    Troopers Arrest Man for Georgetown Home Burglary

    Delaware State Police arrested 64-year-old David Arvey Sr. of Laurel, Delaware, for the burglary of a Georgetown home this month.

    On April 13, 2024, at approximately 7:40 p.m., troopers were called to a home on the 24000 block of Lewes Georgetown Highway, Georgetown, Delaware, for a report of a burglary. Upon arriving, troopers learned a neighbor saw and notified the homeowner of an unknown male on the property. The unknown suspect stole items inside the house and fled in a white Ford pickup truck with decals and the words “Truck Company” on the front passenger side door. The investigation led troopers to David Arvey Sr. as the suspect in the burglary. Warrants were obtained for his arrest.

    On April 26, 2024, at approximately 3:50 p.m., Arvey Sr. was apprehended by Millsboro Police Department after a brief foot chase. He was taken to the Millsboro Police Department where he was charged with the below crimes, arraigned by Justice of the Peace Court 2, and released on a $5,000 unsecured bond. Avery was ultimately committed to the Sussex Correctional Institution on a $1,000 secured bond for two outstanding capiases issued by the Sussex County Superior Court.

    State Police Detectives Investigating Sussex County Daytime Burglaries

    The Delaware State Police are currently investigating four daytime residential burglaries that occurred between April 22, 2024, and April 23, 2024. The burglaries occurred in the neighborhoods of Compass Point and Kindleton in Lewes, and Kings Crossing in Lincoln. The suspects appear to be targeting the owners of various local nail salons. Some of these burglaries involved forced entry to the homes.

    The suspects were wearing construction vests, gloves, baseball hats, sweatshirts and surgical masks. The suspects are possibly operating a dark colored SUV.

    The Delaware State Police are encouraging residents to lock their doors, secure large amounts of cash and jewelry through secure locations such as banks or safety deposit boxes. Please be alert, remain vigilant, and report any suspicious activity by calling 9-1-1.

    *Update – Suspect Arrested* Troopers Searching for Magnolia Robbery Suspect

    Delaware State Police arrested 35-year-old George Brinkley of Milford, Delaware, for a robbery that occurred last week in Magnolia.

    On April 19, 2024, at approximately 9:05 a.m., troopers responded to a house on Gray’s Lane in Magnolia for a robbery. The preliminary investigation revealed that a man went into a woman’s house, began arguing with her, and forcefully stole her property. During the robbery, the man took her phone and threw it. She was not able to call 911.

    Through investigative means, troopers have identified 35-year-old George Brinkley as the suspect and obtained a warrant for his arrest. On April 26, 2024, Brinkley was taken into custody and transported to Troop 3. He was charged with the below crimes, arraigned by Justice of the Peace Court 2, and committed to the Sussex Correctional Institution on a $1,750 secured bond.

    Bridgeville Man Arrested for Falsely Reporting Burglary and Teens Arrested for Gun Offenses

    The Delaware State Police arrested 47-year-old Andrew May of Bridgeville, Delaware for falsely reporting a burglary and two teenagers for felony gun offenses.

    On April 17, 2024, at approximately 7:08 a.m., troopers responded to the 11000 block of Abby’s Way in Bridgeville for a burglary. May reported to troopers that someone had gotten into his house and stolen a gun. During the investigation, detectives learned that no one entered May’s house and that he gave the gun to one teenager and the ammunition and magazines to another. Through further investigation, detectives identified both teenagers. The investigation also revealed that the teenager sold the gun, and it has not been recovered. The investigation is ongoing.

    On April 19, 2024, May responded to Troop 4 and was arrested. He was charged with the crimes listed below, arraigned by Justice of the Peace Court 2, and released on a $4,000 unsecured bond.

    On April 19, 2024, the 15-year-old turned himself in at Troop 4, where he was charged with the crimes listed below, arraigned by Justice of the Peace Court 7, and committed to Stevenson House Detention Center on a $10,000 secured bond.

    • Possession of Ammunition by a Person Under 18 (Felony)

    On April 25, 2024, the 15-year-old turned himself in at Troop 5, where he was charged with the crimes listed below, arraigned by Justice of the Peace Court 3, and released to the custody of a parent.

    State Police Investigates Fatal Bicycle Crash in Felton

    Delaware State Police are investigating a fatal crash involving a bicyclist on Friday afternoon in Felton.

    On April 26, 2024, at approximately 5:09 p.m., a 2005 Chevrolet Tahoe was traveling westbound on Willow Grove Road approaching Logan Drive. At the same time, a bicyclist was traveling southbound on Logan Drive, approaching Willow Grove Road. For reasons under investigation, the bicyclist did not stop at the stop sign on Logan Road, entered the westbound lane of Willow Grove Road, and into the path of the Chevrolet. As a result, the Chevrolet struck the bicyclist.

    The 57-year-old man from Felton, Delaware, died at the scene. The identity of the bicyclist is being withheld until family and relatives are notified.

    The 63-year-old driver of the Chevrolet, a woman from Camden, Delaware, was not injured.

    The roadway was closed for approximately 3 hours while investigators examined the scene and cleared the roadway.

    State Police Issue Gold Alert for Missing Maryland Woman

    Delaware State Police Troop 5 has issued a Gold Alert for 85-year-old Joanna Kellogg of Severna Park, Maryland, after she left her residence on April 26, 2024, to go to Selbyville, Delaware. Attempts to contact or locate her have been unsuccessful, and there is a concern for her safety and well-being.

    Joanna is described as a white female, approximately 5’ tall, weighing approximately 160 pounds with gray hair. She was last seen wearing a gray sweater. Joanna is operating a 2015 Toyota RAV4 bearing Maryland registration 3DK6254.

    Anyone with information regarding Joanna’s whereabouts is asked to contact Delaware State Police Troop 5 by calling (302) 302-337-1090 or dialing 9-1-1. Information may also be provided by contacting Delaware Crime Stoppers at 1-800-847-3333.

    State Police Arrest Man for Multiple Felony Offenses Following Domestic-Related Pursuit in New Castle County

    Delaware State Police arrested 20-year-old Noah Howell of Seaford, Delaware, for multiple felony offenses after a domestic altercation ended in a pursuit early this morning in New Castle County.

    On April 25, 2024, at approximately 11:39 p.m., troopers responded to a distress call from a woman on her way to Delaware State Police Troop 2, located at 100 Cpl/1 Stephen J. Ballard Way, Newark. The caller reported being pursued by her ex-boyfriend, Noah Howell. She also reported Howell struck her vehicle multiple times with his blue Hyundai Santa Fe on the way to Troop 2. Upon arriving at Troop 2’s parking lot, Howell struck the victim’s vehicle again with his Hyundai, before he climbed onto the hood of the victim’s car. Despite verbal commands from troopers, Howell got back into his vehicle and began accelerating when a trooper tried to stop him through the open driver’s side window. As a result, the trooper was thrown from the SUV. While attempting to flee, Howell’s SUV crashed into two vehicle barrier posts in front of Troop 2.

    Following that, Howell fled from Troop 2’s parking lot, and entered the adjoining property of William Keene Elementary School, located at 200 Cpl/1 Stephen J. Ballard Way. Therein, Howell drove through a metal fence on the school’s property as he fled toward Pulaski Highway. In the ensuing pursuit, Howell committed numerous traffic violations, ultimately culminating in a collision with a Dart bus at the intersection of Route 1 and Route 72. Following the crash, Howell attempted to escape on foot but was quickly apprehended. While taking Howell into custody, troopers smelled an odor of an alcoholic beverage emanating from his person. A subsequent search of his vehicle revealed multiple empty liquor bottles.

    Howell was taken to an area hospital for a non-life-threatening injury sustained during the crash. The driver and sole occupant of the DART bus, and the victim, whose identity will not be disclosed, were not injured during the incident. Three troopers were injured during the incident. The troopers were treated and released from an area hospital with non-life-threatening injuries.

    After Howell was discharged from the hospital, he was taken to Troop 2, where he was charged with the crimes listed below, arraigned by Justice of the Peace Court 2, and committed to Howard R. Young Correctional Institution on a $32,700 cash bond.

    Troopers Arrest Three for Millsboro Burglary

    Delaware State Police arrested 61-year-old William Nickerson, 45-year-old Bonnie Osborne, and 21-year-old Alan Dardon-Perez, all of Millsboro, for burglary and related charges.

    On April 25, 2024, at approximately 7:33 p.m., troopers responded to the 21000 block of Paul Drive in Millsboro for a burglary. When troopers arrived, they learned items were stolen from a house under construction. The victims found their stolen property at another house nearby on Paul Drive and confronted a possible suspect. During the confrontation, the possible suspect threatened the victim. The investigation revealed that multiple items had been stolen from the house. The investigation led troopers to Nickerson, Osborne, and Dardon-Perez as the suspects in the burglary.

    Nickerson was arrested and taken to Troop 4, where he was charged with the crimes listed below, arraigned by Justice of the Peace Court 7, and released on his own recognizance.

    Detectives Arrest Pair for Gun and Drug Offenses Following Search Warrant at Milton Residence

    The Delaware State Police arrested 52-year-old Randolph Gooner, and 47-year-old Carey Rust, both of Milton, Delaware, for several felony gun and drug offenses stemming from a search warrant at a residence in Milton earlier this month.

    On April 12, 2024, at approximately 6:00 a.m., members of the Sussex County Governor’s Task Force, Sussex County Drug Unit, and Delaware State Police Special Operations Response Team executed a search warrant at a residence on the 22800 block of Reynolds Pond Road in Milton. The search warrant was obtained following a drug investigation of Randolph Gooner, who was suspected of the large-scale distribution of narcotics. Upon arriving at the residence, detectives found Gooner in the driver’s seat of a Chevrolet Silverado parked in the driveway. Gooner disregarded verbal commands by troopers to get out of the SUV, and physically resisted as troopers attempted to remove him from the vehicle. After a brief struggle, Gooner was taken into custody, and a search of his person led to the discovery of a loaded handgun, and two oxycodone hydrocholoride pills. Detectives then proceeded to search the home.

    A search of the home led to the discovery of the following items:

    • 14 shotguns
    • 6 rifles
    • 4 handguns
    • Approximately 30.28 grams of cocaine
    • Approximately 51.66 grams of methamphetamine
    • Approximately 8.48 grams of psychedelic mushrooms
    • Various amounts of alprazolam, amphetamine, buprenorphine, clonazepam, homatropine methylbromide hydrocodone, oxycodone, and tramadol pills, for which Gooner was unable to produce a prescription
    • Various paraphernalia to include digital scales and distribution/packaging materials

    Following the search of the home, troopers conducted a K9 scan on the Chevrolet Silverado, and a Toyota Tacoma parked on the property. Troopers discovered the Tacoma belonged to Gooner’s significant other, Carey Rust. Troopers searched both vehicles after the K9 scan positively alerted to the presence of narcotics located within the vehicles. A search of the Silverado led to the discovery of a rifle that was concealed in the trunk. A search of the Tacoma led to the discovery of five amphetamine and dextroamphetamine pills. As a result of the drugs found in the Tacoma, troopers obtained a warrant for Rust’s arrest.


    Randolph Gooner was taken to Troop 4, where he was charged with the crimes listed below, arraigned by Justice of the Peace Court 3, and committed to Sussex Correctional Institution on a $453,950 cash bond.

    Troopers Arrest Smyrna Man for Aggravated Menacing

    Delaware State Police arrested 35-year-old Dennis Piasio of Smyrna, Delaware, for aggravated menacing and other charges yesterday.

    On April 25, 2024, at approximately 12:16 p.m., troopers responded to an aggravated menacing on Arthursville Road near Main Street in Hartly. When troopers arrived, they learned that two men were driving northbound on Arthursville Road, leaving a construction site. A blue car was driving southbound in the northbound lane and stopped in front of the vehicle. The driver of the blue car, identified as Dennis Piasio, who the two men know, got out and opened the victims’ driver side door. He pushed the driver against the seat, grabbed the passenger and pointed a gun at him. The driver was able to push Piasio away from the vehicle and leave the area. The victims were not hurt.

    Piasio turned himself in at Troop 3, where he was charged with crimes listed below, arraigned by Justice of the Peace Court 2, and released after posting a $74,000 secured bond.

    State Police Investigating Fatal Crash Near Millsboro

    Delaware State Police are investigating a fatal crash that occurred near Millsboro on Tuesday night.

    On April 23, 2024, at approximately 11:46 p.m., a BMW 328 was driving westbound on Friendship Road west of Independence Drive. For reasons still under investigation, the driver lost control of the car causing it to leave the north side of the road, drive through wet grass, and hit a tree.

    The 19-year-old-driver of the BMW, a man from Millsboro, was not properly restrained. He was taken to a nearby hospital with critical injuries. On April 24, 2024, he died from injuries sustained in the crash. His name is being withheld until his family is notified.

    Officers checked the area where the suspects ran and located a 9mm handgun.

    The ensuing investigation revealed that the victim was robbed at gunpoint by the suspects that fled in the black Dodge Durango.

    The three suspects were taken back to Dover Police Department where they were processed and arraigned.

    The first 17-year-old of Dover was committed to Stevenson House Correctional Facility on $25,000 secured bond on the following charges:

    Home products company Williams-Sonoma will be required to pay a record civil penalty of $3.175 million for violating a 2020 Federal Trade Commission order requiring the retailer to tell the truth about whether the products it sells are Made in USA.

    In a complaint filed by the Department of Justice upon notification and referral from the FTC, the agency charges that Williams-Sonoma listed multiple products for sale as being “Made in USA” when in fact they were made in China and other countries. The company has agreed to a settlement that requires them to pay the civil penalty, which is the largest ever in a Made in USA case.

    “Williams-Sonoma claimed its products were made in the United States even though they were made in China,” said FTC Chair Lina M. Khan. “Williams-Sonoma’s deception misled consumers and harmed honest American businesses. Today’s record-setting civil penalty makes clear that firms committing Made-in-USA fraud will not get a free pass.”

    The FTC sued Williams-Sonoma in 2020, charging that the company advertised multiple product lines under its Goldtouch, Rejuvenation, Pottery Barn Teen and Pottery Barn Kids brands as being all or virtually all made in the USA when they were not. The company agreed to an FTC order that required them to stop their deceptive claims and follow Made in USA requirements.

    The current complaint notes that the FTC became aware that the company was marketing mattress pads under its PBTeen brand as “Crafted in America from domestic and imported materials” when it was actually made in China. The FTC then investigated six other products the company advertised as Made in USA and found those claims were also deceptive in violation of the 2020 order.

    In addition to the civil penalty, the federal court settlement also requires Williams-Sonoma to submit annual compliance certifications, and imposes a number of requirements about the claims the company makes, reinforcing requirements from the 2020 FTC order:

    • Restriction on unqualified claims: Williams-Sonoma will be prohibited from making unqualified U.S.-origin claims for any product, unless it can show that the product’s final assembly or processing—and all significant processing—takes place in the U.S., and that all or virtually all ingredients or components of the product are made and sourced in them U.S.
    • Requirement for qualified claims: The company is required to include in any qualified Made in USA claims a clear and conspicuous disclosure about the extent to which the product contains foreign parts, ingredients or components, or processing.
    • Requirement for assembly claims: The company must also ensure, when claiming a product is assembled in the U.S., that it is last substantially transformed in the U.S., its principal assembly takes place in the U.S., and U.S. assembly operations are substantial.

    The FTC is committed to ensuring that “Made in USA” claims are truthful. The FTC’s Enforcement Policy Statement on U.S. Origin Claims provides guidance on making non-deceptive “Made in USA” claims. In addition, the FTC’s Made in USA Labeling Rule went into effect on Aug. 13, 2021. Companies that violate the Rule from that date forward may be subject to civil penalties.

    The Commission vote to authorize the staff to refer the complaint to the DOJ and to approve the proposed consent decree was 3-0. The DOJ filed the complaint and proposed consent decree in U.S. District Court for the Northern District of California. The FTC thanks Truth In Advertising.org for their assistance in this matter.

  • FTC Finalizes Changes to the Health Breach Notification Rule

    The Federal Trade Commission today announced it has finalized changes to the Health Breach Notification Rule (HBNR) that will strengthen and modernize the rule by clarifying its applicability to health apps and other similar technologies and expanding the information that covered entities must provide to consumers when notifying them of a breach of their health data.

    The HBNR requires vendors of personal health records (PHR) and related entities that are not covered by the Health Insurance Portability and Accountability Act (HIPAA) to notify individuals, the FTC, and, in some cases, the media of a breach of unsecured personally identifiable health data. It also requires third party service providers to vendors of PHRs and PHR related entities to notify such vendors and PHR related entities following the discovery of a breach.

    “Protecting consumers’ sensitive health data is a high priority for the FTC,” said Samuel Levine, Director of the FTC’s Bureau of Consumer Protection. “With the increasing use of health apps and connected devices, the updated HBNR will ensure it keeps pace with changes in the health marketplace.”

    In May 2023, the FTC sought comment on proposed changes to the HBNR. After receiving approximately 120 comments from a broad range of individuals and stakeholders, the Commission has finalized changes to the rule, including:

    • Revising definitions: The Commission revised several definitions to underscore the final rule’s application to health apps and similar technologies not covered by HIPAA. This includes modifying the definition of “PHR identifiable health information” and adding two new definitions for “covered health care provider” and “health care services or supplies”;
    • Clarifying breach of security: It clarifies that a “breach of security” under the final rule includes an unauthorized acquisition of identifiable health information that occurs as a result of a data security breach or an unauthorized disclosure;
    • Revising definition of PHR related entity: The definition of “PHR related entity” has been revised in two ways that pertain to the rule’s scope. The revised definition makes clear that the final rule covers entities that offer products and services through the online services, including mobile applications, of vendors of personal health records. It also makes clear that only entities that access or send unsecured PHR identifiable health information to a personal health record — rather than entities that access or send any information to a personal health record — qualify as PHR related entities;
    • Clarifying multiple sources of PHR identifiable health information: The final rule clarifies what it means for a personal health record to draw PHR identifiable health information from multiple sources;
    • Expanding use of electronic notification: The final rule authorizes the expanded use of email and other electronic means of providing clear and effective notice to consumers of a breach;
    • Expanding consumer notice content: The final rule expands the required content that must be provided in the notice to consumers. For example, the notice would be required to include the name or identity (or, where providing the full name or identity would pose a risk to individuals or the entity providing notice, a description) of any third parties that acquired unsecured PHR identifiable health information as a result of a breach of security;
    • Changing timing requirement: The final rule modifies when the FTC must be notified under the rule. For breaches involving 500 or more individuals, covered entities must notify the FTC at the same time they send notices to affected individuals, which must occur without unreasonable delay and in no case later than 60 calendar days after the discovery of a breach of security; and
    • Improving readability: The final rule also includes changes to improve the rule’s readability and promote compliance.

    The final rule will go into effect 60 days after its publication in the Federal Register.

    In addition to amending the HBNR, the FTC has recently taken action against companies for violating the HBNR, including GoodRx and Easy Healthcare (publisher of the Premom app).

    The Commission voted 3-2 to approve the publication of the final rule in the Federal Register with Commissioners Melissa Holyoak and Andrew N. Ferguson voting no. Chair Lina M. Khan along with Commissioners Rebecca Kelly Slaughter and Alvaro Bedoya issued a separate statement, while Commissioner Holyoak, joined by Commissioner Ferguson, issued a dissenting statement.

    Troopers Arrest Two Men for Drug Offenses and Resisting Arrest Following Pursuit in New Castle County

    Delaware State Police arrested Zion Adeduwon, 22, of Bowie, Maryland, and Bryce Jenifer, 22, of Silver Spring, Maryland, on drug charges and resisting arrest following a pursuit that took place early yesterday morning in New Castle County.

    On April 24, 2024, at approximately 1:45 a.m., a trooper patrolling the area of I-95 and the Biden Welcome Center observed a white 2020 BMW 3 series traveling northbound on I-95 with its four-way flashers on. A computer inquiry of the BMW’s Missouri registration revealed the registration was fictitious. The trooper initiated a traffic stop, however, the BMW did not stop and fled at a high rate of speed. In the ensuing pursuit, the BMW drove in a reckless manner as it traveled on multiple Wilmington area roadways. The pursuit was terminated as the BMW approached a construction zone on I-95 southbound in the area of State Route 896.  After the pursuit was terminated, troopers observed the BMW disregard the lane closure and drive into the closed lanes, where active construction was taking place. A short time later, troopers observed the BMW in the area of State Route 4 eastbound and Churchmans Road, and attempted to stop the vehicle. The BMW did not stop and continued to flee at a high rate of speed. The vehicle pursuit ultimately ended on West Newport Pike after the BMW collided with a Delaware State Police Tahoe, then went off the roadway, and crashed into a mailbox. The driver and front passenger fled from the car towards a backyard on Glenmore Drive. After a brief foot chase, the driver, identified as Zion Adeduwon, and the front passenger, identified as Bryce Jenifer, were taken into custody without incident.

    A search of Adeduwon’s person led to the discovery of $6,141 in suspected drug proceeds. A search of the BMW led to the discovery of approximately 1,498 grams of marijuana, and drug paraphernalia.

    Adeduwon and Jenifer were transported to Troop 2, where they were charged with multiple crimes.


    Adeduwon was charged with the crimes listed below, arraigned by Justice of the Peace Court 2, and released on a $5,555 unsecured bond.

    Delaware State Police arrested 48-year-old Regina Bonacquisti of Ocean View, Delaware, for felony assault of a senior citizen.

    On April 23, 2024, at approximately 7:00 p.m., troopers responded to an assault in the 37000 block of Mahogany Street near Ocean View. When troopers arrived, they spoke with a 66-year-old woman who said that she was assaulted by a woman, later identified as Regina Bonacquisti. During the investigation, troopers learned that the 66-year-old woman was in the driveway of a house when Bonacquisti, who she does not know, aggressively approached her from the roadway, assaulted her, and damaged her vehicle. After the assault, Bonacquisti left the scene. The victim was taken to an area hospital for her injuries. Warrants were obtained for Bonacquisti’s arrest.

    On April 24, 2024, Bonacquisti was arrested and taken to Ocean View Police Department, where she was charged with the crimes listed below, arraigned by Justice of the Peace Court 2, and committed to Sussex Correctional Institution on a $2,700 cash bond.

    The Delaware State Police have identified 47-year-old Shawn Jason of Atlantic City, New Jersey, as the suspect involved in an attempted armed robbery at a CVS in Claymont last month.

    On March 8, 2024, at approximately 7:00 p.m., troopers responded to a report of an attempted armed robbery at the CVS, located at 702 Naamans Road in Claymont. A preliminary investigation revealed that an unknown black male suspect entered the store with a firearm, jumped over the pharmacy counter, and demanded drugs from the pharmacist. While the pharmacist attempted to unlock the safe, the suspect fled the store without any proceeds.

    Troop 2 Robbery Detectives in collaboration with out-of-state law enforcement agencies developed Shawn Jason as the suspect involved in the robbery and obtained a warrant for his arrest. On April 24, 2024, Jason was located and arrested in Pennsylvania, where he is now incarcerated. Upon extradition to Delaware, Jason will be charged with the crimes listed below.

    Delaware State Police Troop 1 is issuing a Gold Alert for 16-year-old Jahona Williams of Wilmington, Delaware. Jahona was last seen on April 24, 2024, at Mt. Pleasant High School, located at 5201 Washington Street Extension in Wilmington. Attempts to contact or locate her have been unsuccessful. There is a concern for her safety and well-being.

    Jahona is described as a black female, approximately 5’07” tall, weighing approximately 155 pounds. She was last seen wearing black tights and a black hoodie.

  • FTC Takes Action Against Bill Payment Company Doxo for Misleading Consumers, Tacking on Millions in Junk Fees

    The Federal Trade Commission is taking action against bill payment company Doxo and two of its co-founders, charging that the company uses misleading search ads to impersonate consumers’ billers and deceptive design practices to mislead consumers about millions of dollars in junk fees they tacked on to consumers’ bills.

    The complaint alleges that Doxo, its CEO and co-founder Steve Shivers, and its vice president and co-founder Roger Parks, have known from years of internal surveys and complaints from tens of thousands of consumers and hundreds of billers of the harms their business model caused consumers and have still failed to correct their unlawful actions.

    The FTC’s complaint notes that, even though Doxo immediately charges a consumer for payment, in many instances, the company then prints a paper check that is mailed to the biller – arriving days or sometimes weeks after the customer believes their bill is paid. As a result, many consumers have had their utilities shut off, have had car and health insurance lapse, and have been charged fees and fines even though they paid their bills on time.   

    “Doxo intercepted consumers trying to reach their billers and tricked them into paying millions of dollars in junk fees,” said Samuel Levine, Director of the FTC’s Bureau of Consumer Protection. “The FTC will continue to take action when companies use deceptive design tricks to harm consumers.”

    According to the FTC’s complaint, Doxo purchases search engine ads that appear when consumers search online for information about companies they owe bills to. These ads are created to mislead consumers into believing that Doxo is affiliated with those companies. The complaint cites as an example Doxo’s ads that are designed to trick consumers into believing they are affiliated with a prominent medical testing company. Doxo bought ads that appeared when consumers searched for the company’s name or website, and the ads included headlines that included the company’s name but not Doxo’s.

    Doxo’s landing pages prominently feature the biller’s company name and sometimes even their logo, even though Doxo generally does not have a formal relationship with the biller. In fact, less than two percent of the companies in Doxo’s “network” authorize Doxo to accept payments on their behalf, according to the complaint.

    Once consumers provide their billing details, Doxo then shows a final payment amount, onto which the company tacks an extra fee that is included only at the final payment step, and even then only in greyed-out fine print.

    The complaint also outlines Doxo’s deceptive process to sign consumers up for its recurring subscription program, noting that, until February 2024, after learning of the FTC’s proposed complaint, the company would automatically check the box to sign consumers up when they clicked to read a terms of service document. In addition, while Doxo said consumers would save on the company’s “delivery” fees, consumers paying for the monthly plan are still often charged those fees.

    Tens of thousands of consumers have complained about Doxo’s deceptive practices, according to the complaint, with many pointing to the fact that they paid more than their actual bill amount, even when the actual billers did not charge for online payments. The complaints were so numerous that, in 2021, employees of a major search engine declared Doxo’s ads to be “super misleading,” but the company still has not changed the fundamental structure of its ads. The complaint points to multiple instances in which the company’s top executives, Shivers and Parks, were personally made aware of complaints against Doxo.

    The complaint alleges that Doxo violated the FTC Act, the Restore Online Shoppers’ Confidence Act, and the Gramm-Leach-Bliley Act.

    The Commission vote authorizing the staff to file the complaint was 5-0. The complaint was filed in the U.S. District Court for the Western District of Washington.

    State Police Arrest Teen for Vehicle Theft in Smyrna

    Delaware State Police arrested a 17-year-old male of Townsend, Delaware, for stealing a Ford Explorer from a residence in Smyrna earlier this month.

    On April 4, 2024, at approximately 5:03 a.m., troopers responded to a residence on the 5500 block of Dupont Parkway, Smyrna, for a report of a vehicle theft. Upon arriving, troopers learned an unknown suspect stole the victim’s gray 2020 Ford Explorer from her driveway. During the investigation, troopers discovered the suspect attempted to gain entry into multiple vehicles on Dupont Parkway leading up to him stealing the victim’s unlocked Ford. The Ford was recovered on April 5, 2024, after it was found abandoned on the shoulder of Red Hill Road in Maryland by a deputy with the Cecil County Sheriff’s Office. Through investigative means, Troop 3 Property Crimes Detectives developed the 17-year-old male as the suspect involved in the vehicle theft and obtained a warrant for his arrest.

    On April 24, 2024, the 17-year-old male turned himself in at Troop 9. He was charged with the crime listed below, arraigned by Justice of the Peace Court 11, and released on a $2,000 unsecured bond.

    Delaware State Police Troop 9 has issued a Gold Alert for 30-year-old David Allen of Dover, Delaware. He left his residence on April 22, 2024, and has not returned. Attempts to contact or locate him have been unsuccessful, and there is a concern for his safety and well-being.

    David is described as a white male, approximately 6’3” tall, weighing approximately 170 pounds with brown eyes and brown hair. His clothing description is unknown. David is driving a blue 2008 Dodge Caliber bearing Delaware registration 36698.

    Troop 2 Collision Reconstruction Unit Investigating Fatal Pedestrian Hit-and-Run Crash in Newark

    The Delaware State Police continues to investigate a Newark area hit-and-run crash that occurred last week after the 53-year-old pedestrian died from injuries sustained in the crash.

    On April 16, 2024, at approximately 8:16 a.m., a pedestrian was walking eastbound across the crosswalk on Kingston Road, at the intersection with East Chestnut Hill Road. At the same time, an unknown vehicle traveling westbound on East Chestnut Hill Road made a right turn onto northbound Kingston Road and struck the pedestrian. The striking vehicle did not remain at the scene and fled in an unknown direction.

    The pedestrian, a 53-year-old man from Newark, Delaware, was taken by ambulance to an area hospital, where he was admitted for life-threatening injuries. On April 23, 2024, he died from injuries sustained in the crash. His name is being withheld until his family and relatives are notified.

    The make and model of the striking vehicle are unknown.

    Delaware State Police are investigating a fatal crash that occurred near Bethany Beach on Friday night.

    On April 19, 2024, at approximately 6:58 p.m., a Ford F-350 pick-up truck, pulling a trailer, was driving southbound in the right lane on Coastal Highway south of Dune Road. At the same time a Jaguar F-type was driving southbound on Coastal Highway, behind the F-350. For reasons under investigation, the driver of the Jaguar lost control causing him to hit the trailer being pulled by the F-350. As a result, the trailer disconnected from the F-350 and overturned.

    The driver of the F-350, a 61-year-old man, and passenger, a 59-year-old woman, both of Drums, Pennsylvania were not hurt. The driver of the Jaguar, an 87-year-old-man from Rehoboth Beach was taken to a nearby hospital with serious injuries. On April 21, 2024, he died from injuries sustained in the crash. His name is being withheld until his family is notified.

    State Police Detectives Arrest Lincoln Man for Georgetown Burglary

    The Delaware State Police arrested 32-year-old Frank Montgomery of Lincoln, Delaware for a burglary and theft in Georgetown last month.

    On April 9, 2024, troopers were called to a home in the 26000 block of Lewes-Georgetown Highway in Georgetown for a burglary. When troopers arrived, they found someone had entered a storage container on the property sometime in late March. Once inside, the suspect took a 4-wheeler, a mini-bike plus numerous power tools. On April 18, 2024, detectives learned of a theft in the 25000 block of Prettyman Road in Georgetown, where lawn and garden equipment were stolen from a 66-year-old woman. The investigation led detectives to Frank Montgomery as the suspect in both incidents, and warrants were obtained for his arrest.

    On April 22, 2024, Montgomery was arrested and taken to Troop 4, where he was charged with the crimes listed below, arraigned by Justice of the Peace Court 2, and released on his own recognizance.

    State Police Arrest Man for Felony Assault at Delaware Park Casino

    Delaware State Police arrested 28-year-old Tavon White of Newark, Delaware, for a felony assault that occurred early Friday morning at Delaware Park Casino in Wilmington.

    On April 19, 2024, at approximately 2:30 a.m., troopers responded to a report of a fight at Delaware Park Casino, located at 777 Delaware Park Boulevard in Wilmington. Upon arriving, troopers made contact with the victim, and the suspect, identified as Tavon White, who were no longer fighting. During the investigation, troopers discovered White got into an argument with the victim after losing a poker game. The argument escalated into a physical altercation after White began punching the victim in the face. White and the victim proceeded to fight, until they were separated after they knocked over a poker table. The victim, an adult man whose identity will not be disclosed, was transported to an area hospital for serious injuries.

    White was not injured and was taken into custody without incident. He was transported to Troop 2, where he was charged with the crimes listed below, arraigned by Justice of the Peace Court 11, and committed to Howard R. Young Correctional Institution on a $10,500 cash bond.

    State Police Arrest Man for Series of Shopliftings from Wilmington Target

    Delaware State Police arrested 40-year-old Bryan Gray of New Castle, Delaware, for a series of shopliftings from a Wilmington area Target that began last month.

    Between March 25, 2024, and April 19, 2024, troopers investigated several shopliftings of a similar nature from the Target located at 3240 Kirkwood Highway in Wilmington. In each shoplifting, an unknown white male suspect shoplifted skincare and cosmetic products from the business. On April 22, 2024, a trooper was at Target conducting an unrelated investigation when he was notified by a Target employee that the white male suspect from the previous shopliftings was in the store and concealing cosmetic products. The trooper made contact with the suspect, identified as Bryan Gray, as he was exiting the business and took him into custody without incident. A search of Gray’s person led to the discovery of several unpaid cosmetic products that were concealed in his pants.

    Troopers identified Gray as the suspect responsible for 5 shopliftings that spanned a little under one month and totaled over $8,200 worth of stolen merchandise. Gray was taken to Troop 2, where he was charged with the crimes listed below, arraigned by Justice of the Peace Court 11, and committed to Howard R. Young Correctional Institution on a $6,000 secured bond.

    Troopers Arrest Man for Aggravated Menacing with Knife in Bear

    Delaware State Police arrested 43-year-old Yonghua Xu of Bear, Delaware, for aggravated menacing with a knife Wednesday morning in Bear.

    On April 17, 2024, at approximately 11:06 a.m., troopers responded to a report of an aggravated menacing at the News Journal Company located at 139 Rickey Boulevard in Bear. Upon arriving, troopers learned the suspect, identified as Yonghua Xu, and the victim work in the same shopping center and have had conflicts in the past. On Wednesday, Xu blocked the victim’s vehicle with his van as the victim was trying to leave the parking space. The victim got out of his vehicle to confront Xu, and saw Xu holding an unfolded pocketknife. The victim backed away as Xu got out of his vehicle and walked towards the victim with the knife in his hand. Xu then returned to his van and fled in an unknown direction. A short time later, Xu returned to the parking lot while troopers were at the scene investigating and was taken into custody without incident.

    Xu was taken to Troop 2, where he was charged with crimes listed below, arraigned by Justice of the Peace Court 11, and released after posting a $66,000 cash bond.

    FTC Sends Refunds to Ring Customers Stemming from 2023 Settlement over Charges the Company Failed to Block Employees and Hackers from Accessing Consumer Videos

    The Federal Trade Commission is sending refunds totaling more than $5.6 million to consumers as the result of a settlement with Ring over charges the company allowed employees and contractors to access consumers’ private videos and failed to implement security protections, enabling hackers to take control of consumers’ accounts, cameras, and videos.

    In a complaint first announced in May 2023, the FTC says that Ring deceived its customers by failing to restrict employees’ and contractors’ access to its customers’ videos, using its customer videos to train algorithms without consent, and failing to implement security safeguards. These practices led to egregious violations of users’ privacy.

    The FTC is sending 117,044 PayPal payments to consumers who had certain types of Ring devices, such as indoor cameras, during periods when the FTC alleges unauthorized users may have had access to customer videos. Consumers should redeem their PayPal payment within 30 days.Explore Data with the FTC: Learn more about FTC refunds to consumers

    Consumers who have questions about their payment should contact the refund administrator, Rust Consulting, Inc., at  1-833-637-4884, or visit the FTC website to view frequently asked questions about the refund process. The Commission never requires people to pay money or provide account information to get a refund.

    The Federal Trade Commission announced the appointment of Dania L. Ayoubi to serve as one of the agency’s Administrative Law Judges, who are responsible for independent adjudicative fact-finding in the agency’s administrative litigation and rulemaking proceedings.

    The Commission voted 3-0 in February 2024 to approve Ayoubi’s appointment as an Administrative Law Judge.

    Administrative Law Judge Ayoubi joins Chief Administrative Law Judge D. Michael Chappell and Administrative Law Judge Jay L. Himes, who came to the agency in March 2024. The Commission is expanding the number of administrative law judges to help handle an increased workload stemming from FTC rulemakings and enforcement matters as well as reviews of final civil sanctions imposed by the Horseracing Integrity and Safety Authority, a private nonprofit that the FTC oversees. 

    Ayoubi most recently served as an administrative law judge for the Maryland Office of Administrative Hearings, where she served with distinction. Ayoubi independently presided over hundreds of cases involving appeals of state administrative agency decisions, including complex matters in consumer protection and antitrust. Prior to that, she worked as senior counsel in the Consumer Financial Protection Bureau’s Office of Regulations and as an attorney advisor in the Federal Communications Commission’s Wireline Competition Bureau.

    She also served as a law clerk to the Honorable Eric T. Washington of the District of Columbia Court of Appeals and worked in the litigation practice group at Hughes Hubbard and Reed LLP. Ayoubi earned her undergraduate degree from Georgetown University and law degree from Georgetown University Law Center.

    The Delaware State Police Troop 7 Collision Reconstruction Unit is attempting to locate the two vehicles involved in the fatal pedestrian hit-and-run crash that occurred on April 19, 2024. The first vehicle is described as a silver car with moderate front-end damage. The second vehicle is described as a smaller white SUV with minor front-end damage or damage to the undercarriage. Both vehicles were last seen driving northbound on Harbeson Road after the crash.

    Traffic Stop Leads to Arrest of Dover Man For Felony Gun Charge

    Delaware State Police arrested 23-year-old Elijah Lambert of Dover, Delaware, for a felony gun charge on Friday night near Frederica.

    On April 19, 2024, at approximately 10:57 p.m., a trooper on patrol saw a Chevrolet Impala speeding on Bay Road southbound at Trap Shooters Road near Frederica. The trooper pulled the car over and spoke with the driver, identified as Elijah Lambert. During the conversation, Lambert told the trooper there was a loaded gun under the driver’s seat. Lambert was arrested and troopers found a loaded Taurus 9mm handgun under the seat. A computer check showed that Lambert does not have a concealed carry permit.

    Lambert was taken to Troop 3, where he was charged with the crimes listed below, arraigned by Justice of the Peace Court 7, and released on his own recognizance.

    Troopers Arrest Man for Shooting in Blades

    The Delaware State Police have arrested 25-year-old Harold Dixon after a shooting in Blades Sunday morning.

    On April 21, 2024, at approximately 8:21 a.m., troopers responded to a house on East Fifth Street in Blades for a report of shots fired. When troopers arrived, they learned that gunshots were fired, and a black car was seen speeding away. Troopers were able to get a description of the car and the suspect. During the investigation, the suspect was identified as Harold Dixon. Troopers arrested Dixon and learned that he was having an argument with a woman when he fired several shots in the ground outside of the house. A child was inside the house when the shooting happened. No one was hurt.

    Dixon was taken to Troop 5, where he was charged with the crimes listed below, arraigned by Justice of the Peace Court 3, and committed to Sussex Correctional Institution on a $107,000 cash bond.

    UPDATE – The Dover Police Department has identified Elijah Kellum, 15, of Dover, DE as the victim who died as a result of the shooting on Governors Avenue last weekend, April 14th, 2024.

    Narrative: The Dover Police Department has arrested Breshawn Best,19, of Dover, on murder charges, following a shooting that occurred Sunday night. The investigation began at 8:33 p.m., when Dover Police Department was called for a shooting in the area of South Governors Avenue and West Reed Street. Officers responded and located the victim, a 15-year-old male of Dover, who had sustained gun shot wounds as a result of the shooting. Sadly, the 15-year-old was pronounced dead on scene. The victim’s name is being withheld pending family notifications.

    The ensuing investigation revealed that the victim was walking in the area of West Reed Street and South Governors Avenue when a group of suspects ambushed him and fired multiple shots at the victim. Through the investigation, Breshawn Best was identified as one of the people responsible for this shooting. Best was located and taken into custody without incident. He was transported to Dover Police Department to be processed and arraigned.

    Best was committed to SCI on $1,086,000 cash bail on the following charges:
    -Murder First Degree
    -Possession of a Firearm During Commission of a Felony
    -Possession of Ammunition By a Person Prohibited
    -Carrying a Concealed Deadly Weapon

    Troopers Arrest Man for DUI, Drug, and Weapon Charges Following Crash Investigation

    Delaware State Police arrested 46-year-old Richard Butcher of Smyrna, Delaware, for DUI, drug, and weapon charges following a crash investigation in Hartly early Wednesday morning.

    On April 17, 2024, at approximately 12:41 a.m., troopers responded to the Dover Scrap Yard located at 3221 Hartly Road, Hartly, for a single-vehicle crash. Upon arriving, troopers learned a silver 2019 Volkswagen Tiguan with Delaware registration veered off the roadway and struck a tree. Troopers further learned EMS initially found the operator and sole occupant of the Volkswagen, identified as Richard Butcher, unconscious in the driver’s seat from an apparent drug overdose. Butcher became responsive after EMS administered Narcan and was subsequently transported to an area hospital for medical treatment. Troopers conducted a search of the Volkswagen, which led to the discovery of 8 blue wax papers containing approximately 0.056 grams of heroin, 1 small clear bag containing approximately 5.98 grams of cocaine that was found on the dashboard, 1 small clear bag containing approximately 0.70 grams of cocaine that was found near the gas pedal, and one 9mm magazine loaded with 12 rounds of ammunition that was found in the center console.

    A computer inquiry revealed Butcher’s driver’s license is suspended/revoked, and he is prohibited from possessing ammunition due to being a convicted felon. After being discharged from the hospital, Butcher was taken to Troop 3, where he was charged with the offenses listed below, arraigned by Justice of the Peace Court 7, and released on his own recognizance.

    State Police Arrest Middletown Area Travel Agency Owner for Fraudulent Credit Card Purchases

    Delaware State Police arrested 55-year-old Jane Fencer of Townsend, Delaware, for making several fraudulent credit card purchases through her Middletown-based travel agency, Wanderlust Tours and Travel.

    On January 26, 2024, troopers were dispatched to a report of multiple unauthorized credit card purchases made through Wanderlust Tours and Travel, located at 717 South Cox Street in Middletown. Troopers learned that in December 2023 the travel agency’s owner, identified as Jane Fencer, used a former customer’s credit card for over $19,000 worth of unauthorized purchases. During the investigation, Troop 2 Criminal Investigations Detectives discovered additional former customers of Fencer’s travel agency with unauthorized purchases made by Fencer on their credit cards. Detectives obtained a warrant for Fencer’s arrest.

    On April 19, 2024, Fencer turned herself in at Troop 2, where she was charged with the crimes listed below, arraigned by Justice of the Peace Court 2, and released on her own recognizance.

    Narrative:

    The Dover Police Department, in collaboration with the Delaware State University Police Department, is investigating a shooting that resulted in the death of a 18-year-old female, of Wilmington. The investigation began at approximately 1:40 a.m. Sunday morning, when DSU Police received a call for shots fired on campus, in the area Warren-Franklin Hall. Officers responded and located the victim, an 18-year-old female of Wilmington, who had sustained a gun shot wound to her upper body. Officers rendered aid to the victim and she was transported to Bayhealth Kent Campus for treatment. Tragically, the 18-year-old died at the hospital as a result of her injuries. The victim’s name is being withheld pending notification of her family. She was not a registered student of the University. No other injuries were reported. At this time, no suspect description is available.

    Delaware State University provided the following statement.

    “The DSU Police Department and staff will continue to take all necessary actions to ensure the health and well-being of our campus community.  Counseling services are available in the Tubman Laws Hall housing office.  The campus is closed today, events have been cancelled, and police patrols have been increased.  No visitation will be permitted today.”

    The Federal Trade Commission has issued an order approving modifications that the Horseracing Integrity and Safety Authority has proposed to its Registration Rule. The rule modifications aim to enhance the safety and welfare of horses the Authority oversees by enabling it to have accurate and timely information about covered horses and persons.

    The Horseracing Integrity and Safety Act requires the Authority to submit proposed rules (or rule modifications) to the FTC for approval. The act requires the FTC to approve submitted rules if it finds that they are “consistent with” the act and the FTC’s procedural rules governing the submission process.

    On June 29, 2022, the FTC issued an order approving the Authority’s initial Registration Rule after a public comment period. The rule requires covered persons, which includes trainers, breeders, jockeys and others involved in the horse racing industry, and covered horses to register with the Authority, which has a registration portal at its website, www.hisaus.org. In February 2024, the FTC sought public comment on the Authority’s proposed modifications to the Registration Rule.

    Under the act, the FTC has 60 days from the date of publication to approve or disapprove the proposed rule modifications. The Commission order announced today finds that the proposed modifications are consistent with the Act, and that the Authority complied with the FTC’s procedural requirements.

    The Commission vote in favor of an order approving the Registration Rule modification was 5-0. The modified rule will take effect on July 1, 2024.

    Troopers Arrest Chicago Pair for Felony Shoplifting

    Delaware State Police arrested 35-year-old Fabian Jaworski and 34-year-old Sandra Zelinska both of Chicago, Illinois, for felony shoplifting yesterday.

    On April 20, 2024, at approximately 11:12 a.m., troopers responded to Lowe’s, located at 2225 Hessler Boulevard in New Castle, for a shoplifting. When troopers arrived, they were told that a man and a woman had stolen merchandise from the store and left in a Chrysler minivan. A short time later, a Lowe’s employee saw the man and woman at Dunkin’ Donuts, located at 2076 Concord Pike in Wilmington. When troopers arrived at Dunkin’ Donuts, they contacted the man and woman, identified as Fabian Jaworski and Sandra Zelinska. Through investigative means, troopers identified them as the suspects in the shoplifting and they were arrested. Troopers found the stolen merchandise from Lowe’s along with other stolen property valued at over $4,000. Troopers learned that the suspects stole merchandise valued over $450 from Lowe’s, located at 1030 East Songsmith Drive in Bear, and merchandise valued over $1,900 from the Hessler Boulevard location.

    Jaworski was taken to Troop 2, charged with the crimes listed below, arraigned by Justice of the Peace Court 11, and committed to Howard R. Young Correctional Institution on an $8,000 cash bond.

    Narrative:

    The Dover Police Department, in collaboration with the Delaware State University Police Department, is investigating a shooting that resulted in the death of a 18-year-old female, of Wilmington. The investigation began at approximately 1:40 a.m. Sunday morning, when DSU Police received a call for shots fired on campus, in the area Warren-Franklin Hall. Officers responded and located the victim, an 18-year-old female of Wilmington, who had sustained a gun shot wound to her upper body. Officers rendered aid to the victim and she was transported to Bayhealth Kent Campus for treatment. Tragically, the 18-year-old died at the hospital as a result of her injuries. The victim’s name is being withheld pending notification of her family. She was not a registered student of the University. No other injuries were reported. At this time, no suspect description is available.

    Delaware State University provided the following statement.

    “The DSU Police Department and staff will continue to take all necessary actions to ensure the health and well-being of our campus community.  Counseling services are available in the Tubman Laws Hall housing office.  The campus is closed today, events have been cancelled, and police patrols have been increased.  No visitation will be permitted today.”

    The Delaware State Police are investigating a parking lot robbery in Wilmington last night.

    On April 20, 2024, at approximately 9:36 p.m., troopers responded to Canby Park Shopping Center on Maryland Avenue in Wilmington, for a robbery that happened in the parking lot near China Dragon Restaurant. When troopers arrived, they learned that a 35-year-old man was getting into his car when he was approached by two men. The two men assaulted the victim and stole his money. The suspects left the scene in an unknown vehicle towards Maryland Avenue. The victim was taken to an area hospital for minor injuries.

    The first suspect is described as a Hispanic male, approximately 35-40 years of age, wearing a hat, white t-shirt, and blue sweatpants. The second suspect is described as a Hispanic male, approximately 35 years of age, wearing a navy t-shirt, gray pants, and gray sneakers.

    Surveillance video and images of the suspects are not yet available.

    Troopers Arrest Man for Stealing Church Van

    The Delaware State Police arrested 18-year-old Ronald Alberts of Seaford, Delaware, for stealing a church van early Friday morning.

    On April 19, 2024, at approximately 1:52 a.m., a trooper on patrol saw a white Dodge passenger van swerving on Concord Road in the area of Church Road near Seaford. The trooper pulled the van over on Concord Pond Road and spoke to the driver, identified as Ronald Alberts. A computer check found that the van belonged to a local church. A representative of the church was contacted, and it was learned that the van was stolen from the church parking lot. Alberts was arrested for stealing the van.

    Alberts was taken to Troop 5, where he was charged with the below crimes, arraigned by Justice of the Peace Court 7, and released on a $2,400 unsecured bond.

    Troopers Searching for Magnolia Robbery Suspect

    The Delaware State Police are searching for a suspect in a robbery that occurred yesterday morning in Magnolia.

    On April 19, 2024, at approximately 9:05 a.m., troopers responded to a house on Gray’s Lane in Magnolia for a robbery. The preliminary investigation revealed that a man went into a woman’s house, began arguing with her and forcefully stole her property. During the robbery, the man took her phone and threw it, she was not able to call 911. The suspect left the house on foot in an unknown direction. Troopers searched the area but did not find him.

    Through investigative means, troopers have identified 35-year-old George Brinkley as the suspect. He is a black male, approximately 6’02” tall, weighing approximately 240 pounds, brown eyes and black hair. He was last seen wearing a white North Face hooded sweatshirt, and blue pants.

    The Delaware State Police Troop 3 are searching for Brinkley.     State Police Asking for Witnesses Following Fatal Pedestrian Hit-and-Run Crash in Harbeson

    Delaware State Police are investigating a hit-and-run crash that claimed the life of one man early this morning.

    On April 19, 2024, at approximately 2:18 a.m., a silver car was driving northbound on Harbeson Road north of Lewes-Georgetown Highway. At the same time, for reasons under investigation, a pedestrian was in the northbound lane of Harbeson Road. The pedestrian was hit by the silver car. A short time later, a smaller white SUV also driving northbound, hit the pedestrian. Both vehicles left the scene.

    The victim, a 28-year-old man from Seaford, was taken to a nearby hospital where he died. His name is being withheld until his family has been notified.

    As of now, surveillance video and images of the vehicles are not available.

    Harbeson Road was closed for approximately 4 hours while investigators examined the scene and cleared the roadway.

    On April 19, 2024, at approximately 4:00 a.m., troopers responded to an armed robbery in the parking lot of Waffle House, located at 4003 South Dupont Highway in Dover. During the preliminary investigation, detectives learned that four women were sitting in a disabled car waiting for help when they were approached by two black men with guns. The suspects demanded the victims’ property from the car, and they complied. The suspects fled on foot from the scene. The four women were not hurt.

    State Police Arrest Man for Selling Stolen Car Following Vehicle Theft Investigation in Bridgeville

    Delaware State Police arrested 66-year-old Henry Williams, of Bridgeville, Delaware, for selling a stolen car following a vehicle theft investigation that began last week in Bridgeville.

    On April 12, 2024, at approximately 11:32 a.m., troopers investigated a report of a vehicle theft from a property on the 4600 block of Dublin Hill Road in Bridgeville. Troopers learned the victim’s gray 2004 Ford Taurus had been parked on his friend’s property with the friend’s permission since 2021. On April 11, 2024, the victim observed the car was no longer on the property, and his friend, identified as Henry Williams, was unable to provide the whereabouts of the car. Through investigative means, Troop 4 Criminal Investigations Detectives discovered Williams falsely claimed to be the owner of the Taurus and sold it to a car dealer in Laurel on April 10, 2024. Subsequently, detectives obtained a warrant for Williams’ arrest.

    On April 17, 2024, Williams turned himself in at Troop 5, where he was charged with the crimes listed below, arraigned by Justice of the Peace Court 2, and released on his own recognizance.

    State Police Investigates Fatal Bicycle Crash in Camden

    Delaware State Police are investigating a fatal crash involving a bicyclist on Wednesday evening in Camden.

    On April 17, 2024, at approximately 9:17 p.m., a 2015 Nissan Altima was traveling southbound on Old Camden Road, just west of the South Dupont Highway intersection. For reasons under investigation, a bicyclist was attempting to cross South Dupont Highway and Old Camden Road from the east to the west. The bicyclist crossed directly in front of the Nissan. As a result, the Nissan struck the bicyclist in the southbound travel lane of Old Camden Road.

    The bicyclist, a 52-year-old man from Delaware, was taken to an area hospital by ambulance, where he died. His name is being withheld until family and relatives are notified.

    The driver of the Nissan, a 22-year-old woman from Camden, Delaware, was not injured.

    South Dupont Highway and Old Camden Road were closed for approximately 4 hours to investigate the crash and cleared.

Once inside the store, the suspect stole an undisclosed amount of money and left.

    Narrative: The Dover Police Department is investigating a shots fired that occurred Monday afternoon in Capital Green. The investigation began at 2:01 p.m., when Dover Police received a call for several shots fired in the 400 block of East Water Street. Officers responded to the area and began to investigate. The ensuing investigation revealed that 3 to 4 black male suspects exited a vehicle and began shooting at a parked vehicle that was occupied. The suspects then fled in a white in color SUV. The person sitting in the vehicle that was shot fled the area as well prior to police arrival.

    No injuries were reported as a result of this incident.

    *Update- Suspect Arrested* Detectives Investigating Armed Robbery at Wilmington Kohl’s

    Delaware State Police arrested 29-year-old Nyejierra Drummond of Wilmington, Delaware, for an armed robbery that occurred last week at a Kohl’s in Wilmington.

    On April 9, 2024, at approximately 11:37 a.m., troopers responded to Kohl’s, located at 4437 Kirkwood Highway, Wilmington, for a report of a robbery. The preliminary investigation revealed a Kohl’s employee approached a black female suspect that he recognized from previous shopliftings. The suspect began walking out of the store as the employee approached her. Once outside, the suspect turned around, pulled out a handgun from her purse, and threatened to kill the employee. The suspect then walked back into the store, stole over $1,300 worth of merchandise, and fled in an unknown direction.

    Through investigative means and with the assistance of Delaware Probation and Parole, Delaware State Police Troop 2 Robbery Detectives developed probationer Nyejierra Drummond as the suspect involved in the robbery and obtained a warrant for her arrest. On April 15, 2024, Drummond was taken into custody without incident by Probation and Parole and transported to Troop 2. Drummond was charged with the offenses listed below, arraigned by Justice of the Peace Court 2, and committed to Delores J. Baylor Womens Correctional Institution on a $66,000 cash bond.

He was last seen near Stevenson Drive in Magnolia on April 15, 2024, and has not been seen since. Attempts to contact or locate him have been unsuccessful, and there is a concern for his safety and well-being.

    James is described as a black male, approximately 6’02” tall, weighing approximately 215 pounds, thin build with brown eyes and bald. He was last seen wearing pajama pants, a white t-shirt, and slippers.

  • FTC Action Leads to Industry Ban for Ringleader of Student Loan Debt Relief Scam

    The ringleader of a student loan debt relief scam will be permanently banned from the debt relief industry and is required to turn over assets as part of a settlement with the Federal Trade Commission.

    The settlement with Marco Manzi resolves FTC charges involving the student loan debt relief scheme. The FTC charged that Manzi, Ivan Esquivel, and Robert Kissinger, operators of Express Enrollment LLC (also doing business as SLFD Processing) and Intercontinental Solutions LLC (also doing business as Apex Doc Processing LLC), pretended to be affiliated with the U.S. Department of Education and used “Biden Loan Forgiveness” or similar names to trick students into signing up for their student debt relief scheme. The FTC said that Apex operators pocketed approximately $8.8 million in junk fees by luring students with false promises of loan forgiveness.

    The FTC announced a settlement in February 2024 with the other defendants in the case, Esquivel, Kissinger and the corporate defendants, which imposed similar requirements as the proposed order against Manzi.

    The FTC has resources on how to avoid student loan debt relief scams at ftc.gov/StudentLoans. Consumers can get assistance with their student loans for free at StudentAid.gov.

    The Commission vote authorizing the staff to file the stipulated final order was 3-0. The FTC filed the final order in the U.S. District Court for the Central District of California. The Court approved the final order on March 15, 2024.

    The staff attorneys for this matter are Carlton Mosley and Gregory Ashe of the FTC’s Bureau of Consumer Protection.

    Check on the Welfare Call Leads to DUI and Weapon Arrest

    The Delaware State Police arrested 47-year-old Samuel Etheridge of Norristown, Pennsylvania, for DUI and gun charges on Sunday morning in Wilmington.

    On April 14, 2024, at approximately 7:39 a.m., troopers were called for a report of an unresponsive driver who had stopped at the stop sign located on Ramsey Road, at the intersection of Thompsons Bridge Road. Upon arriving, troopers contacted the sole occupant of a maroon Acura, identified as Samuel Etheridge, who showed signs of impairment. While he was being taken into custody, a trooper saw a handgun on the driver’s seat in plain sight. Etheridge was transported to Troop 1 where he completed Standardized Field Sobriety Tests. A computer check revealed the loaded gun had been reported as stolen by the Richland Township Police Department in 2006. The computer inquiry showed Etheridge is a convicted felon and is prohibited from possessing a firearm and/or ammunition. He was charged with the below crimes, arraigned by Justice of the Peace Court 11, and committed to Howard R. Young Correctional Institution on a $77,000 cash bond.

    Detectives Investigating a Road Rage Shooting on I-495

    The Delaware State Police are investigating a road rage shooting on I-495 near Wilmington.

    On April 14, 2024, at approximately 12:28 a.m., troopers responded to a road rage shooting that occurred on I-495 where one man was shot. The preliminary investigation revealed a man was driving southbound on I-495 near the merge at I-95, when an unknown blue car pulled next to him and shot at his car. The interaction between the two drivers before the shooting is under investigation. The victim, a 47-year-old man, was shot in the wrist. He was taken to an area hospital with non-life-threatening injuries. The driver of the blue car left the scene.

    Currently, there is no suspect information available.

    Troop 2 Criminal Investigations Unit is still investigating this shooting. Detectives are asking anyone who witnessed or has information regarding this case to contact Detective B.     Narrative: The Dover Police Department has arrested Mitchell Harding,39, of Dover, on burglary charges, following an incident late Sunday night. The investigation began at 11:19 p.m., when Dover Police was called for an alarm at Valero. Officers responded and found a front window had been broken, allowing a suspect to make entry. Officers checked the business for the suspect with negative results.

    Through the investigation, it was determined that the suspect forced entry into the business by breaking a front window. Once inside, the suspect removed an undisclosed amount of cigarettes, scratch offs, and vapes before fleeing. Officers were able to obtain a description of the suspect and began to check the area. Officers located Harding, who matched the description of the suspect, and he was taken into custody without incident. Officers were also able to recovers merchandise from the store as a result of the investigation. Harding was transported to Dover Police Department where he was processed and arraigned.

    Harding was released on his ow recognizance on the following charges:

    -Burglary Third Degree
    -Theft $1,500 or Greater
    -Criminal Mischief Less Than $5,000

    Harding is presumed innocent until proven guilty.

    Narrative: The Dover Police Department has arrested Breshawn Best,19, of Dover, on murder charges, following a shooting that occurred Sunday night. The investigation began at 8:33 p.m., when Dover Police Department was called for a shooting in the area of South Governors Avenue and West Reed Street. Officers responded and located the victim, a 15-year-old male of Dover, who had sustained gun shot wounds as a result of the shooting. Sadly, the 15-year-old was pronounced dead on scene. The victim’s name is being withheld pending family notifications.

    The ensuing investigation revealed that the victim was walking in the area of West Reed Street and South Governors Avenue when a group of suspects ambushed him and fired multiple shots at the victim. Through the investigation, Breshawn Best was identified as one of the people responsible for this shooting. Best was located and taken into custody without incident. He was transported to Dover Police Department to be processed and arraigned.

    Best was committed to SCI on $1,086,000 cash bail on the following charges:
    -Murder First Degree
    -Possession of a Firearm During Commission of a Felony
    -Possession of Ammunition By a Person Prohibited
    -Carrying a Concealed Deadly Weapon
    -Conspiracy First Degree

    Best is presumed innocent until proven guilty.

  • Proposed FTC Order will Prohibit Telehealth Firm Cerebral from Using or Disclosing Sensitive Data for Advertising Purposes, and Require it to Pay $7 Million

    Cerebral, Inc. has agreed to an order that, will restrict how the company can use or disclose sensitive consumer data and require it to provide consumers with a simple way to cancel services to settle Federal Trade Commission charges that the telehealth firm failed to secure and protect sensitive health data.

    Under the proposed order, filed by the Department of Justice upon notification and referral from the FTC, Cerebral will also be required to pay more than $7 million over charges that it disclosed consumers’ sensitive personal health information and other sensitive data to third parties for advertising purposes and failed to honor its easy cancellation promises. The order must be approved by the court before it can go into effect.

    “As the Commission’s complaint lays out, Cerebral violated its customers’ privacy by revealing their most sensitive mental health conditions across the Internet and in the mail,” said FTC Chair Lina M. Khan. “To address this betrayal, the Commission is ordering a first-of-its-kind prohibition that bans Cerebral from using any health information for most advertising purposes.”

    Cerebral provides online mental health and related services on a negative option basis, which means consumers are automatically charged unless they cancel those services. Consumers who sign up and use the company’s services provide detailed personal data including their home and email addresses, birthdates, medical and prescription histories, payment account or driver license numbers, as well as information about their treatment plans, pharmacy and health insurance plans, and other personal data, such as their religious or political beliefs, or sexual orientation.

    The complaint charges that Cerebral and its former CEO, Kyle Robertson, repeatedly broke their privacy promises to consumers and misled them about the company’s cancellation policies. The complaint also charges that Cerebral and Robertson violated the Opioid Addiction Recovery Fraud Prevention Act of 2018 (OARFPA) by engaging in unfair and deceptive practices with respect to substance use disorder treatment services.

    To get consumers to sign up for the company’s services and provide detailed personal data, the company claimed it offered “safe, secure, and discreet” services and that users’ data would be kept confidential, according to the complaint. The complaint charges that Cerebral failed to clearly disclose that it would be sharing consumers’ sensitive data with third parties for advertising and buried disclaimers about its data sharing practices in dense privacy policies. In fact, according to the complaint, the company claimed in many instances that it would not share users’ data for marketing purposes without obtaining consumers’ consent. The complaint alleges that these practices originated under the direction of its former CEO, Robertson, and continued after his tenure.

    Specifically, the complaint charges that Cerebral provided sensitive information of nearly 3.2 million consumers to third parties such as LinkedIn, Snapchat and TikTok by using or integrating tracking tools on its website or apps. These tracking tools collect and send data to third parties so they can provide advertising, data analytics, or other services to the owner of the websites or apps. Through the use of tracking tools, Cerebral gave third parties personal data about its users including names; medical and prescription histories; home and email addresses; phone numbers; birthdates; demographic information; IP addresses; pharmacy and health insurance information; and other health information, according to the complaint.

    The complaint says that Cerebral, and Robertson, while he was CEO, also failed to deploy adequate safeguards for the sensitive data collected from consumers and engaged in sloppy security practices. As described in the complaint, Cerebral’s practices included:

    • Engaging in Careless Marketing: Cerebral sent out promotional postcards, which were not in envelopes, to over 6,000 patients that included their names and language that appeared to reveal their diagnosis and treatment to anyone who saw the postcards;
    • Allowing Former Employees to Access User Data: From May to December 2021, the company failed to block former employees from accessing confidential electronic medical records of Cerebral patients. It also failed to ensure providers only accessed their patients’ records;
    • Using Insecure Access Methods: The company used a single sign-on method for accessing its patient portal that in numerous instances exposed confidential medical files and patient information such as diagnoses, medications, email addresses, and phone numbers, to other patients when those users signed onto the portal at the same time; and
    • Failing to Implement Adequate Policies and Training: The company failed to restrict access to consumer data to only those employees who needed it, implement proper procedures and training related to the handling of sensitive data, and develop and implement adequate information security standards, policies, and procedures.

    In addition to its privacy and data security failures, the complaint alleges that Cerebral also violated the Restore Online Shoppers’ Confidence Act (ROSCA) by failing to clearly disclose all material terms of Cerebral’s cancellation policies before charging consumers. Despite promising that consumers could “cancel anytime,” Cerebral required its clients to navigate a complex, multi-step, and often multi-day process to cancel. The complaint alleges that the company continued to charge consumers while it slow-walked consumers’ cancellation requests, which cost consumers millions in additional charges. When it first implemented an easier cancellation button in April 2020, the company removed it after only two weeks at Robertson’s direction after seeing cancellations rise, according to the complaint.

    The proposed order, which must be approved by a federal court before it can go into effect, only applies to Cerebral. Robertson has not agreed to a settlement, and the charges against him will be decided by the court.

    Under the proposed order, Cerebral will pay nearly $5.1 million, which will be used to provide partial refunds to consumers impacted by its deceptive cancellation practices, as well as a $10 million civil penalty, which will be suspended after a $2 million penalty payment due to the company’s inability to pay the full amount. The proposed order also will:

    • Permanently ban Cerebral from using or disclosing consumers’ personal and health information to third parties for most marketing or advertising purposes, and generally require the company to obtain consumers’ consent before disclosing such information to outside parties;
    • Prohibit the company from misrepresenting its privacy and data security practices;
    • Require the company to implement a comprehensive privacy and data security program that, among other things, addresses the specific problems outlined in the complaint;
    • Require the company to post a notice on its website alerting users to the allegations outlined in the complaint and detail the steps it is required to take under the order;
    • Require the company to implement a data retention schedule and to delete most consumer data not used for treatment, payment, or health care operations unless consumers consent to its retention, and provide consumers with a clear mechanism to request that their data be deleted; and
    • Prohibit the company from misrepresenting any negative option and cancellation policies or practices and also require it to provide consumers with an easy method to cancel services.

    The Commission voted 3-0 to refer the complaint against Cerebral and Robertson and a stipulated final order with Cerebral to the Department of Justice for filing. The DOJ filed the complaint and stipulated order in the U.S. District Court for the Southern District of Florida.

    NOTE: The Commission authorizes the filing of a complaint when it has “reason to believe” that the named defendant is violating or is about to violate the law and it appears to the Commission that a proceeding is in the public interest. Stipulated final orders have the force of law when approved and signed by the District Court judge.

    Narrative: The Dover Police Department has arrested Sadique Ingram, 23, of Dover, on murder charges, following a shooting that occurred on West Loockerman Street early Sunday morning. The investigation began at 1:26 a.m., when Dover Police Department was called for a shooting in the area of Irish Mike’s, where two subjects had been shot. Officers responded and located the victims, Syncere Friends, 25, of Dover, who had sustained a gun shot wound to his chest, and a 30-year-old female of Magnolia, who had sustained a gun shot wound to her lower body. Both victims were transported to Bayheath Kent Campus for treatment. Sadly, Friends died as a result of his injuries while at the hospital.

    The ensuing investigation lead investigators to identify Sadique Ingram as the person responsible for the shooting. Detectives obtained warrants for his arrest and he was taken into custody during a traffic stop in Milford, Delaware late Sunday morning. Ingram was transported to Dover Police Department where he was processed and arraigned.

    Ingram was committed to SCI on $1,000,000 cash bail on the following charges:
    -Murder First Degree
    -Possession of a Firearm During the Commission of a Felony
    -Assault First Degree
    -Possession of a Firearm During the Commission of a Felony

    Ingram is presumed innocent until proven guilty.

    State Police Investigating Single-Vehicle Fatal Crash in Felton

    Delaware State Police are investigating a single-vehicle fatal crash that occurred early this morning.

    On April 14, 2024, at approximately 3:10 a.m., a Chevrolet Silverado was traveling westbound on Paradise Alley Road, approaching a stop sign at the South Dupont Highway intersection. Without stopping, the vehicle proceeded through the intersection, crossing both the north and southbound lanes of South Dupont Highway. It then veered off the southwest edge of the roadway, striking a stop sign located on the eastbound side of Paradise Road. The vehicle continued westbound through a grassy area before side-swiping a large tree.

    The driver, a 20-year-old man from Clayton, was pronounced dead at the scene. The identity of the victim will be released once his family has been notified.

    The roadway was closed for approximately 3 hours while investigators examined the scene and cleared the roadway.

    State Police Apprehend Four Teenagers Following Multi-Jurisdiction Pursuit

    Delaware State Police arrested four teenagers after a high-speed pursuit through multiple jurisdictions in Sussex County Saturday evening.

    On April 13, 2024, at approximately 7:21 p.m., a silver Honda CRV with temporary Delaware registration fled from a traffic stop initiated by Bethany Beach Police Department. Troopers spotted the same vehicle speeding northbound on Coastal Highway near Fred Hudson Road moments later. Despite attempts to pursue the car, troopers discontinued the chase due to safety concerns arising from the excessive speed. The vehicle, which was later discovered to be reported stolen within the Dover Police Department’s jurisdiction, proceeded through Dewey Beach before turning eastbound onto Silver Lake Drive towards Rehoboth Beach.

    Assistance from the Delaware State Police Aviation Unit enabled continuous monitoring of the vehicle from the sky until it eventually crashed near Olive Avenue and the Boardwalk in Rehoboth Beach. Subsequently, all four suspects were observed fleeing the scene on foot. Delaware State Police, with the assistance of the Dewey Beach Police Department and Rehoboth Beach Police Department, apprehended the suspects a short time later near the Henlopen Hotel in Rehoboth Beach.

    Further investigation revealed a firearm within easy reach of where the suspects had been seated inside the vehicle. No citizens were injured during this incident. All suspects, confirmed to be teenagers, were taken into custody and transported to Troop 7, where they were charged with multiple crimes:

    A 15-year-old was charged with the offenses listed below, arraigned by Justice of the Peace Court 7, and committed to Stevenson House Detention Center on a $12,500 secured bond.

    • Possession of a Firearm During the Commission of a Felony (Felony)
    • Possession of a Deadly Weapon Persons Under 18 (Felony)
    • Receiving Stolen Property Over $1500 (Felony)
    • Conspiracy Second Degree (Felony)
    • Resisting Arrest

    This suspect was identified as the driver and subsequently charged with multiple traffic violations by additional local law enforcement agencies.


    A 17-year-old was charged with the offenses listed below, arraigned by Justice of the Peace Court 7, and committed to Stevenson House Detention Center on a $17,000 secured bond.

    • Possession of a Firearm During the Commission of a Felony (Felony)
    • Possession of a Deadly Weapon Persons Under 18 (Felony)
    • Receiving Stolen Property Over $1500 (Felony)
    • Conspiracy Second Degree (Felony)
    • Resisting Arrest

    Another 15-year-old was charged with the offenses listed below, arraigned by Justice of the Peace Court 7, and committed to Stevenson House Detention Center on a $17,000 secured bond.

    I-95 Drive to Save Lives Commences During National Distracted Driving Awareness Month – April 2024

    The Delaware State Police, in partnership with the Delaware Office of Highway Safety, is joining forces with other law enforcement agencies along the I-95 corridor and across the State of Delaware in the “I-95 Drive to Save Lives/National Distracted Driving Awareness Month -2024” campaign. This multi-jurisdictional initiative aims to increase awareness and safety along the I-95 corridor and throughout Delaware. Over the past five years, Delaware has witnessed 9,569 crashes, resulting in 174 serious injuries and 22 fatalities due to distracted driving. The Delaware State Police will lead this collaborative effort, coordinating with 15 State Police and Highway Patrol agencies along I-95 and numerous participating Delaware law enforcement agencies from Friday, April 19th to Sunday, April 21st, 2024.

    Law enforcement agencies participating in the “I-95 Drive to Save Lives” initiative include Florida Highway Patrol, North Carolina Highway Patrol, South Carolina Highway Patrol, Georgia Highway Patrol, Virginia State Police, Maryland State Police, Delaware State Police, Pennsylvania State Police, New Jersey State Police, New York State Police, Connecticut State Police, Rhode Island State Police, New Hampshire State Police, Massachusetts State Police, and Maine State Police. Simultaneously, local law enforcement agencies in Delaware will conduct the “Drive to Save Lives” initiative, patrolling within their respective jurisdictions to reinforce safety measures.

    “As we kick off National Distracted Driver Awareness Month, it’s imperative that we all recognize the crucial role we play in promoting safe driving practices and protecting lives on our roadways,” said Colonel Melissa Zebley, Superintendent of the Delaware State Police. “Every year, we witness the tragic loss of thousands of lives in motor vehicle crashes across the country, leaving families and communities shattered by grief.     State Police Asking for Witnesses Following Fatal Pedestrian Hit-and-Run Crash in Newark

    Delaware State Police are investigating a hit-and-run crash that claimed the life of one man early this morning.

    On April 13, 2024, at approximately 12:08 a.m., an unidentified vehicle was traveling eastbound on Christiana Road east of South Brownleaf Road.  A pedestrian entered the eastbound lanes of Christiana Road from an unknown location, just west of the South Gerald Drive intersection. At the same time, the unknown vehicle entered the same area and struck the pedestrian. The vehicle then fled the scene.

    The victim, a 49-year-old man from Newark, was transported to a nearby hospital and pronounced dead. The identity of the victim will be released once his family has been notified.

    Christiana Road was temporarily closed for approximately 3 hours while investigators examined the scene and cleared the roadway.

    State Police Investigating a Pedestrian Killed by a Train Near Newark

    The Delaware State Police are investigating a man hit and killed by a train near Newark last night.

    On April 11, 2024, at approximately 5:15 p.m., a CSX train was traveling from New York to Washington, D.C., in the area of 4949 Ogletown Stanton Road in Newark. At the same time, a man was walking on the outside of the railroad tracks with his back to the oncoming train. The preliminary investigation suggests, the man did not move from the track area after the train operator blew the horn. As a result, the front of the train hit the man.

    The victim, a 54-year-old man from Smyrna, Delaware, was pronounced dead at the scene. His name is being withheld until his family is notified.

    The Delaware State Police Troop 2 Criminal Investigations Unit continues to investigate this incident. Detectives are asking anyone who witnessed the incident to contact Detective E.     State Police Issue Gold Alert for Missing Dover Teenager

    Delaware State Police Troop 3 is issuing a Gold Alert for 13-year-old Kiotti Maldonado of Dover, Delaware. Kiotti was last seen leaving his residence on April 12, 2024. Attempts to contact or locate him have been unsuccessful, and there is a concern for his safety and well-being.

    Kiotti is described as a white male, approximately 5’04” tall, weighing approximately 120 pounds. He was last seen wearing red sweatpants and a gray shirt. He was last seen on a red and black Mongoose bicycle. His destination is unknown.
