  • March 20 to 24 is Severe Weather Awareness Week For Delaware

March 20 to 24 is Severe Weather Awareness Week For Delaware

Governor John Carney and Lt. Governor Bethany Hall-Long have proclaimed March 20 to March 24 as Severe Weather Awareness Week in Delaware. In recent years, Delaware has experienced floodingtornadoes, and winter storms that put lives and property at risk while adversely impacting the health, safety, and economic well-being of families, businesses, and schools. Learning about the different types of hazards will increase preparedness and help reduce the amount of devastation caused by severe weather. This year, Severe Weather Awareness Week roughly coincides with the 30th anniversary of the “Storm of the Century” or the “Blizzard of 1993.” This monster late-winter storm directly affected 40 percent of the U.S. population from the Deep South to Canada during the period from Friday, March 12 to Sunday, March 14, 1993. It brought record cold temperatures, heavy snowfall, hurricane-force winds, damaging storm surge, and closed almost every major airport on the U.S. East Coast at some point. It resulted in $5.5 billion in damages, 318 fatalities, and the loss of electric power to more than 10 million households.

The Delaware Emergency Management Agency (DEMA) is collaborating with the National Weather Service in Philadelphia/Mount Holly, NJ, the Center for Environmental Monitoring and Analysis (CEMA) at the University of Delaware, and Delaware Sea Grant to raise awareness. Flooding, coastal storm surge, thunderstorms, tornadoes, and lightning are just some of the weather threats that can occur in Delaware, often with little advance warning. The National Weather Service has created a special “Severe Weather Awareness Week” web page with resources and links to information on specific hazards that could impact residents, often without advance warning.

    The link is: https://www.weather.gov/phi/DESevereAwarenessWeek.

Every day from March 20 to 24, there will be a different topic:

The webpage also contains links to the National Oceanographic and Atmospheric Administration’s (NOAA) Weather-Ready Nation website. Information on how to make a family plan and how to make a preparedness kit can also be found on the page with a link to PrepareDE.org. Follow along on social media as we cover a different weather hazard each day, providing historical context and tips for how to stay safe.

  • $1.5 Million Civil Penalty May Be Levied Against GoodRx

$1.5 Million Civil Penalty May Be Levied Against GoodRx

GoodRx is a telehealth and prescription drug discount provider.

The Federal Trade Commission has taken enforcement action for the first time under its Health Breach Notification Rule against the telehealth and prescription drug discount provider GoodRx Holdings Inc., for failing to notify consumers and others of its unauthorized disclosures of consumers’ personal health information to Facebook, Google, and other companies.

In a first-of-its-kind proposed order, filed by the Department of Justice on behalf of the FTC, GoodRx will be prohibited from sharing user health data with applicable third parties for advertising purposes, and has agreed to pay a $1.5 million civil penalty for violating the rule. The proposed order must be approved by the federal court to go into effect.

“Digital health companies and mobile apps should not cash in on consumers’ extremely sensitive and personally identifiable health information,” said Samuel Levine, Director of the FTC’s Bureau of Consumer Protection. “The FTC is serving notice that it will use all of its legal authority to protect American consumers’ sensitive data from misuse and illegal exploitation.”

California-based GoodRx operates a digital health platform that offers prescription drug discounts, telehealth visits, and other health services. The company collects personal and health information about its users, including information from users themselves and from pharmacy benefit managers confirming when a consumer purchases a medication using a GoodRx coupon. Since January 2017, more than 55 million consumers have visited or used GoodRx’s website or mobile apps.

According to the FTC’s complaint, GoodRx violated the FTC Act by sharing sensitive personal health information for years with advertising companies and platforms—contrary to its privacy promises—and failed to report these unauthorized disclosures as required by the Health Breach Notification Rule. Specifically, the FTC said GoodRx:

    • Shared Personal Health Information with Facebook, Google, Criteo, and Others: Since at least 2017, GoodRx deceptively promised its users that it would never share personal health information with advertisers or other third parties. GoodRx repeatedly violated this promise by sharing sensitive personal health information—including its users’ prescription medications and personal health conditions—with third party advertising companies and advertising platforms like Facebook, Google, and Criteo, and other third parties like Branch and Twilio.
    • Used Personal Health Information to Target its Users with Ads: GoodRx monetized its users’ personal health information, and used data it shared with Facebook to target GoodRx’s own users with personalized health- and medication-specific advertisements on Facebook and Instagram. For example, in August 2019, GoodRx compiled lists of its users who had purchased particular medications such as those used to treat heart disease and blood pressure, and uploaded their email addresses, phone numbers, and mobile advertising IDs to Facebook so it could identify their profiles. GoodRx then used that information to target these users with health-related advertisements.
    • Failed to Limit Third-Party Use of Personal Health Information: GoodRx allowed third parties it shared data with to use that information for their own internal purposes, including for research and development or to improve advertising. It also falsely claimed that it complied with the Digital Advertising Alliance principles, which require companies to get consent before using health information for advertising.
    • Misrepresented its HIPAA Compliance: GoodRx displayed a seal at the bottom of its telehealth services homepage falsely suggesting to consumers that it complied with the Health Insurance Portability and Accountability Act of 1996 (HIPAA), a law that sets forth privacy and information security protections for health data.
    • Failed to Implement Policies to Protect Personal Health Information: GoodRx failed to maintain sufficient policies or procedures to protect its users’ personal health information. Until a consumer watchdog publicly revealed GoodRx’s actions in February 2020, GoodRx had no sufficient formal, written, or standard privacy or data sharing policies or compliance programs in place.

    Health Breach Notification Rule Violation

According to the FTC complaint, as a vendor of personal health records, GoodRx is subject to the Health Breach Notification Rule. GoodRx lets users keep track of their personal health information, including to save, track, and receive alerts about their prescriptions, refills, pricing, and medication purchase history.

GoodRx violated the Health Breach Notification Rule by failing to notify consumers, the FTC, and the media about the company’s unauthorized disclosure of individually identifiable health information to Facebook, Google, Criteo, Branch, and Twilio. The FTC issued a policy statement in September 2021 warning health apps and others that collect or use consumers’ health information that they must comply with the Health Breach Notification Rule. More information on compliance and reporting breaches under the Health Breach Notification Rule are available at the FTC’s Health Privacy page.

    Proposed Order

In addition to the $1.5 million penalty for violating the rule, the proposed federal court order also prohibits GoodRx from engaging in the deceptive practices outlined in the complaint and requires the company to comply with the Health Breach Notification Rule. To remedy the FTC’s numerous allegations, other provisions of the proposed order against GoodRx also:

    • Prohibit the sharing of health data for ads: GoodRx will be permanently prohibited from disclosing user health information with applicable third parties for advertising purposes.
    • Require user consent for any other sharing: The company must obtain users’ affirmative express consent before disclosing user health information with applicable third parties for other purposes. The order requires the company to clearly and conspicuously detail the categories of health information that it will disclose to third parties and prohibits the company from using manipulative designs, known as dark patterns, to obtain users’ consent to share the information.
    • Require company to seek deletion of data: The company must direct third parties to delete the consumer health data that was shared with them and inform consumers about the breaches and the FTC’s enforcement action against the company.
    • Limit Retention of Data: GoodRx will be required to limit how long it can retain personal and health information according to a data retention schedule. It also must publicly post a retention schedule, and detail the information it collects and why such data collection is necessary.
    • Implement Mandated Privacy Program: It must put in place a comprehensive privacy program that includes strong safeguards to protect consumer data.

The Commission voted 4-0 to refer the complaint and stipulated final order to the Department of Justice for filing. Commissioner Christine S. Wilson issued a concurring statement. The DOJ filed the complaint and stipulated order in the U.S. District Court for the Northern District of California.

NOTE: The Commission authorizes the filing of a complaint when it has “reason to believe” that the named defendant is violating or is about to violate the law and it appears to the Commission that a proceeding is in the public interest. Stipulated final orders have the force of law when approved and signed by the District Court judge.

With the unanimous support of the Unemployment Insurance Advisory Council, DOL Secretary Karryl Hubbard issued Emergency Rule 21 to implement new tax rates for 2023 which are estimated to reduce the Unemployment Insurance tax obligation for Delaware employers by an estimated $50 million. DOL was able to take these actions on December 31, 2022 due in part to the $240 million investment in Corona Virus Response Act Funds that were placed in the UI Trust Fund in 2021.

House Bill 49, signed by Governor Carney on January 26, 2023 codifies the changes enacted by Secretary Hubbard’s 21st Emergency Rule issued on December 22, 2022.

    • For calendar 2023, the average employer assessment rate, the average industry assessment rate, and the average construction industry assessment rate will each be 1%.
    • All other employers will be assigned a basic assessment rate according to the following table in place for 2023:

If an employer’s benefit wage ratio exceeds the highest percentage in the table above, their basic assessment rate shall be 5.40 %

  • FTC Order to Bar ZyCal Bioceuticals from Deceptive Health Marketing

FTC Order to Bar ZyCal Bioceuticals from Deceptive Health Marketing

Company claimed its product could grow bone and cartilage, relieve joint pain

    ZyCal Bioceuticals

The Federal Trade Commission today announced an order settling a 2020 federal lawsuit against defendants ZyCal Bioceuticals Healthcare Company, Inc. (ZyCal) and its president James J. Scaffidi, which charged them with deceptively claiming that their products grow bone and cartilage and relieve joint pain.

The order bars the ZyCal defendants from making these claims unless supported by randomized controlled clinical trials. It also bars them from providing anyone else with the means to make false or misleading claims. The FTC filed the orderin the U.S. District Court for the District of Massachusetts, and it must be approved and signed by a judge to become final.

“The Commission sued these defendants to halt bogus claims that their products grow bone and cartilage and relieve joint pain,” said Samuel Levine, Director of the FTC’s Bureau of Consumer Protection. “This settlement is an important reminder that health-related advertising claims require rigorous substantiation in the form of competent and reliable scientific evidence. Unfortunately, the Supreme Court decision in AMG Capital Management prevented us from obtaining refunds for consumers in this case. The Commission has urged Congress to enact legislation to restore the agency’s ability to obtain critical relief for consumers through federal court actions.”

The FTC’s February 2020 complaintalleged the ZyCal defendants marketed oral products containing the ingredient Cyplexinol, which they touted was a stem cell activator that could grow bone and cartilage in users and relieve joint pain, including for people with osteoporosis and osteoarthritis. They also claimed that these health benefits were clinically or scientifically proven. The ZyCal defendants marketed Cyplexinol products directly to consumers under the brand name Ostinol, and indirectly through health practitioners and third-party distributors.

The complaint further alleged that the ZyCal defendants supplied a company, Excellent Marketing Results, Inc. (EMR), with the means and instrumentalities to deceptively market a copycat Cyplexinol product called StimTein. While the Commission announced a settlement with the EMR defendants when the complaint was announced in early 2020, litigation continued against the ZyCal defendants. The consent order announced today resolves the agency’s complaint against ZyCal and Scaffidi.

The settlement bars the ZyCal defendants from making bone and cartilage growth and joint pain claims for any food, drug, or dietary supplement, unless they are not misleading and are substantiated by competent and reliable scientific evidence, including randomized clinical trials. It also prohibits them from making other health benefit claims for the same products unless they are supported by reliable scientific evidence.

Finally, the order prohibits the defendants from misrepresenting that bone and cartilage growth claims, pain claims, and related claims are clinically or scientifically proven; from misrepresenting the existence, contents, or results of any scientific test or study; and from providing anyone else with the means to make false or misleading statements. ZyCal also must send a notice of the settlement with the FTC to a number of consumers, health practitioners, and other purchasers who bought Cyplexinol products from the company on or after January 1, 2018.

The Commission vote approving the stipulated final order was 4-0. The staff attorney handling the case is Mary L. Johnson in the FTC’s Bureau of Consumer Protection.

NOTE: Stipulated final orders or injunctions have the force of law when approved and signed by the District Court judge.

  • For Auld Lang Syne, For Cars Lock Each Time – Keep Your Car Doors Locked!

For Auld Lang Syne, For Cars Lock Each Time – Keep Your Car Doors Locked!

The Delaware State Police continually investigate theft from motor vehicle complaints. Many of these thefts have occurred from unlocked cars that were left running to warm up during the chilly morning hours. These crimes have resulted in the loss of money, electronics, personal belongings of value, personal identification, and other items. These types of thefts are avoidable by simply taking the extra time to ensure that your car is locked while parked at work, gas stations, shopping centers, and your residence, especially while it is unattended and running. Delaware State Police want to share the importance of locking your car each and every time to combat this preventable trend.

The Delaware State Police are offering the following prevention and awareness tips:

    • Always keep the doors of your unattended vehicles locked and the windows shut.
    • Do not leave items of value in your vehicle. These items include purses, wallets, credit cards, electronics, checkbooks, money, Social Security cards, loose change, documents, and paperwork with your printed personal information.
    • Store valuable tools inside your residence. If needed daily for work, create an easy system to load and unload, such as using storage containers to transport.
    • Lock your glove box, which should only store your registration and insurance cards. Do not store your vehicle title in the glove box. Store it in a safe place in your residence.
    • Clear the vehicle of all clutter and personal items. This can give the general impression that other property of value may be kept within the vehicle.
    • Do not keep a spare vehicle key hidden in the same vehicle. Do not store house keys or other keys in your vehicle.
    • If possible, keep your vehicle parked under a lighted area that you can check from your residence.

Delaware State Police Investigating Crash Resulting in Three Fatalities

Delaware State Police are investigating a fatal motor vehicle collision that claimed the lives of three individuals last night in the Lewes area.

The collision occurred on December 24, 2022, at approximately 7:59 p.m., when a 2016 Land Rover operated by an unknown subject, was traveling westbound on Lewes-Georgetown Highway (Route 9) approaching Minos Conaway Road. At the time, a 2008 Honda Odyssey operated by a 42-year-old male from Temple, PA, was stopped southbound on Minos Conaway Road for a stop sign at the intersection of Lewes-Georgetown Highway. The Honda attempted to turn left at the intersection and pulled into the path of the Land Rover. As a result, the front of the Land Rover struck the driver’s side of the Honda for impact in the westbound lane, within the intersection. After impact, the Land Rover continued westbound as it rotated in a counterclockwise direction coming to rest in the westbound lane. The impact caused the Honda to spin in a counterclockwise direction where it came to a rest in the eastbound lane.

The 42-year-old male operator of the Honda was transported to an area hospital where he was treated for minor injuries. There were six other occupants inside the Honda, three of whom were ejected during the collision. A 35-year-old female from Temple, PA, a 9-year-old female from Temple, PA, and a 74-year-old male from Lewes, DE were all ejected and pronounced deceased at the scene. The identifications of the victims are pending notifications to the next of kin. The other three passengers, a 12-year-old male, a 4-year-old male, and a 67-year-old female were all transported to an area hospital with non-life-threatening injuries.

The operator of the Land Rover fled from the collision scene on foot and has not been identified at this time.

Lewes-Georgetown Highway at Minos Conaway Road was closed for approximately 4 hours while the crash was investigated, and the roadway cleared.

The Delaware State Police Troop 7 Collision Reconstruction Unit continues to investigate this incident. Troopers are asking anyone who witnessed this collision to please contact Master Corporal K. Argo by calling 302-703-3264. • It’s Lovely Weather for a Sleigh Ride Together – Holiday Safety Travel Tips

It’s Lovely Weather for a Sleigh Ride Together – Holiday Safety Travel Tips

The Delaware State Police hope that everyone is going to have the safest and hap-hap-happiest Christmas and holiday season this year. Before families kick off their fun, old-fashioned family adventure by heading out into the country in the old front-wheel drive sleigh to embrace the frosty majesty of the winter landscape, Troopers are offering the following holiday travel checklist:

    • Plan your trip before you embark on your journey. Map out how you will get there and how you will return home. Then it’s happy trails, Hans! Yippee-ki-yay!
    • Make sure your car is mechanically sound. Check all fluid levels and tire air pressure readings, including the spare tire. It’s not a bad little car. It’s not bad at all, really. Maybe it just needs a little love.
    • Look into road and weather conditions to see if your car can handle them. Inclement weather can leave you stranded or lost in New York.
    • Lock the house doors and set the alarm system. Place lights and “fragile” leg lamps on timers.
    • Do not use your cell phone while driving. A screen light shouldn’t guide your sleigh tonight.
    • Take a break every few hours to stretch and refocus. Maybe snack on some pudding or some carved roast beast.
    • If you stop at a rest stop, park in a well-lit area, stay with your children, and be aware of your surroundings. Don’t let Kevin wander on his own.
    • When your car is parked, lock the doors and don’t leave any valuables or gifts in sight. The Grinch may nearby, staring down from his cave with a sour grinchy frown, at the warm lighted windows below in the town.
    • Do not drive impaired. If you’ve been drinking, call a friend, family member, or ride-sharing service. If you’re driving, avoid consuming alcohol. Instead, be sure to drink your Ovaltine.
    • Avoid posting updates on your location on social media. Harry and Marv will know that no one is home and may try to break in. Save the photo dumps for when you get back.

Ensuring that all these points are checked can prevent a family trip from being jeopardized. The “obvious” things can be easily overlooked – wouldn’t it be silly for someone to check thousands of tiny little lights, only to see that the extension cord wasn’t plugged in?

And when it comes to safety, there’s always time to double-check. Even if you still have to brush your teeth, feed the hog, still got some homework to do, still got those bills to pay – make the time! This isn’t charity – it’s family.

From Atlantic to Pacific – travel safely and enjoy the holiday season!

At the time, a 2022 Lexus RX, operated by a 35-year-old male of Lewes, DE, was also traveling eastbound on John J. Williams Highway in front of the Hyundai. As the Hyundai quickly approached the Lexus, Briscoe attempted to avoid striking the rear of the Lexus by swerving to the left, but ultimately the front right of his vehicle struck the left rear of the Lexus. This impact caused the Lexus to rotate clockwise until it struck a guardrail along the south edge of John J Williams Highway. After striking the guardrail, the Lexus was redirected into the path of the Hyundai, where the vehicles had a second collision.

When troopers arrived at the collision scene, they located two occupants of the Hyundai, Evan Briscoe (driver) and Joshua Baull (passenger), who both displayed obvious signs of impairment. Troopers discovered a handgun with an obliterated serial number inside of the vehicle. Troopers were able to determine the serial number, and a computer inquiry on the firearm revealed it was reported stolen by the Georgetown Police Department in February. Additionally, Baull was located with a gunshot wound to the lower extremity. Baull and Briscoe were transported to an area hospital for medical treatment for non-life-threatening injuries.

The operator of the Lexus and a 28-year-old female passenger were transported to an area hospital for minor injuries sustained from the collision.

  • Total Lunar Eclipse November 8th On Delmarva

Total Lunar Eclipse November 8th On Delmarva

The last total lunar eclipse for three years will occur on November 8, 2022, with the next occurring on March 14, 2025 — though we will continue to see partial and penumbral lunar eclipses during that time.

lunar eclipse occurs when the Sun, Earth, and Moon align so that the Moon passes into Earth’s shadow. In a total lunar eclipse, the entire Moon falls within the darkest part of Earth’s shadow, called the umbra. When the Moon is within the umbra, it will turn a reddish hue. Lunar eclipses are sometimes called “Blood Moons” because of this phenomenon.

How can I observe the eclipse?

You don’t need any special equipment to observe a lunar eclipse, although binoculars or a telescope will enhance the view and the red color. A dark environment away from bright lights makes for the best viewing conditions.

Totality ― the stage of the eclipse where the Moon is entirely in Earth’s shadow ― will be visible across North and Central America and in Ecuador, Colombia, and western portions of Venezuela and Peru. In Puerto Rico, the Moon sets just after totality begins. The eclipse is also visible in Asia, Australia, and New Zealand. Viewers in Alaska and Hawaii will have the opportunity to see every stage of the eclipse.

What if it’s cloudy or I’m not in the viewing region?

Numerous organizations and individuals around the globe present live streams and videos of lunar eclipses. An online search will provide multiple options for viewing from your computer screen. You can also visit NASA’s Dial-a-Moon for a visualization of the eclipse.

  • DNREC to Pilot Changes to Delaware Surf Fishing Permit Program for 2023

DNREC to Pilot Changes to Delaware Surf Fishing Permit Program for 2023

The Delaware Department of Natural Resources and Environmental Control announced today changes are to be piloted for the 2023 surf fishing permit program after record interest in the program in 2022. One of the biggest changes will be the elimination of a cap in effect since 2019 on the number of permits sold annually. The DNREC Division of Parks and Recreation will replace the cap for 2023 with a technology-based reservation system for managing capacity on summer weekends, when the state’s surf fishing beaches are in highest demand.

Last spring, the Division of Parks and Recreation initiated a comprehensive review of the program in response to unprecedented permit sales for the 2022 season – including the opening day for sales, when the online permitting system was temporarily overwhelmed and surf fishing permits sold out in just a few hours. The historic sales volume peaked at 742 permits being issued per minute, with the sales cap of 17,000 permits reached in under four hours. DNREC’s review of the program looked nationally at best practices and other states’ models for viable solutions to improve the sales process, delivery of permits, compliance with surf fishing regulations, enforcement and public safety – all with a goal of providing access to surf fishing on state park multi-use beaches while protecting the natural resource.

“Over the last few years, we have implemented changes such as single-stack parking and increased surf fishing check points at the beach crossings, which have improved public safety and the visitor experience. Piloting the changes of dropping the cap requirement, implementing a reservation system for summer weekends, and adding an educational component was the next logical step to better manage the program for the future,” said DNREC Secretary Shawn M. Garvin.

DNREC’s surf fishing permit program review and evaluation also included gathering data and information about the existing surf fishing program from staff and permit-holders, and researching best practices to identify potential strategies. The Division of Parks and Recreation sent surveys to more than 30,000 current and previous surf fishing permit holders, and received more than 7,000 responses.

A stakeholder workgroup was formed in May to evaluate the data and provide feedback on potential solutions. The workgroup comprised members from various backgrounds including four members of the Delaware General Assembly, leadership of a homeowner’s association for a neighborhood bordering state park land, Department of Transportation, Delaware Volunteer Firefighters Association, the Delaware Parks and Recreation Advisory Council, Delaware Mobile Surf Fishermen, a bait and tackle shop owner and experts in environmental science from Delaware universities.

The recommendations were presented and endorsed by the Parks and Recreation Council in August 2022. The Council was formed in 1968 with the purpose of advising the Director of Parks and Recreation concerning matters related to the planning, acquisition, development, management, conservation, and programming of lands and services under the jurisdiction of the Division.

DNREC will implement the following recommendations for the 2023 Surf Fishing Program:

    • Remove the existing 17,000-permit sales cap.
“The stakeholder committee did a thorough job of evaluating potential solutions and I am pleased that the existing 17,000 sales cap is being removed,” said State Representative Ron Gray.

“Removal of the cap will eliminate the rush that has occurred in recent years while allowing everyone equal access to purchase a surf fishing permit over a prolonged period,” said State Senator Gerald Hocker.

•Pilot the new surf fishing permit reservation system.
•Reservations will be required Saturdays, Sundays and holidays starting the third weekend in May through Labor Day weekend, from 8 a.m. to 4 p.m. Peak holidays are: Memorial Day, Juneteenth, 4th of July and Labor Day.
    • Reservations will be $4 per day and will reserve access from 8 a.m. to 4 p.m.
    • Reservations will not be available for Off-Peak surf tag permit holders.
    • Reservations will be for a specific beach location and can be made for one of seven different locations.
    • Reservations can be made conveniently online (desktop and mobile) or through the Division of Parks and Recreation’s call center. Reservations cannot be made in-person at the state parks or at the DNREC central office in Dover.
    • Reservations must be printed and displayed in the vehicle for enforcement verification. Mobile verification may be used as a backup.
