Investigations Unit and the Delaware Department of Justice – Division of Civil Rights and Public Trust.

    There were two other individuals in the vehicle at the time of this incident; a 24-year-old male from Dover and a 21-year-old male of Smyrna. Both were uninjured.

    Detectives obtained and executed a search warrant on the vehicle that Richardson was operating. Detectives located the following items as a result of the search:

    -A loaded Black Polymer 80 .40 caliber handgun which was concealed between the driver’s seat and center console of  the vehicle
    -Over $1,000
    -219.6 grams of marijuana
    -56.7 grams of THC Wax
    -7 Grams of marijuana edibles and oils
    -A digital scale and other drug paraphernalia
    -15.5 doses of Xanax

    Once Richardson is released from Bayhealth Kent Campus he will be charged with the following:
    -Possession of a Firearm During the Commission of a Felony
    -Possession of a Firearm or Ammunition by a Person Prohibited (3x)
    -Possession with Intent to Deliver a Controlled Substance
    -Carrying a Concealed Deadly Weapon
    -Criminal Mischief Over $1,000 but Less than $5,000
    -Resisting Arrest
    -Possession of a Controlled Substance
    -Possession of Drug Paraphernalia

    The Officer involved in the incident is a 2 ½ year veteran of the Dover Police Department and is a member of the Patrol Division. Consistent with standard policy, the Officer has been placed on administrative leave, with pay, pending the outcome of the investigation.  As previously stated, the Dover Police Department will continue to investigate this incident in coordination with the Delaware Department of Justice – Division of Civil Rights and Public Trust and will provide additional details as they become available.

  • FTC Issues Orders to Eight Companies Seeking Information on Surveillance Pricing

    The Federal Trade Commission issued orders to eight companies offering surveillance pricing products and services that incorporate data about consumers’ characteristics and behavior. The orders seek information about the potential impact these practices have on privacy, competition, and consumer protection.

    The orders are aimed at helping the FTC better understand the opaque market for products by third-party intermediaries that claim to use advanced algorithms, artificial intelligence and other technologies, along with personal information about consumers—such as their location, demographics, credit history, and browsing or shopping history—to categorize individuals and set a targeted price for a product or service. The study is aimed at helping the FTC better understand how surveillance pricing is affecting consumers, especially when the pricing is based on surveillance of an individual’s personal characteristics and behavior.

    “Firms that harvest Americans’ personal data can put people’s privacy at risk. Now firms could be exploiting this vast trove of personal information to charge people higher prices,” said FTC Chair Lina M. Khan. “Americans deserve to know whether businesses are using detailed consumer data to deploy surveillance pricing, and the FTC’s inquiry will shed light on this shadowy ecosystem of pricing middlemen.”

    The FTC is using its 6(b) authority, which authorizes the Commission to conduct wide-ranging studies that do not have a specific law enforcement purpose, to obtain information from eight firms that advertise their use of AI and other technologies along with historical and real-time customer information to target prices for individual consumers. The orders were sent to: Mastercard, Revionics, Bloomreach, JPMorgan Chase, Task Software, PROS, Accenture, and McKinsey & Co.

    The orders are seeking information on four major areas:

    • Types of products and services being offered: The types of surveillance pricing products and services that each company has produced, developed, or licensed to a third party, as well as details about the technical implementation and current and intended uses of this technology;
    • Data collection and inputs: Information on the data sources used for each product or service, including the data collection methods for each data source, the platforms and methods that were used to collect such data, and whether that data is collected by other parties (such as other companies or other third parties);
    • Customer and sales information: Information about whom the products and services were offered to and what those customers planned to do with those products or services; and
    • Impacts on consumers and prices: Information on the potential impact of these products and services on surveilled consumers including the prices they pay.

    The FTC has long been on the front lines of documenting and investigating the hidden ecosystem of data brokers, digital platforms, and other intermediaries that specialize in monitoring and selling user data. The FTC’s 6(b) orders aim to shed light on how the current data ecosystem may facilitate the ability to target consumers with individual prices.

    The Commission voted 5-0 to issue the 6(b) orders to the eight companies. Commissioners Melissa Holyoak and Andrew N. Ferguson issued concurring statements.

    FTC Acts to Stop Debt Relief Scheme Targeting Spanish-Speaking Student Loan Borrowers

    The Federal Trade Commission has stopped the operators of a scheme that it says tricked financially strapped consumers seeking student loan relief into paying hundreds of dollars in junk fees. The operators often targeted Spanish-speaking consumers in Puerto Rico, pretended to be affiliated with the Department of Education and its loan servicers, and made false promises of low, permanently fixed monthly payments and loan forgiveness.

    federal court temporarily halted the scheme and froze its assets at the request of the FTC, which seeks to end the unlawful practices and secure redress for the thousands of consumers who have been harmed.

    “By pretending to be affiliated with the Department of Education and misrepresenting features of its free income-driven loan repayment programs, these scammers bilked millions from the consumers these programs were designed to help,” said Samuel Levine, Director of the FTC’s Bureau of Consumer Protection. “We are pleased that the court preliminarily shut down this predatory operation and froze its assets, and we will continue our efforts to crack down on junk fees, unwanted calls, and exploitation of consumers struggling with student loan debt.”

    According to the FTC’s complaint, since at least April 2019, Florida-based Start Connecting LLC and Colombia-based Start Connecting SAS (collectively doing business as USA Student Debt Relief (USASDR) and their owners and operators Douglas Goodman, Doris Gallon-Goodman, and Juan Rojas have enticed consumers by falsely suggesting an affiliation with the government or its student loan servicers. USASDR also falsely promised to enroll consumers in programs that guarantee permanent low, fixed monthly payments—as low as $9 per month—followed by generous lump-sum loan forgiveness of the remaining balance. In exchange for enrollment, the operators have charged consumers illegal advance fees of several hundred dollars followed by monthly fees of as much as $29. Although USASDR claimed it would apply consumers’ monthly payments to their loan balances, in reality USASDR’s operators pocketed consumers’ hard-earned money and offshored much of the funds to Colombia.

    The complaint also notes that USASDR falsely marketed its services with fake testimonials and reviews on its website and social media pages, as well as on third-party consumer review platforms like those hosted by the Better Business Bureau and Trustpilot. For example, USASDR posted testimonials to its Instagram and Facebook pages that falsely appeared to recount real consumers’ positive experiences with the company. One such testimonial posted on August 19, 2022 purported to recount the experience of “Ana Rojas” and falsely claimed that USASDR had reduced her loan payments from $1,300 per month for 28 years to only $417 per month for eight 8 years.

    In reality, according to the complaint, this review and others like it are fabricated. Fake testimonials like the one from Ana Rojas feature stock photos available for download online and describe permanently-fixed-monthly-payment scenarios that cannot be obtained under any income-driven repayment plan.

    In addition, the complaint alleges that USASDR telemarketers based in Colombia placed unwanted telemarketing calls to consumers throughout the United States, including consumers on the Do Not Call Registry, and disproportionately targeted consumers in Puerto Rico. Of the more than 750,000 outbound calls that USASDR telemarketers made to consumers between April 2019 and February 2024, approximately 220,000—nearly 30 percent—went to consumers with a Puerto Rico area code, many of whom only spoke Spanish. The complaint further notes that USASDR unfairly provides Spanish-speaking consumers with fine-print contracts written in English, even though the sales pitch and email communications to those consumers are generally in Spanish and targeted consumers who do not speak or read English fluently, if at all.

    The FTC thanks the U.S. Department of Education, the Better Business Bureau of West Florida, the California Department of Financial Protection and Innovation, and the Minnesota Attorney General’s Office for their assistance with this matter. 

    The Commission vote authorizing the staff to file the complaint was 5-0. The complaint was filed in the U.S. District Court for the Middle District of Florida. The court entered a temporary restraining order on July 11, 2024.

    NOTE: The Commission files a complaint when it has “reason to believe” that the named defendants are violating or are about to violate the law and it appears to the Commission that a proceeding is in the public interest. Stipulated final orders have the force of law when approved and signed by the District Court judge.

    State Police Investigate Late-Night Shooting on New Castle Avenue

    The Delaware State Police are investigating a shooting incident that occurred late Saturday night on New Castle Avenue in New Castle, Delaware.

    On July 20, 2024, at approximately 10:53 p.m., troopers responded to a report of a shooting in the 3100 block of New Castle Avenue. Preliminary investigations revealed that an 18-year-old man and a 17-year-old male, both from Wilmington, Delaware, were riding their bicycles northbound on New Castle Avenue. As they approached the Spice N’ Nice Restaurant, they crossed from the east side of the roadway to the west side.

    During this crossing, the 18-year-old man felt a sudden impact and realized he had been shot. As the shooting continued, he managed to cross back to the east side of the road and then started running after abandoning his bicycle. Meanwhile, the 17-year-old male continued riding northbound on New Castle Avenue. The unidentified suspect(s) fled the scene.

    The 18-year-old victim was transported to a nearby hospital with non-life-threatening gunshot wounds. No other injuries were reported.

    Currently, there is no description of the suspect(s), and no video surveillance or images are available.

    On July 19, 2024, at approximately 8:30 p.m., troopers were dispatched to Railroad Avenue in Townsend for a reported robbery. The preliminary investigation revealed that two young victims, a 19-year-old man from Middletown, Delaware, and an 18-year-old woman from Newark, Delaware, had arranged to sell vape pens to an unknown individual they had met through social media.

    When they arrived at a residence on the 500 block of Railroad Avenue, the victims were approached by two suspects on foot. The suspects entered the vehicle, brandished handguns, and demanded the vape pens and money.

    In response, the 19-year-old driver began honking the vehicle’s horn, causing one suspect to flee. The second suspect remained inside as the driver attempted to escape by driving away. The vehicle veered off Railroad Avenue and collided with a utility pole before crashing into a nearby residence. After the crash, all individuals exited the vehicle. The 19-year-old driver pursued the suspects, at which point one of the suspects fired a shot at him. The suspects then fled the scene.

    The 18-year-old woman was taken to a nearby hospital for minor injuries sustained during the crash. No other injuries were reported, including from the occupied residence that was struck. Currently, there is no description of the suspects, and no video surveillance or images are available at this time.

    She is described as a white female, approximately 5’7” tall, weighing about 200 pounds, with brown eyes and auburn-colored hair. She was last seen wearing a tie-dye tank top, dark green shorts, and white sandals. She may be driving a white 2018 Buick Enclave with Florida registration VG2UI.

    Detectives Arrest Man for Felony Gun and Drug Related Charges Following Drug Investigation in New Castle County

    Delaware State Police arrested 41-year-old Ziare Miller of Middletown, Delaware, for felony gun and drug related charges following the conclusion of a several-month long drug investigation in New Castle County yesterday morning.

    In the early morning hours of July 17, 2024, members of the New Castle County Governor’s Task Force, Troop 2 Drug Unit, and Delaware State Police Special Operations Response Team executed search warrants at a residence on Goodwick Drive in Middletown, and a business property associated with Ziare Miller on South Dupont Highway in New Castle. The search warrants were obtained following a several-month long drug investigation of Ziare Miller, who was suspected of the large-scale distribution of narcotics. Miller was taken into custody at his residence on Goodwick Drive without incident.

    A search of the two properties led to the discovery of the following items:

    • 2 loaded handguns
    • Multiple rounds of ammunition
    • Approximately 348 grams of a fentanyl, heroin, and xylazine mixture
    • Approximately $7,600 in suspected drug dealing proceeds
    • Various paraphernalia to include digital scales, hot plates, and distribution/packaging materials

    Following the execution of the search warrants, detectives were successful in determining that Miller was operating a heroin processing mill and cocaine distribution center from the location on South Dupont Highway due to the evidence discovered inside the business. The recovered evidence indicated that the approximately 348 grams of heroin mixture seized prevented approximately 50,000 bags of heroin from being manufactured and distributed throughout the State of Delaware. 

    A computer inquiry revealed Miller is a convicted felon and is prohibited from possessing firearms and/or ammunition. Miller was taken to Troop 2, where he was charged with the crimes listed below, arraigned by Justice of the Peace Court 2, and committed to Howard R. Young Correctional Institution on a $203,000 cash bond.

    Troop 7 Collision Reconstruction Unit Investigating Fatal Two-Vehicle Crash in Bridgeville

    The Delaware State Police continues to investigate a Bridgeville area crash that occurred early Wednesday morning after 22-year-old Djifenson Dorilus of Salisbury, Maryland, died from injuries sustained in the crash.

    On July 17, 2024, at approximately 12:59 a.m., a 2017 Dodge Durango was traveling in a northbound lane of Sussex Highway, approaching the area of Newtown Road. Simultaneously, a 2013 Hyundai Santa Fe was traveling southbound in a northbound lane of Sussex Highway, in the Dodge’s path of travel. Both vehicles were traveling in the left northbound lane of Sussex Highway as they approached each other from opposite directions. In an attempt to avoid a collision with the Hyundai, the Dodge moved into the right northbound lane of Sussex Highway. At the same time, the Hyundai also moved into the right northbound lane of Sussex Highway. As a result, the front of the Hyundai struck the front of the Dodge. After the initial impact, the Hyundai overturned onto its roof and rotated clockwise before it came to rest between the shoulder and the right northbound lane. The Dodge rotated clockwise and came to rest on the centerline of the roadway.

    The driver of the Hyundai, identified as Djifenson Dorilus, was transported to an area hospital for life-threatening injuries. On July 18, 2024, Djifenson died from injuries sustained in the crash. His family and relatives were notified.

    The driver of the Dodge, a 46-year-old man from Millsboro, Delaware, was taken to an area hospital for a serious injury.

    The roadway was closed for approximately 3 hours while the scene was investigated and cleared.

    State Police Detectives Arrest Lewes Man for Multiple Felony Thefts

    Delaware State Police arrested 31-year-old William Rodenbaugh of Lewes, Delaware, for multiple felony thefts from vehicles that occurred over the last week in the Lewes area.

    Between July 8, 2024, and July 17, 2024, troopers investigated multiple thefts and trespassing of a similar nature in Angola and Lewes area. In each of the incidents, a white male suspect trespassed onto residential properties, where he went through unsecured vehicles and stole money and property. Detectives identified the suspect responsible for the thefts as William Rodenbaugh and obtained warrants for his arrest. Detectives were familiar with Rodenbaugh as part of an ongoing investigation of thefts and attempted thefts from vehicles in the Lewes area.

    On July 17, 2024, at approximately 4:40 a.m., a trooper on patrol in the Henlopen Landing neighborhood in Lewes, saw a man wearing a black hooded sweatshirt and carrying a backpack walking through the neighborhood. The trooper recognized the man as Rodenbaugh from previous investigations and attempted to contact him. Before the trooper could contact him, Rodenbaugh ran away, but was arrested a short time later following a foot chase.

    Rodenbaugh was taken to Troop 7 where he was charged with the crimes listed below, arraigned by Justice of the Peace Court 2 and committed to Sussex Correctional Institution on a $1,500 secured bond.

    Troopers Arrest Man for Vehicular Assault and DUI Following Crash Investigation in Greenville

    The Delaware State Police arrested 47-year-old John Fester of West Chester, Pennsylvania, for vehicular assault and DUI charges following a crash investigation that occurred Tuesday night in Greenville.

    On July 16, 2024, at approximately 11:35 p.m., troopers responded to the intersection of Montchanin Road and Buck Road, Greenville, for a report of a two-vehicle crash. Upon arriving, troopers observed two pickup trucks disabled in the roadway with front end damage. In the ensuing investigation, troopers learned a black Toyota Tundra, operated by John Fester, was traveling in the southbound lane of Montchanin Road, approaching the intersection with Buck Road. At the same time, a red Chevrolet F-150 was traveling in the northbound lane of Montchanin Road, approaching the same intersection. The Toyota failed to maintain its lane and entered the northbound lane in the Chevrolet’s path of travel. As a result, the front of the Toyota struck the front of the Chevrolet in the northbound lane of Montchanin Road.

    The 22-year-old driver of the Chevrolet was taken to an area hospital for serious injuries sustained in the crash.

    During the investigation, troopers observed multiple beer cans scattered within the proximity of the Toyota. Upon making contact with Fester, troopers observed multiple signs of impairment and smelled an odor of an alcoholic beverage emanating from Fester’s breath. Fester was subsequently taken into custody without incident and transported to Troop 1, where he was charged with the crimes listed below, arraigned by Justice of the Peace Court 11, and released after posting a $5,000 cash bond.

    Delaware State Police arrested 37-year-old Glenn Haught of Bishopville, Maryland for felony shoplifting.

    On July 17, 2024, at approximately 2:11 p.m., troopers responded to Harris Teeter, located at 31221 Americana Parkway in Selbyville for a shoplifting. When troopers arrived, they were told that an unknown suspect had stolen over $5,000 of consumable merchandise from the store since June. Through investigative means, troopers identified Glenn Haught as the suspect. Later in the day, troopers responded back to Harris Teeter when Haught returned and was being detained by asset protection.

    Haught was arrested and taken to Troop 4, charged with the crime listed below, arraigned by Justice of the Peace Court 2, and released on a $2,000 unsecured bond.

    Governor’s Task Force Arrests Dover Man for Drug Offenses and Resisting Arrest

    Delaware State Police arrested 34-year-old Jesus Torres of Dover, Delaware, on multiple drug and resisting arrest charges after a pursuit near Seaford yesterday.

    On July 16, 2024, at approximately 3:47 p.m., a member of the Sussex County Governor’s Task Force saw an Acura MDX fail to use its turn signal as it was turning onto German Road from Concord Pond Road. The Acura initially did not stop when the detective tried to pull it over. The Acura ultimately came to a stop at a dead end on Jewell Street, at which point the detective attempted to arrest the driver, later identified as Jesus Torres. Torres failed to comply with verbal commands and struck the detective several times as he physically resisted arrest. Torres was able to escape and fled on foot but was apprehended a short time later. After Torres was taken into custody, detectives searched the Acura and found approximately 21.95 grams of powder cocaine, and $932 in suspected drug dealing proceeds.

    Torres was taken to Troop 5, where he was charged with the crimes listed below, arraigned by Justice of the Peace Court 2, and committed to Sussex Correctional Institution on a $23,501 cash bond.

    State Police Arrest Two Teens for Wilmington Area Smoke Shop Burglary

    Delaware State Police have arrested a 15-year-old male from Newark, Delaware, and a 15-year-old male from Wilmington, Delaware, for a burglary that occurred early Monday morning at a business in Wilmington.

    On July 15, 2024, at approximately 3:58 a.m., troopers responded to Z Smoke Land, located at 5337 Limestone Road, Wilmington, for a report of a burglary. Upon arriving, troopers located one of the suspects behind the shopping center and gave him multiple verbal commands to stop. The suspect, later identified as a 15-year-old from Newark, did not comply and began running away; however, he was quickly apprehended following a K9 deployment. While apprehending the Newark teen, troopers saw a second suspect fleeing in a northerly direction. Troopers subsequently searched the area for the suspect, but were unable to locate him. In the ensuing investigation, detectives learned the two white male suspects drilled a hole into the smoke shop’s front door, then entered the business and removed various merchandise.

    The 15-year-old suspect from Newark was taken to an area hospital for non-life-threatening injuries sustained from the K9 apprehension. After the teen was discharged from the hospital, he was taken to Troop 2, where he was charged with multiple crimes. Through investigative means, Troop 2 Property Crimes Detectives identified the second suspect as a 15-year-old male from Wilmington and obtained a warrant for his arrest.


    The 15-year-old male from Newark was charged with the crimes listed below, arraigned by New Castle County Family Court, and released to a guardian on his own recognizance.

    The Dover Police Department is currently accepting applications for the 2024 Citizen’s Police Academy.  The Citizen’s Police Academy (CPA) is a program that meets once a week on Wednesday evenings from 6:00p.m-9:00pm.  The academy will begin on September 11th and ends on November 13th, 2024.  This program is designed to provide members of the Dover community with additional knowledge about their police department. It allows citizens of Dover to become more educated on Dover Police Department procedure and the pressures associated within law enforcement. We seek and invite a diverse group of people who either live in or work in the City of Dover to apply.  You do not have to be a Dover citizen to attend.  There is no cost to attend the Citizen Police Academy.

    The application deadline for 2024 is September 1st, 2024 by 3:00 p.m.!

    There are LIMITED spots available for the 2024 class.

    The purpose of the Citizen Police Academy is to accomplish three goals:

    1. To educate community members in Dover Police Department procedures and the pressures associated within law enforcement

    The Delaware State Police are investigating a bank robbery that occurred yesterday afternoon at the WSFS Bank in Wilmington.

    On July 16, 2024, at approximately 2:51 p.m., troopers responded to the WSFS Bank, located at 4601 Kirkwood Highway, Wilmington, for a report of a robbery. The preliminary investigation revealed an unknown white male suspect entered the bank and presented a demand note to the bank teller. The victim complied and the suspect fled on foot with an undisclosed amount of cash. Troopers attempted to locate the suspect in the surrounding area but were unable to find him.

    The suspect is described as an unknown white male wearing a black mask. Surveillance images and video are not yet available.

    The Delaware State Police Troop 2 Robbery Unit continues to investigate this incident. Detectives are asking anyone with information about this case to contact Detective D.     New Castle County Governor’s Task Force Arrest Man for Drug Charges at Wilmington Motel

    Delaware State Police arrested 65-year-old Lary Watson of Wilmington, Delaware, for drug charges following a search warrant at a motel in Wilmington on Thursday.

    On July 11, 2024, at approximately 8:15 p.m., members of the New Castle County Governor’s Task Force executed a search warrant at the Fairview Inn, located at 1051 S. Market Street, Wilmington. The search warrant was obtained following a drug investigation of Larry Watson, who was suspected of the large-scale distribution of narcotics from a room in the motel. Watson taken into custody without incident during the execution of the search warrant.

    A search of Watson’s room led to the discovery of the following items:

    • Approximately 224 bags containing approximately 1.5 grams of heroin
    • Approximately 10 grams of cocaine
    • Approximately 61.7 grams of crack cocaine
    • Various paraphernalia to include digital scales and distribution/packaging materials

    Watson was taken to Troop 2, where he was charged with the crimes listed below, arraigned by Justice of the Peace Court 11, and committed to Howard R. Young Correctional Institution on a $77,200 cash bond.

    Narrative:
    In recent months, the Dover Police Department has received several complaints regarding quality-of-life concerns in the downtown area, including prostitution. The Dover Police Department has been actively exploring strategies that will help address all of the concerns, including measure to deter patronage. Patronizing or soliciting the services of a prostitute is a crime punishable by law, and both the police and the Delaware Department of Justice are cracking down on offenders in Dover and throughout the State.

    On July 10th, 2024, the Dover Police Department, in collaboration with the Delaware Department of Justice, conducted an operation specifically targeting prostitution in the downtown area. As a result of the operation, the following individuals were arrested and charged:

    -Patronizing a Prostitute within 1000 feet of a church
    -Conspiracy in the 3rd Degree

    “To those who solicit prostitution, you have been put on notice,” said Attorney General Kathy Jennings. “I am grateful to our team and the Dover Police Department for this great work. We will continue to do everything in our power to protect the quality-of-life of citizens and businesses in Dover and across Delaware”

    Chief Johnson echoed his appreciation to the team that conducted the operation and also offered: “This operation is a small but significant step towards enhancing the safety of our downtown area. We appreciate the ongoing support of our residents, business owners, and local legislators. We will continue to explore strategies that effectively address all quality-of-life concerns that challenge the health of the community.” 

    All individuals charged were released on their own recognizance pending a future court date. They are presumed innocent until proven guilty.

    State Police Investigating Fatal Crash in Lewes

    Delaware State Police are investigating a fatal crash that occurred in Lewes last night.

    On July 15, 2024, at approximately 11:26 p.m., a BMW 328 was driving eastbound near the 16000 block of Gills Neck Road at an apparent high rate of speed. For reasons under investigation, the BMW left the road as it approached a sharp curve on Gills Neck Road. The BMW then continued onto a residential property, where it struck a wall/pillar, a tree, and a metal fence. After striking the tree, the BMW became engulfed in fire. The fire spread to the house causing extensive damage. The occupants of the house exited and were not injured.

    The driver and passenger were pronounced dead at the scene. Their names are being withheld until their family is notified.

    The roadway was closed for approximately three hours while the scene was investigated and cleared.

    The Delaware State Police Troop 7 Collision Reconstruction Unit continues to investigate this incident.     FTC and FDA Send Second Set of Cease-and-Desist Letters to Companies Selling Products Containing Delta-8 THC in Packaging Designed to Look Like Children’s Snacks

    For the second time in as many years, the Federal Trade Commission today sent cease-and-desist letters – jointly with the U.S. Food and Drug Administration (FDA) – to several companies currently marketing edibles containing Delta-8 tetrahydrocannabinol (THC) in packaging deceptively similar to many foods children eat such as Froot Loops and Chips Ahoy! chocolate chip cookies.

    “Companies that market and sell edible THC products that are easily mistaken for snacks and candy are not only acting illegally, but they are also putting the health of young children at risk,” said Samuel Levine, Director of the FTC’s Bureau of Consumer Protection. “Those that prioritize profits in front of children’s safety are at serious risk of legal action.”

    “Inadequate or confusing labeling can result in children or unsuspecting adults consuming products with strong resemblance to popular snacks and candies that contain delta-8 THC without realizing it,” said FDA Principal Deputy Commissioner Namandjé Bumpus, Ph.D. “As accidental ingestion and/or overconsumption of Delta-8 THC containing products could pose considerable health risks, the companies who sell these illegal products are demonstrating complete neglect for consumer safety. The FDA will continue to work to safeguard the health and safety of U.S. consumers by monitoring the marketplace and taking action when companies sell products that present a threat to public health.”

    The agencies sent letters to the following companies: 1) Hippy Mood (Levittown, Pennsylvania); 2) Life Leaf Medical CBD Center (Murrells Inlet, South Carolina); 3) Shamrockshrooms.com (online only); 4) Mary Janes Bakery Co. LLC and Miami Rave LLC (Miami, Florida); and 5) Earthly Hemps (Cape Coral, Florida).

    According to the letters, children can suffer serious health consequences from eating products containing cannabis, and they are at special risk of consuming edible THC products that appear similar to traditional foods because children are less likely to focus on or be able to understand text on the product labels.

    FTC-FDA THC cease and desist examples

    After reviewing online marketing for Delta-8 THC products sold by the companies, the FTC has determined that their advertising may violate the FTC Act’s prohibition against unfair or deceptive acts in the marketplace, including practices that present unwarranted health or safety risks. The letters stress that preventing practices that present such risks, particularly to young children, is one of the Commission’s highest priorities, and that imitating non-THC-containing food products that children consume is also misleading.

    The companies’ Delta-8 THC products mimic a range of food that appeal to children. Hippy Mood sells various Delta-8 THC cereal products with names like Berry Boss, Chocolate Balls, Cookie Cat Crunch, and Frutti Rocks that have colorful packages and other graphical elements causing them to resemble packaging for children’s cereal. For example, the Rainbow Rings Delta-8 Cereal package features a cartoon toucan on a red background and depicts ring-shaped cereal in multiple colors – all suggestive of the packaging for Kellogg’s Froot Loops cereal.

    Life Leaf Medical CBD Center sells a Delta-8 THC product that strongly resembles Nerds Rope candy, with both products comprising multi-colored crunchy candies attached to a gummy rope. The company’s packaging features a brightly colored background, the blue and white Nerds logo, and what appears to be the Nerds mascot — a cartoon anthropomorphic Nerds candy with two eyes, a prominent round nose, and two legs.

    Mary Janes Bakery Co. LLC and Miami Rave LLC sell Trips Ahoy chocolate chip cookies, which are in packaging that closely resembles that for Nabisco Chips Ahoy cookies, including the use of a blue background, the depiction of a chocolate chip cookie with a bite taken out on the left side displayed underneath the word “ORIGINAL” in all caps in a white font that mimics handwriting, and the use of a similar color scheme and font for the “Trips Ahoy!” logo as that used for Chips Ahoy! logo. The packaging for other products sold on the companies’ sites, including Stoney Patch Sour Watermelon Slices, Stoney Ranchers Hard Candy, Dank Ropes, and Flaming Hot Weedos, contain color schemes and graphical elements resembling Sour Patch Kids Watermelon Candy, Jolly Rancher hard candy, Nerds Rope, and Flamin’ Hot Cheetos.

    In the letters, the FTC demands the companies immediately stop marketing edible Delta-8 THC products that imitate conventional foods using advertising or packaging that is likely to appeal to young children. The FTC also strongly urges the sellers to review all of their marketing and product packaging for similar edible THC products and to take swift action and steps to protect consumers, especially young children, from these products. Finally, the FTC has asked each company to contact agency staff within 15 days to detail the specific actions it has taken to address the Commission’s concerns.

    In July 2023, the agencies sent joint warning letters to six companies that were marketing edible products containing Delta-8 THC in packaging almost identical to many snacks and candy children eat, including Doritos, Cheetos, and Nerds. The letters sent today follow up on that effort and put additional companies on notice that selling such products may violate the FTC Act and lead to enforcement action.

    Delaware State Police Troop 4 has issued a Gold Alert for 29-year-old Terontae Fisher of Frankford, Delaware. He was last seen near the 35000 block of Zion Church Road around 4:53 p.m. on July 15, 2024. Attempts to contact or locate him have been unsuccessful, and there is a concern for his safety and well-being.

    He is described as a black male, approximately 5’10” tall, weighing about 180 pounds, with brown eyes and brown hair. He was last seen wearing a black hoodie and unknown color gym shorts. It is unclear whether he is traveling on foot or by car.

    State Police Investigating Shooting Near Milton, Detectives Ask for Help Finding Suspect

    Delaware State Police are investigating a shooting that occurred near Milton last night.

    On July 14, 2024, at approximately 7:49 p.m., troopers responded to Cool Spring Road near Fisher Road, for a Ford Explorer that crashed into a utility pole. When troopers arrived, they learned that the driver, a 27-year-old man from Laurel, Delaware, had been shot in the back. He was taken to an area hospital with critical injuries. The preliminary investigation revealed that the victim was driving on West Springside Drive when the suspect fired several rounds at the Explorer, hitting the victim. After the shooting, the Explorer drove away and hit a utility pole a short distance away.

    Through investigative means, detectives identified the suspect responsible for the shooting as 24-year-old Timmarus Perry of Milton, Delaware. Detectives have obtained a warrant for Perry’s arrest for the shooting.

    Delaware State Police Troop 4 Criminal Investigations Unit continues to investigate this incident. Detectives are asking anyone with information about Perry’s whereabouts to call 9-1-1.     State Police Investigating Fatal Crash in Delmar

    The Delaware State Police are investigating a two-vehicle fatal crash that occurred last night in Delmar that left one man dead.

    On July 12, 2024, at approximately 9:30 p.m., a 1996 Subaru Outback was traveling southbound on Providence Church Road, approaching the intersection of Delmar Road. At the same time, a 2017 Nissan Rogue was traveling westbound on Delmar Road, approaching the intersection of Providence Church Road. The Subaru did not stop at the stop sign and entered the westbound lane of Delmar Road. As a result, the left front of the Nissan struck the left front of the Subaru in the westbound lane of Delmar Road.

    The 48-year-old driver of the Subaru, a man from Salisbury, Maryland, was not wearing a seatbelt at the time of the crash, was pronounced dead at the scene. His name is being withheld until his family and relatives are notified.

    The 40-year-old driver of the Nissan, a woman from Laurel, Delaware and three children passengers, sustained minor non-life-threatening injuries.

    The roadway was temporarily closed for approximately 3 hours while investigators examined the scene and the roadway to be cleared.

    Detectives Arrest Man for Royal Farms Robbery and Gun Offenses in New Castle

    Delaware State Police arrested 21-year-old Adrien Owens of New Castle, Delaware, for several felony charges following a New Castle area Royal Farms robbery investigation that began in June.

    On June 25, 2024, at approximately 11:28 a.m., troopers responded to a report of a robbery at the Royal Farms, located at 2160 New Castle Avenue in New Castle. The preliminary investigation revealed that an unknown black male suspect selected food products from the store and walked out of the business without paying for the items. Before fleeing, the suspect approached a Royal Farms employee in the parking lot and repeatedly punched him until the employee fell to the ground, which caused a minor injury.  The suspect then entered a black Chrysler sedan and fled in an unknown direction with the shoplifted items.

    Through investigative means, Troop 2 Robbery Detectives identified the suspect involved in the robbery as Adrien Owens and obtained a warrant for his arrest. On July 10, 2024, detectives located Owens and the black Chrysler sedan in the New Castle area. A brief struggle ensued as detectives made contact with Owens and attempted to take him into custody. As Owens continued resisting arrest, he made several attempts to reach for a black bag slung across his body. After Owens was taken into custody, a search of the black bag led to the discovery of a loaded Polymer80 ghost gun with a large capacity magazine containing 32 9mm rounds of ammunition.

    A computer inquiry revealed Owens is a convicted felon who is prohibited from possessing a firearm or ammunition. Owens was taken to Troop 2, where he was charged with the crimes listed below, arraigned by Justice of the Peace Court 2, and committed to Howard R. Young Correctional Institution on a $62,500 cash bond.

    Millsboro Daycare Employee Arrested for Child Abuse

    The Delaware State Police have arrested 47-year-old Veronica Ayres of Millsboro, Delaware for child abuse following an investigation at a Millsboro daycare.

    On June 3, 2024, Delaware State Police were notified by Division of Family Services of physical abuse of a child by a staff member at Bright Beginnings Daycare, located at 29735 John J. Williams Highway in Millsboro. Through the course of the investigation, detectives learned that on May 31, 2024, a staff member, identified as Veronica Ayres, struck a 2-year-old child in the face. Ayres’ employment was terminated the day of the incident.

    On July 9, 2024, Ayres turned herself in at Troop 4, where she was charged with the crime listed below, arraigned by Justice of the Peace Court 2, and released on her own recognizance.

  • FTC Publishes Inflation-Adjusted Monetary Thresholds for Three Exemptions in Franchise Rule

    The Federal Trade Commission has adjusted for inflation three monetary exemption thresholds used to determine whether the sale of a franchise qualifies for an exemption under the agency’s Franchise Rule. The rule requires franchisors to disclose key information prospective buyers need to evaluate the risks and benefits of investing in a franchise.

    The rule requires the FTC to adjust the thresholds for inflation every four years based on the Consumer Price Index. The exemptions from compliance with the rule, which will take effect July 12, 2024, are:

    • Sales where the buyer pays less than $735 (currently $615) for the franchise;
    • Sales requiring a large investment where the franchisee pays at least $1,469,600 (currently $1,233,000), excluding the cost of unimproved land and any franchisor (or affiliate) financing; and
    • Sales to large entities, such as multi-unit franchisees, airports, hospitals, and universities that have been in business for at least five years and have a net worth of at least $7,348,000 (currently $6,165,000).

    The Commission vote to approve the Federal Register notice was 5-0. The notice was published in the Federal Register.

  • FTC Takes Action to Ensure Franchisees’ Complaints are Heard and Protect Against Illegal Fees

    Today, the Federal Trade Commission and its staff took a suite of actions to address growing concern about unfair and deceptive practices by franchisors—to ensure that the franchise business model remains a ladder of opportunity to owning a business for honest small business owners.

    Among the actions being announced today by the FTC include a policy statement that warns that franchisors’ use of contract provisions, including non-disparagement clauses that prohibit franchisees’ communications with the government, violate the law. The statement emphasizes that franchisee reports and voluntary interviews are a critical part of FTC investigations and franchisees’ reluctance or inability to file reports and discuss their experiences may hamper the agency’s work to protect franchisees. Threats of retaliation against a franchisee for reporting potential law violations to the government are unlawful.

    FTC staff also released new guidance from franchisees that were not previously disclosed. In response to the FTC’s request for information, franchisees reported ever increasing payment processing and technology fees that make it difficult to make a living, while others identified undisclosed fees for training, marketing, property improvement, or any other product or service required by the franchisor. Today’s staff guidance makes clear that it is illegal for franchisors to impose undisclosed junk fees—fees that raise costs and which may make the difference between a profitable franchise and an unsustainable one.

    “Franchising is a chance for Americans to build a business, but the FTC has heard concerns about how unfair franchisor practices, like a failure to fully disclose fees upfront, go unreported thanks to a fear of retaliation,” said FTC Chair Lina M. Khan. “Today the Commission is making clear that contractual terms prohibiting franchisees from reporting potential law violations to the government are unfair, unenforceable, and illegal.”

    Today FTC staff also released an Issue Spotlight summarizing the top concerns raised by franchisees in response to a 2023 Request for Information. The FTC received more than 2,000 comments in response to the RFI, including from franchisees, franchisors and other stakeholders. The Issue Spotlight also describes staff analysis of Small Business Administration loan default data, finding that certain franchisors appear to present riskier investments than others.

    Finally, to facilitate continued engagement with all market participants on these topics, FTC staff is reopening the comment period for the 2023 Request for Information (RFI) related to franchise agreements and franchisor business practices. Interested franchise stakeholders can submit comments to the Commission until October 10, 2024 online at the regulations.gov comment submission portal.

    All of these franchise resources can be found at the newly launched FTC franchise website [link]. Prospective and current franchisees and franchisors can use the website as a single resource for the FTC’s latest franchising materials.

    The Commission voted 3-2 to adopt the policy statement. Commissioners Melissa Holyoak and Andrew N. Ferguson voted no and each issued dissenting statements.

    State Police Arrest Rehoboth Beach Man Following Pursuit in Kent County

    Delaware State Police arrested 38-year-old Joey Finney of Rehoboth Beach, Delaware, for multiple felony offenses following a pursuit yesterday near Felton.

    On July 9, 2024, at approximately 5:30 p.m. members of the Kent County Governor’s Task Force were on patrol on South Dupont Highway near Felton when they saw a black GMC Yukon driven by Joey Finney. Detectives recognized Finney from previous investigations, and knew he had active warrants for his arrest, which a computer check confirmed. Detectives attempted to pull the Yukon over in the parking lot of Royal Farms, located at 11460 South Dupont Highway but it sped away. During the pursuit, detectives saw Finney throw an object out of the Yukon while driving in a reckless manner on several Felton area streets and roads. The Yukon eventually came to a stop in the parking lot of Uncle Willie’s on Reeves Crossing Road after detectives successfully deployed stop sticks. Detectives found a cigarette pack that was thrown from the Yukon and discovered that it contained approximately 5.06 grams of powder cocaine and approximately .07 grams of heroin.

    Finney was arrested and taken to Troop 3, where he was charged with the crimes listed below, arraigned by Justice of the Peace Court 2, and committed to Sussex Correctional Institution on a $18,900 cash bond.

    Troopers Arrest Seaford Man for DUI and Gun Offenses After Traffic Stop

    Delaware State Police arrested 22-year-old Myles Andrews of Seaford, Delaware, on multiple gun and traffic-related charges after a traffic stop in Blades.

    On July 9, 2024, at approximately 12:47 a.m., a trooper on patrol saw a Mercedes E350 driving on South Market Street in Blades with multiple equipment violations. The trooper pulled the car over and spoke to the driver, identified as Myles Andrews, who showed signs of impairment. After the trooper administered Standardized Field Sobriety Tests, he was arrested for driving under the influence. During a search of the car, troopers found a loaded .40 caliber handgun with an obliterated serial number, several rounds of ammunition, a digital scale, and other drug paraphernalia.

    Andrews was taken to Troop 5, where he was charged with the crimes listed below, arraigned by Justice of the Peace Court 7, and committed to Sussex Correctional Institution on a $25,302 secured bond.

    The suspect is described as a light-skinned male, approximately 5’10”, wearing a white shirt, dark shorts, dark hat, and a cloth surgical mask. Surveillance footage was not available to provide at the time of this release.

  • FTC, ICPEN, GPEN Announce Results of Review of Use of Dark Patterns Affecting Subscription Services, Privacy

    The Federal Trade Commission and two international consumer protection networks announced the results of a review of selected websites and apps that showed a large percentage of the websites and mobile apps examined may use dark patterns, digital design techniques that may manipulate consumers into buying products or services or giving up their privacy. These techniques can steer consumers to take actions they would not otherwise have taken.

    The International Consumer Protection and Enforcement Network’s (ICPEN) annual review, which took place January 29-February 2, 2024, examined the use of possible dark patterns by 642 websites and mobile apps that offered subscription services from companies across the globe and in multiple languages. Officials from 27 authorities in 26 countries participated. Nearly 76% of the sites and apps examined as part of the review employed at least one possible dark pattern, and nearly 67% used multiple possible dark patterns. It was not reported whether these identified practices were used in an unlawful way or violated the laws of the affected countries.

    Participants examined several types of dark patterns, using descriptions of the practices as set out by the Organization for Economic Cooperation and Development. The potential dark patterns most often encountered during the review were sneaking practices, which involve hiding or delaying the disclosure of information that might affect a consumer’s purchase decision, and interface interference, techniques such as obscuring important information or preselecting options that frame information in a way that steers consumers toward making decisions more favorable for the business.

    ICPEN coordinated its review with the Global Privacy Enforcement Network (GPEN), a network of more than 80 privacy enforcement authorities. GPEN’s review—in which the FTC also participated—focused on websites and apps using design patterns that may encourage individuals to provide more personal information than they intended. Like the ICPEN review, the 26 privacy authorities participating in the GPEN review of sites operating in various countries found that the majority of websites and apps examined used at least one potential dark pattern. While there were no findings as to whether any of these instances rose to the level of law violations, the collaboration underscores the ways dark pattern techniques may impact not just consumers’ wallets but also their privacy choices.

    Today’s announcement coincides with the FTC officially assuming the 2024-2025 presidency of ICPEN, an international network of consumer protection authorities from more than 70 countries that protects consumers around the world by sharing information and encouraging global enforcement cooperation among consumer protection authorities.

    The FTC has worked for many years to identify and crack down on businesses that deploy deceptive and unlawful dark patterns. In 2022, the FTC released a staff report, Bringing Dark Patterns to Light, which detailed a wide range of dark patterns.

    Narrative: The Dover Police Department is investigating a serious motor vehicle crash that left two boys (15 and 14 years old) with serious injuries.  The 15-year-old male was operating a stolen motorcycle (Honda Grom) with the 14-year-old as a passenger.  The 15-year-old operator rode recklessly, running several red lights, and disobeying multiple traffic laws prior to the collision. The motorcycle was later determined to be stolen out of Philadelphia.  

    While traveling south on North DuPont Highway, approaching Lepore Drive, the 15-year-old operator of the stolen motorcycle ran a red light at a high rate of speed and collided with the side of a Honda CRV that was legally making a U-turn.  Both the operator and passenger of the motorcycle suffered serious injuries and were transported to Bayhealth Kent Campus for treatment.  Further investigation revealed that the 15-year-old operator was under the influence of alcohol as well. Both teens remain hospitalized in stable condition. Once released from medical care, the 15-year-old operator will be charged with the following offenses: -DUI -Vehicular Assault 2nd Degree (x2) -Receiving Stolen Property -Multiple Traffic Offenses

    Troopers Arrest Man for Robbery and Stolen Vehicle Charges Following Multiple Investigations Spanning Two Counties

    Delaware State Police arrested 42-year-old Thomas Pusey of Frankford, Delaware, for robbery and stolen vehicle charges following multiple investigations that occurred in Kent County and Sussex County on Friday.

    On July 5, 2024, at approximately 11:41 a.m., Troop 3 Troopers responded to Hertrich Chevrolet of Dover, located at 1450 South Dupont Highway, for a report of a stolen vehicle. Upon arriving, troopers learned an unknown white male suspect arrived at the dealership in a Mini Cooper and requested to test drive a vehicle. The suspect then got into a gray 2024 Chevrolet Silverado, locked himself inside, and disregarded the car salesman trying to stop him as he fled from the dealership without providing any identification. Troopers conducted a computer inquiry on the Mini Cooper the suspect arrived in and learned it was registered to a Frankford, Delaware address. Through investigative means, troopers learned the stolen Silverado was tracking at a residence on Powell Farm Road in Frankford. Troop 4 Troopers responded to the residence and located the stolen Silverado in the driveway. Troopers made contact with the home’s occupant, identified as Thomas Pusey, and took into custody without incident. Troopers further learned Pusey had trespassed onto his neighbor’s property and stole the Mini Cooper. Pusey then drove the stolen Mini Cooper to Hertrich Chevrolet of Dover, where he left the Mini Cooper, and stole the Silverado.

    During the investigation of the stolen Silverado, troopers identified Pusey as the suspect responsible for a robbery that occurred on July 5, 2024, at approximately 1:05 p.m., at the Walgreens, located at 34960 Atlantic Avenue in Ocean View. The robbery investigation revealed Pusey went behind the pharmacy counter after he was unable to fill his prescription and grabbed medications. Pusey then got into a physical altercation with two Walgreens employees who were attempting to prevent him from taking the medications. Pusey ultimately dropped the medications and fled from Walgreens in the stolen truck.

    Pusey was taken to Troop 4, where he was charged with the crimes listed below, arraigned by Justice of the Peace Court 2, and committed to Sussex Correctional Institution on a $13,450 cash bond.

    Delaware State Police detectives have arrested 21-year-old Marcus Yunas of Ellendale, Delaware, for multiple felony charges following a shooting in Ellendale in May.

    On May 8, 2024, at approximately 12:31 a.m., troopers responded to a home on South Old State Road in Ellendale for a disorderly incident. While responding, troopers were told that shots had been fired at the same location. When troopers arrived, they found a 20-year-old woman had been shot in the leg. During the investigation, they learned a gray SUV stopped in the road, the occupants argued with people in the backyard of the house and fired shots at them, hitting the woman and the house. Troopers located the SUV and the suspects a short time later. The suspects, identified as Isaiah Yunas, and two 17-year-olds were arrested. Detectives worked to locate a fourth suspect, identified as 21-year-old Marcus Yunas.

    On June 27,2024, Yunas was arrested in Maryland and on July 8, 2024, he was extradited to Delaware. He was taken to Troop 4, charged with the crimes listed below, arraigned by Justice of the Peace Court 2, and committed to Sussex Correctional Institution on a $92,100 cash bond.

  • Commission Testifies before House Energy and Commerce Subcommittee on Innovation, Data and Commerce

    The Federal Trade Commission today testified before the House Energy and Commerce Subcommittee on Innovation, Data and Commerce on the agency’s fiscal year 2025 budget and work to promote competition and protect consumers.

    In her testimony FTC Chair Lina M. Khan discussed the FTC’s work to protect privacy and data security; fight fraud, junk fees, and related harms affecting consumers; combat opioid recovery fraud and other health fraud; stand up for all consumers, including older adults, servicemembers, and historically underserved communities; and ensure that domestic manufacturers, independent repairers, and other small businesses have a chance to compete fairly.

    On the competition side, Chair Khan highlighted the FTC’s recent rule to ban noncompete clauses in employment contracts, which the Commission estimates affect one in five U.S. workers. Chair Khan highlighted the fact that the vast majority of public comments submitted by Americans were in support of the FTC’s rule. She also discussed the Commission’s work to prevent unlawful consolidation and to identify and stop anticompetitive conduct.

    While describing some of the agency’s many accomplishments, she noted that the FTC’s work requires resources and highlighted the value the agency provides to the American people. In FY 2023, every $1 of the FTC’s costs returned an estimated $14 in benefits to Americans through the Commission’s consumer protection and competition law enforcement efforts.

    Chair Khan was joined at the hearing by Commissioners Rebecca Kelly Slaughter, Alvaro Bedoya, Melissa Holyoak and Andrew N. Ferguson.

  • FTC Order Will Ban NGL Labs and its Founders from Offering Anonymous Messaging Apps to Kids Under 18 and Halt Deceptive Claims Around AI Content Moderation

    The Federal Trade Commission and the Los Angeles District Attorney’s Office are taking action against NGL Labs, LLC and two of its co-founders, Raj Vir and Joao Figueiredo, for a host of law violations related to their anonymous messaging app, including unfairly marketing the service to children and teens. The defendants will pay $5 million to settle the lawsuit, and will be banned from offering their “NGL: ask me anything” app to anyone under the age of 18.

    In their complaint, the FTC and Los Angeles DA’s Office allege that NGL and its co-founders not only actively marketed their service to children and teens, but that they also falsely claimed that its AI content moderation program filtered out cyberbullying and other harmful messages. In addition, the complaint alleges that the defendants sent fake messages that appeared to come from real people and tricked users into signing up for their paid subscription by falsely promising that doing so would reveal the identity of the senders of messages.

    “NGL marketed its app to kids and teens despite knowing that it was exposing them to cyberbullying and harassment,” said FTC Chair Lina M. Khan. “In light of NGL’s reckless disregard for kids’ safety, the FTC’s order would ban NGL from marketing or offering its app to those under 18. We will keep cracking down on businesses that unlawfully exploit kids for profit.”

    “The consequences of these actions can be severe. The anonymity provided by the app can facilitate rampant cyberbullying among teens, causing untold harm to our young people,” Los Angeles District Attorney George Gascón said. “We cannot tolerate such behavior, nor can we allow companies to profit at the expense of our children’s safety and well-being. Today’s charges send a clear message that deceptive practices and targeting vulnerable populations will not be tolerated.”

    California-based NGL was launched in 2021 as an anonymous messaging service that allows people to receive anonymous messages from their friends and social media followers. NGL and its operators marketed the app as a “safe space for teens” and claimed it uses “world class AI content moderation” including “deep learning and pattern matching algorithms” to combat cyberbullying and other harms.

    In their complaint, however, the FTC and the Los Angeles DA’s office allege that NGL and its operators actively marketed their service to kids despite being aware of the harms from similar services; made false claims about their AI content moderation program; deceived users with fake messages and other tactics aimed at driving up the number of paid users; failed to clearly disclose and obtain consent for recurring charges for its NGL Pro service; and violated the Children’s Online Privacy Protection Act Rule (COPPA Rule).

    After consumers downloaded the NGL app, they could share a link on their social media accounts urging their social media followers to respond to prompts such as “If you could change anything about me, what would it be?” Followers who clicked on this link were then taken to the NGL app, where they could write an anonymous message that would be sent to the consumer.

    After failing to generate much interest in its app, NGL in 2022 began automatically sending consumers fake computer-generated messages that appeared to be from real people. When a consumer posted a prompt inviting anonymous messages, they would receive computer-generated fake messages such as “are you straight?” or “I know what you did.” NGL used fake, computer-generated messages like these or others—such as messages regarding stalking—in an effort to trick consumers into believing that their friends and social media contacts were engaging with them through the NGL App.

    When a user would receive a reply to a prompt—whether it was from a real consumer or a fake message—consumers saw advertising encouraging them to buy the NGL Pro service to find out the identity of the sender. The complaint alleges, however, that consumers who signed up for the service, which cost as much as $9.99 a week, did not receive the name of the sender. Instead, paying users only received useless “hints” such as the time the message was sent, whether the sender had an Android or iPhone device, and the sender’s general location. NGL’s bait-and-switch tactic prompted many consumers to complain, which NGL executives laughed off, dismissing such users as “suckers.”

    In addition, the complaint alleges that NGL violated the Restore Online Shoppers’ Confidence Act by failing to adequately disclose and obtain consumers’ consent for such recurring charges. Many users who signed up for NGL Pro were unaware that it was a recurring weekly charge, according to the complaint.

    NGL Targeted Kids and Teens

    The FTC and Los Angeles DA also say that NGL and its operators aggressively marketed its service to children and teens even though they were aware of the dangers of cyberbullying on anonymous messaging apps. Company executives told employees to reach out to high school kids directly. Figueiredo urged employees to get “kids who are popular to post and get their friends to post” and noted that the “best way is to reach out on [Instagram] by finding popular girls on high school cheer [Instagram] pages,” according to the complaint.

    The complaint says the company falsely claimed that its AI-powered system would filter out cyberbullying and other harmful messages. In fact, users complained that NGL failed to prevent rampant cyberbullying and threats against children and teens. One consumer reported that their friend had attempted suicide because of the NGL app, according to the complaint.

    In addition to failing to crack down on cyberbullying, the FTC and Los Angeles DA say NGL also violated the COPPA Rule, which requires apps and other online services that are directed to or knowingly being used by children under 13 to inform their parents about the personal information they collect from children and obtain verifiable parental consent from their parents. According to the complaint, the company was aware that numerous children used the app and made no attempt to verify the age of its users, failed to obtain parental consent to collect and use personal data collected from children under 13, failed to honor parents’ request to delete their children’s personal data, and retained children’s data longer than reasonably necessary to fulfill the purpose for which the data was collected.

    Proposed Order

    In addition to the ban on marketing anonymous messaging apps to kids and teens under 18, the proposed order also requires NGL, Vir, and Figueiredo to pay $4.5 million, which will be used to provide redress to consumers, and a $500,000 civil penalty to the Los Angeles DA’s office. Under the proposed order, which must be approved by a federal court before it can go into effect, NGL and its operators also will be:

    • Required to implement a neutral age gate that prevents new and current users from accessing the app if they indicate that they are under 18 and to delete all personal information that is associated with the user of any messaging app unless the user indicates they are over 13 or NGL’s operators obtain parental consent to retain such data;
    • Prohibited from making misrepresentations about the sender of messages on any app and making similar false claims as outlined in the complaint;
    • Prohibited from making misrepresentations about the capabilities of any artificial intelligence technology, and its ability to filter out cyberbullying;
    • Prohibited from making misrepresentations related to negative options and required to disclose all details related to recurring charges; and
    • Required to obtain express informed consent from consumers prior to billing them for a negative option subscription, provide a simple mechanism for cancelling any negative option subscriptions, and to send reminders to consumers about negative option charges.

    The Commission vote authorizing the staff to file the complaint and stipulated final order was 5-0. The FTC filed the complaint and final order in the U.S. District Court for the Central District of California. Commissioners Melissa Holyoak and Andrew N. Ferguson issued separate statements.

    NOTE: The Commission files a complaint when it has “reason to believe” that the named defendants are violating or are about to violate the law and it appears to the Commission that a proceeding is in the public interest. Stipulated final orders have the force of law when approved and signed by the District Court judge.

    State Police Detectives Arrest Lewes Man for Felony Theft

    Delaware State Police have arrested 31-year-old William Rodenbaugh of Lewes, Delaware for felony theft and attempted theft from vehicles in the Angola area.

    On June 11, 2024, troopers began investigating a theft and attempted theft from vehicles in the Angola area near Lewes. During the investigation, troopers learned that an unknown suspect had gone through vehicles in the neighborhoods of Angola Beach and Estates, Bayridge Crossing, and The Cove between June 11 and June 14 where money had been stolen. Troopers also learned that the suspect had trespassed on several properties in those neighborhoods. Through investigative means, detectives identified William Rodenbaugh as the suspect and obtained a warrant for his arrest.

    On July 5, 2024, detectives arrested Rodenbaugh. He was taken to Troop 4, charged with the crimes listed below, arraigned by Justice of the Peace Court 2, and released on a $5,000 unsecured bond. However, he was committed to Sussex Correctional Institution on an existing capias warrant.

    State Police Issue Gold Alert for Missing Newark Woman

    Delaware State Police Troop 6 has issued a Gold Alert for 28-year-old Christina Dmeza of Newark, Delaware. She was last seen leaving Christiana Hospital around 9:46 a.m., on July 5, 2024.  Attempts to contact or locate her have been unsuccessful. There is a concern for her safety and well-being.

    Christina is described as a black female, approximately 5’5”-5’7″ tall, and weighing approximately 200 pounds. Her clothing description is unknown.

    Detectives Investigating Armed Robbery in Smyrna

    The Delaware State Police are investigating an armed robbery that occurred Saturday night in Smyrna.

    On July 6, 2024, at approximately 9:26 p.m., troopers responded to a report of an armed robbery that occurred at the intersection of Joseph Wick Drive and Willowwood Drive in Smyrna. The preliminary investigation revealed that the victim was walking home when he was approached by 2 unknown black male suspects. A physical altercation ensued between the suspects and victim, during which one of the suspects struck the victim in the back of the head with a handgun. After the altercation ended, the victim attempted to retrieve his jacket and other personal property from the street, however, one of the suspects threatened to shoot him if he grabbed the jacket. The 17-year-old victim, who had sustained a minor injury to the back of his head, then fled from the scene without his personal property.

    The suspects are described as black males, approximately 18-19 years old, approximately 5’6″-5’7″ tall, with average builds. Surveillance video and images of the suspects are not available.

    Troopers Arrest Man for 10th Offense DUI following Traffic Stop in Lincoln

    Delaware State Police arrested 58-year-old Anthony Nesmith of Lincoln, Delaware, for a 10th offense felony DUI following a traffic stop in Lincoln on Friday night.

    On July 5, 2024, at approximately 9:15 p.m., a trooper on patrol in the area of Greentop Road and Greely Avenue, Lincoln, observed a black Acura RL fail to maintain its lane as it was traveling westbound on Greely Avenue. The trooper conducted a traffic stop and made contact with the driver, identified as Anthony Nesmith. During the contact with Nesmith, the trooper observed multiple signs of impairment and administered Standardized Field Sobriety Tests. Following the tests, Nesmith was taken into custody without incident for driving under the influence. A computer inquiry revealed Nesmith had 9 prior DUI-related convictions.

    Nesmith was transported to Troop 7, where he was charged with the crime listed below, arraigned by Justice of the Peace Court 7, and committed to Sussex Correctional Institution on a $8,000 cash bond.

    The Delaware State Police are investigating a robbery that occurred Saturday night in Frederica.

    On July 6, 2024, at approximately 10:45 p.m., troopers responded to a report of a robbery that occurred on Sycamore Drive in Frederica. The preliminary investigation revealed that the victim was walking on Sycamore Drive when she was approached by an unknown black male suspect on a bicycle. The suspect demanded money from the victim before he proceeded to steal the victim’s backpack. The suspect then fled south on Sycamore Drive on the bicycle with the victim’s property. The victim was not injured.

    The suspect is described as a black male wearing dark-colored clothing. Surveillance video and images of the suspect are not available.

    State Police Investigating Fatal Pedestrian Crash on I-495

    The Delaware State Police are investigating a fatal pedestrian crash that occurred last night on I-495 near Edgemoor that left one woman dead.

    On July 7, 2024, at approximately 11:43 p.m., a white 2015 Honda Accord was traveling in the left lane of I-495 northbound, north of Edgemoor Road. At the same time, a pedestrian, who was not wearing any reflective clothing or carrying a flashlight, was attempting to cross from the left side of I-495 northbound to the right side. The pedestrian crossed in the path of the Honda and was struck in the left lane of I-495 northbound. After the collision, the Honda came to a stop on the left shoulder. During the investigation, it was discovered the pedestrian was initially operating a black 2014 Jeep Grand Cherokee, which was located approximately 1/4 mile north of the crash scene on the right shoulder with its hazard lights on.

    The pedestrian, a 38-year-old woman from Elkton, Maryland, was pronounced dead at the scene. Her name is being withheld until her family and relatives are notified.

    The driver of the Honda, a 47-year-old man from Bear, Delaware, was not injured.

    The roadway was closed for approximately 3 hours while the investigators examined the scene and cleared the roadway.

    Troop 2 Collision Reconstruction Unit Investigating Fatal Pedestrian Hit-and-Run Crash in Newark

    The Delaware State Police are investigating a fatal pedestrian hit-and-run crash that occurred yesterday afternoon in Newark that left one man dead.

    On July 5, 2024, at approximately 4:14 p.m., a pedestrian was walking northbound on the right shoulder of Salem Church Road, north of Michaels Lane. At the same time, an unknown white vehicle was also traveling northbound on Salem Church Road, north of Michaels Lane. For unknown reasons, the vehicle failed to maintain its lane of travel and drifted onto the shoulder, where it struck the pedestrian. The striking vehicle did not remain at the scene and fled northbound on Salem Church Road.

    The pedestrian, a 57-year-old man from Newark, Delaware, was taken by ambulance to an area hospital, where he was pronounced dead. His name is being withheld until his family and relatives are notified.

    The striking vehicle is a white vehicle of an unknown make and model with possible damage to the front right.
