A federal appeals court has refused to help the Trump administration revive a $100,000 fee it sought to impose on H-1B visas, which are used to bring highly skilled foreign workers into the United States.
On Friday, the Boston-based 1st U.S. Circuit Court of Appeals declined to suspend a lower court ruling that had blocked the fee from taking effect. That earlier ruling, issued on June 8, determined that the proposed charge amounted to an unlawful tax that Congress had never approved.
With the appeals court’s refusal to intervene, the lower court’s order blocking the fee remains in place.
