    State Police Issue Gold Alert for Missing Dover Man

    Delaware State Police Troop 3 is issuing a Gold Alert for 27-year-old Travis Smith from Dover, Delaware. Travis was last seen on July 9, 2024, in the area of Peachtree Run in the Dover. Attempts to locate him have been unsuccessful. There is a concern for his safety and well-being.

    Travis is described as a black male, approximately 5’05” tall, weighing approximately 150 lbs., with black hair and brown eyes. He was last seen wearing a blue shirt and blue jeans. He walks with a limp.

    Narrative: The Dover Police Department is investigating a bank robbery that occurred on Tuesday, July 9th at approximately 11:14 a.m.  The incident occurred when a suspect entered the bank and wrote a message on a deposit slip demanding money from the teller.  The suspect handed the message to the teller and the teller gave the suspect an undisclosed amount of cash.  The suspect then fled in a westbound direction on foot, taking the note with him.  

    The suspect is described as a light-skinned male, approximately 5’10”, wearing a white shirt, dark shorts, dark hat, and a cloth surgical mask. Surveillance footage was not available to provide at the time of this release.                          

    This investigation is ongoing and anyone with information is asked to contact the Dover Police Department at (302) 736-7130. Callers may remain anonymous.     Troopers Arrest Man for Robbery and Stolen Vehicle Charges Following Multiple Investigations Spanning Two Counties

    Delaware State Police arrested 42-year-old Thomas Pusey of Frankford, Delaware, for robbery and stolen vehicle charges following multiple investigations that occurred in Kent County and Sussex County on Friday.

    On July 5, 2024, at approximately 11:41 a.m., Troop 3 Troopers responded to Hertrich Chevrolet of Dover, located at 1450 South Dupont Highway, for a report of a stolen vehicle. Upon arriving, troopers learned an unknown white male suspect arrived at the dealership in a Mini Cooper and requested to test drive a vehicle. The suspect then got into a gray 2024 Chevrolet Silverado, locked himself inside, and disregarded the car salesman trying to stop him as he fled from the dealership without providing any identification. Troopers conducted a computer inquiry on the Mini Cooper the suspect arrived in and learned it was registered to a Frankford, Delaware address. Through investigative means, troopers learned the stolen Silverado was tracking at a residence on Powell Farm Road in Frankford. Troop 4 Troopers responded to the residence and located the stolen Silverado in the driveway. Troopers made contact with the home’s occupant, identified as Thomas Pusey, and took into custody without incident. Troopers further learned Pusey had trespassed onto his neighbor’s property and stole the Mini Cooper. Pusey then drove the stolen Mini Cooper to Hertrich Chevrolet of Dover, where he left the Mini Cooper, and stole the Silverado.

    During the investigation of the stolen Silverado, troopers identified Pusey as the suspect responsible for a robbery that occurred on July 5, 2024, at approximately 1:05 p.m., at the Walgreens, located at 34960 Atlantic Avenue in Ocean View. The robbery investigation revealed Pusey went behind the pharmacy counter after he was unable to fill his prescription and grabbed medications. Pusey then got into a physical altercation with two Walgreens employees who were attempting to prevent him from taking the medications. Pusey ultimately dropped the medications and fled from Walgreens in the stolen truck.

    Pusey was taken to Troop 4, where he was charged with the crimes listed below, arraigned by Justice of the Peace Court 2, and committed to Sussex Correctional Institution on a $13,450 cash bond.

    *Update – Fourth Suspect Arrested* Three Arrested Following Shooting in Ellendale, Detectives Ask for Help Finding Fourth Suspect

    Delaware State Police detectives have arrested 21-year-old Marcus Yunas of Ellendale, Delaware, for multiple felony charges following a shooting in Ellendale in May.

    On May 8, 2024, at approximately 12:31 a.m., troopers responded to a home on South Old State Road in Ellendale for a disorderly incident. While responding, troopers were told that shots had been fired at the same location. When troopers arrived, they found a 20-year-old woman had been shot in the leg. During the investigation, they learned a gray SUV stopped in the road, the occupants argued with people in the backyard of the house and fired shots at them, hitting the woman and the house. Troopers located the SUV and the suspects a short time later. The suspects, identified as Isaiah Yunas, and two 17-year-olds were arrested. Detectives worked to locate a fourth suspect, identified as 21-year-old Marcus Yunas.

    On June 27,2024, Yunas was arrested in Maryland and on July 8, 2024, he was extradited to Delaware. He was taken to Troop 4, charged with the crimes listed below, arraigned by Justice of the Peace Court 2, and committed to Sussex Correctional Institution on a $92,100 cash bond.

  • Commission Testifies before House Energy and Commerce Subcommittee on Innovation, Data and Commerce

    The Federal Trade Commission today testified before the House Energy and Commerce Subcommittee on Innovation, Data and Commerce on the agency’s fiscal year 2025 budget and work to promote competition and protect consumers.

    In her testimony FTC Chair Lina M. Khan discussed the FTC’s work to protect privacy and data security; fight fraud, junk fees, and related harms affecting consumers; combat opioid recovery fraud and other health fraud; stand up for all consumers, including older adults, servicemembers, and historically underserved communities; and ensure that domestic manufacturers, independent repairers, and other small businesses have a chance to compete fairly.

    On the competition side, Chair Khan highlighted the FTC’s recent rule to ban noncompete clauses in employment contracts, which the Commission estimates affect one in five U.S. workers. Chair Khan highlighted the fact that the vast majority of public comments submitted by Americans were in support of the FTC’s rule. She also discussed the Commission’s work to prevent unlawful consolidation and to identify and stop anticompetitive conduct.

    While describing some of the agency’s many accomplishments, she noted that the FTC’s work requires resources and highlighted the value the agency provides to the American people. In FY 2023, every $1 of the FTC’s costs returned an estimated $14 in benefits to Americans through the Commission’s consumer protection and competition law enforcement efforts.

    Chair Khan was joined at the hearing by Commissioners Rebecca Kelly Slaughter, Alvaro Bedoya, Melissa Holyoak and Andrew N. Ferguson.

  • FTC Order Will Ban NGL Labs and its Founders from Offering Anonymous Messaging Apps to Kids Under 18 and Halt Deceptive Claims Around AI Content Moderation

    The Federal Trade Commission and the Los Angeles District Attorney’s Office are taking action against NGL Labs, LLC and two of its co-founders, Raj Vir and Joao Figueiredo, for a host of law violations related to their anonymous messaging app, including unfairly marketing the service to children and teens. The defendants will pay $5 million to settle the lawsuit, and will be banned from offering their “NGL: ask me anything” app to anyone under the age of 18.

    In their complaint, the FTC and Los Angeles DA’s Office allege that NGL and its co-founders not only actively marketed their service to children and teens, but that they also falsely claimed that its AI content moderation program filtered out cyberbullying and other harmful messages. In addition, the complaint alleges that the defendants sent fake messages that appeared to come from real people and tricked users into signing up for their paid subscription by falsely promising that doing so would reveal the identity of the senders of messages.

    “NGL marketed its app to kids and teens despite knowing that it was exposing them to cyberbullying and harassment,” said FTC Chair Lina M. Khan. “In light of NGL’s reckless disregard for kids’ safety, the FTC’s order would ban NGL from marketing or offering its app to those under 18. We will keep cracking down on businesses that unlawfully exploit kids for profit.”

    “The consequences of these actions can be severe. The anonymity provided by the app can facilitate rampant cyberbullying among teens, causing untold harm to our young people,” Los Angeles District Attorney George Gascón said. “We cannot tolerate such behavior, nor can we allow companies to profit at the expense of our children’s safety and well-being. Today’s charges send a clear message that deceptive practices and targeting vulnerable populations will not be tolerated.”

    California-based NGL was launched in 2021 as an anonymous messaging service that allows people to receive anonymous messages from their friends and social media followers. NGL and its operators marketed the app as a “safe space for teens” and claimed it uses “world class AI content moderation” including “deep learning and pattern matching algorithms” to combat cyberbullying and other harms.

    In their complaint, however, the FTC and the Los Angeles DA’s office allege that NGL and its operators actively marketed their service to kids despite being aware of the harms from similar services; made false claims about their AI content moderation program; deceived users with fake messages and other tactics aimed at driving up the number of paid users; failed to clearly disclose and obtain consent for recurring charges for its NGL Pro service; and violated the Children’s Online Privacy Protection Act Rule (COPPA Rule).

    After consumers downloaded the NGL app, they could share a link on their social media accounts urging their social media followers to respond to prompts such as “If you could change anything about me, what would it be?” Followers who clicked on this link were then taken to the NGL app, where they could write an anonymous message that would be sent to the consumer.

    After failing to generate much interest in its app, NGL in 2022 began automatically sending consumers fake computer-generated messages that appeared to be from real people. When a consumer posted a prompt inviting anonymous messages, they would receive computer-generated fake messages such as “are you straight?” or “I know what you did.” NGL used fake, computer-generated messages like these or others—such as messages regarding stalking—in an effort to trick consumers into believing that their friends and social media contacts were engaging with them through the NGL App.

    When a user would receive a reply to a prompt—whether it was from a real consumer or a fake message—consumers saw advertising encouraging them to buy the NGL Pro service to find out the identity of the sender. The complaint alleges, however, that consumers who signed up for the service, which cost as much as $9.99 a week, did not receive the name of the sender. Instead, paying users only received useless “hints” such as the time the message was sent, whether the sender had an Android or iPhone device, and the sender’s general location. NGL’s bait-and-switch tactic prompted many consumers to complain, which NGL executives laughed off, dismissing such users as “suckers.”

    In addition, the complaint alleges that NGL violated the Restore Online Shoppers’ Confidence Act by failing to adequately disclose and obtain consumers’ consent for such recurring charges. Many users who signed up for NGL Pro were unaware that it was a recurring weekly charge, according to the complaint.

    NGL Targeted Kids and Teens

    The FTC and Los Angeles DA also say that NGL and its operators aggressively marketed its service to children and teens even though they were aware of the dangers of cyberbullying on anonymous messaging apps. Company executives told employees to reach out to high school kids directly. Figueiredo urged employees to get “kids who are popular to post and get their friends to post” and noted that the “best way is to reach out on [Instagram] by finding popular girls on high school cheer [Instagram] pages,” according to the complaint.

    The complaint says the company falsely claimed that its AI-powered system would filter out cyberbullying and other harmful messages. In fact, users complained that NGL failed to prevent rampant cyberbullying and threats against children and teens. One consumer reported that their friend had attempted suicide because of the NGL app, according to the complaint.

    In addition to failing to crack down on cyberbullying, the FTC and Los Angeles DA say NGL also violated the COPPA Rule, which requires apps and other online services that are directed to or knowingly being used by children under 13 to inform their parents about the personal information they collect from children and obtain verifiable parental consent from their parents. According to the complaint, the company was aware that numerous children used the app and made no attempt to verify the age of its users, failed to obtain parental consent to collect and use personal data collected from children under 13, failed to honor parents’ request to delete their children’s personal data, and retained children’s data longer than reasonably necessary to fulfill the purpose for which the data was collected.

    Proposed Order

    In addition to the ban on marketing anonymous messaging apps to kids and teens under 18, the proposed order also requires NGL, Vir, and Figueiredo to pay $4.5 million, which will be used to provide redress to consumers, and a $500,000 civil penalty to the Los Angeles DA’s office. Under the proposed order, which must be approved by a federal court before it can go into effect, NGL and its operators also will be:

    • Required to implement a neutral age gate that prevents new and current users from accessing the app if they indicate that they are under 18 and to delete all personal information that is associated with the user of any messaging app unless the user indicates they are over 13 or NGL’s operators obtain parental consent to retain such data;
    • Prohibited from making misrepresentations about the sender of messages on any app and making similar false claims as outlined in the complaint;
    • Prohibited from making misrepresentations about the capabilities of any artificial intelligence technology, and its ability to filter out cyberbullying;
    • Prohibited from making misrepresentations related to negative options and required to disclose all details related to recurring charges; and
    • Required to obtain express informed consent from consumers prior to billing them for a negative option subscription, provide a simple mechanism for cancelling any negative option subscriptions, and to send reminders to consumers about negative option charges.

    The Commission vote authorizing the staff to file the complaint and stipulated final order was 5-0. The FTC filed the complaint and final order in the U.S. District Court for the Central District of California. Commissioners Melissa Holyoak and Andrew N. Ferguson issued separate statements.

    NOTE: The Commission files a complaint when it has “reason to believe” that the named defendants are violating or are about to violate the law and it appears to the Commission that a proceeding is in the public interest. Stipulated final orders have the force of law when approved and signed by the District Court judge.

    State Police Detectives Arrest Lewes Man for Felony Theft

    Delaware State Police have arrested 31-year-old William Rodenbaugh of Lewes, Delaware for felony theft and attempted theft from vehicles in the Angola area.

    On June 11, 2024, troopers began investigating a theft and attempted theft from vehicles in the Angola area near Lewes. During the investigation, troopers learned that an unknown suspect had gone through vehicles in the neighborhoods of Angola Beach and Estates, Bayridge Crossing, and The Cove between June 11 and June 14 where money had been stolen. Troopers also learned that the suspect had trespassed on several properties in those neighborhoods. Through investigative means, detectives identified William Rodenbaugh as the suspect and obtained a warrant for his arrest.

    On July 5, 2024, detectives arrested Rodenbaugh. He was taken to Troop 4, charged with the crimes listed below, arraigned by Justice of the Peace Court 2, and released on a $5,000 unsecured bond. However, he was committed to Sussex Correctional Institution on an existing capias warrant.

She was last seen leaving Christiana Hospital around 9:46 a.m., on July 5, 2024.  Attempts to contact or locate her have been unsuccessful. There is a concern for her safety and well-being.

    Christina is described as a black female, approximately 5’5”-5’7″ tall, and weighing approximately 200 pounds. Her clothing description is unknown.

    Detectives Investigating Armed Robbery in Smyrna

    The Delaware State Police are investigating an armed robbery that occurred Saturday night in Smyrna.

    On July 6, 2024, at approximately 9:26 p.m., troopers responded to a report of an armed robbery that occurred at the intersection of Joseph Wick Drive and Willowwood Drive in Smyrna. The preliminary investigation revealed that the victim was walking home when he was approached by 2 unknown black male suspects. A physical altercation ensued between the suspects and victim, during which one of the suspects struck the victim in the back of the head with a handgun. After the altercation ended, the victim attempted to retrieve his jacket and other personal property from the street, however, one of the suspects threatened to shoot him if he grabbed the jacket. The 17-year-old victim, who had sustained a minor injury to the back of his head, then fled from the scene without his personal property.

    The suspects are described as black males, approximately 18-19 years old, approximately 5’6″-5’7″ tall, with average builds. Surveillance video and images of the suspects are not available.

    Troopers Arrest Man for 10th Offense DUI following Traffic Stop in Lincoln

    Delaware State Police arrested 58-year-old Anthony Nesmith of Lincoln, Delaware, for a 10th offense felony DUI following a traffic stop in Lincoln on Friday night.

    On July 5, 2024, at approximately 9:15 p.m., a trooper on patrol in the area of Greentop Road and Greely Avenue, Lincoln, observed a black Acura RL fail to maintain its lane as it was traveling westbound on Greely Avenue. The trooper conducted a traffic stop and made contact with the driver, identified as Anthony Nesmith. During the contact with Nesmith, the trooper observed multiple signs of impairment and administered Standardized Field Sobriety Tests. Following the tests, Nesmith was taken into custody without incident for driving under the influence. A computer inquiry revealed Nesmith had 9 prior DUI-related convictions.

    Nesmith was transported to Troop 7, where he was charged with the crime listed below, arraigned by Justice of the Peace Court 7, and committed to Sussex Correctional Institution on a $8,000 cash bond.

    State Police Investigating Robbery in Frederica

    The Delaware State Police are investigating a robbery that occurred Saturday night in Frederica.

    On July 6, 2024, at approximately 10:45 p.m., troopers responded to a report of a robbery that occurred on Sycamore Drive in Frederica. The preliminary investigation revealed that the victim was walking on Sycamore Drive when she was approached by an unknown black male suspect on a bicycle. The suspect demanded money from the victim before he proceeded to steal the victim’s backpack. The suspect then fled south on Sycamore Drive on the bicycle with the victim’s property. The victim was not injured.

    The suspect is described as a black male wearing dark-colored clothing. Surveillance video and images of the suspect are not available.

    State Police Investigating Fatal Pedestrian Crash on I-495

    The Delaware State Police are investigating a fatal pedestrian crash that occurred last night on I-495 near Edgemoor that left one woman dead.

    On July 7, 2024, at approximately 11:43 p.m., a white 2015 Honda Accord was traveling in the left lane of I-495 northbound, north of Edgemoor Road. At the same time, a pedestrian, who was not wearing any reflective clothing or carrying a flashlight, was attempting to cross from the left side of I-495 northbound to the right side. The pedestrian crossed in the path of the Honda and was struck in the left lane of I-495 northbound. After the collision, the Honda came to a stop on the left shoulder. During the investigation, it was discovered the pedestrian was initially operating a black 2014 Jeep Grand Cherokee, which was located approximately 1/4 mile north of the crash scene on the right shoulder with its hazard lights on.

    The pedestrian, a 38-year-old woman from Elkton, Maryland, was pronounced dead at the scene. Her name is being withheld until her family and relatives are notified.

    The driver of the Honda, a 47-year-old man from Bear, Delaware, was not injured.

    The roadway was closed for approximately 3 hours while the investigators examined the scene and cleared the roadway.

    Troop 2 Collision Reconstruction Unit Investigating Fatal Pedestrian Hit-and-Run Crash in Newark

    The Delaware State Police are investigating a fatal pedestrian hit-and-run crash that occurred yesterday afternoon in Newark that left one man dead.

    On July 5, 2024, at approximately 4:14 p.m., a pedestrian was walking northbound on the right shoulder of Salem Church Road, north of Michaels Lane. At the same time, an unknown white vehicle was also traveling northbound on Salem Church Road, north of Michaels Lane. For unknown reasons, the vehicle failed to maintain its lane of travel and drifted onto the shoulder, where it struck the pedestrian. The striking vehicle did not remain at the scene and fled northbound on Salem Church Road.

    The pedestrian, a 57-year-old man from Newark, Delaware, was taken by ambulance to an area hospital, where he was pronounced dead. His name is being withheld until his family and relatives are notified.

    The striking vehicle is a white vehicle of an unknown make and model with possible damage to the front right.

    State Police Arrest Man for Multiple Shopliftings at Wegmans

    Delaware State Police arrested 52-year-old Thomas Hetzler, of Wilmington, Delaware, for retail theft charges stemming from multiple shopliftings that occurred at the Wegmans, located at 371 Buckley Mill Road in Wilmington.

    On July 4, 2024, at approximately 7:00 p.m., a trooper on duty was notified by a Wegmans employee that a habitual shoplifter was trespassing on the property and had a shopping cart full of grocery items. The employee recognized the man, identified as Thomas Hetzler, and his actions from previous Wegmans shopliftings. The trooper made contact with Hetzler as he exited the store with a cart full of stolen goods that totaled over $300, and took him into custody without incident. A computer inquiry revealed Hetzler had an active No Contact Order with Wegmans issued by the New Castle County Court of Common Pleas, and warrants for his arrest for shopliftings of a similar nature that occurred on March 19, 2024, and June 26, 2024, at Wegmans. In each shoplifting, Hetzler filled up a shopping cart with various grocery items and left the business without paying.

    Hetzler was taken to Troop 1, where he was charged with the crimes listed below, arraigned by Justice of the Peace Court 2, and released on a $5,250 unsecured bond.

    State Police Arrest Fugitive for Several Retail Theft Charges throughout New Castle County

    Delaware State Police arrested 33-year-old Moses Warren of Newark, Delaware, for several retail thefts that occurred over the last month at multiple businesses throughout New Castle County.

    On June 30, 2024, at approximately 6:42 p.m., a trooper responded to the Kohl’s, located at 401 Rocky Run Boulevard, Wilmington, for a report of two black males and one white female that fled towards Concord Pike after shoplifting. While responding, the trooper observed a man who matched the suspect’s description walking on Concord Pike in the area of Rocky Run Boulevard. The trooper recognized the man as Moses Warren from previous investigations and took him into custody without incident. The trooper searched the bag Warren was carrying and recovered over $2,000 worth of merchandise that had been shoplifted from Kohl’s. Troopers searched the area for other two suspects, however, they were not located.

    Warren was taken to Troop 2, where the trooper identified him as the suspect responsible for 18 shopliftings from multiple businesses throughout New Castle County over the last month. Between May 26, 2024, and June 28, 2024, troopers investigated shopliftings involving Warren as the suspect from Giant, Rite Aid, Royal Farms, and multiple Kohl’s, Sunglass Hut at Macy’s, Walgreens, and Wawa locations. The shopliftings totaled over $40,000 worth of stolen merchandise consisting of eyewear, various household goods, and cigarettes. In the shoplifting that occurred on June 6, 2024, at the Wawa located at 274 East Chestnut Hill Road, Newark, Warren shoplifted with an unknown Hispanic male. In the shoplifting that occurred on June 20, 2024, at the Sunglass Hut at Macy’s located at the Christiana Mall, Newark, Warren shoplifted with an unknown black male and unknown black female. After each incident, troopers obtained a warrant for Warren’s arrest and attempted to locate him. At this time, Warren’s accomplices have not been identified, and images of the suspects are not available.

    A computer inquiry revealed that in addition to the shoplifting warrants, Warren had a capias for his arrest and an active No Contact Order with all Walgreens properties in Delaware, both of which were issued by the New Castle County Court of Common Pleas. At Troop 2, Warren was charged with the crimes listed below, arraigned by Justice of the Peace Court 11, and committed to Howard R. Young Correctional Institution on a $99,102 cash bond.

    • Shoplifting Over $1,500 (Felony) – 7 counts
    • Wearing a Disguise During the Commission of a Felony (Felony)

    Troopers Arrest Milton Woman in Stolen Acura Following Pursuit

    Delaware State Police arrested 30-year-old Jenifer Hirl of Milton, Delaware, for multiple offenses following a pursuit in a stolen Acura yesterday near Milton.

    On July 4, 2024, at approximately 5:19 p.m. troopers were notified of a stolen Acura ATL from New Jersey that was being electronically tracked, driving southbound on Coastal Highway near Milton. Troopers found the car on West Randor Drive in Milton and tried to pull it over, but it did not stop. During the pursuit, the Acura drove on several area streets until it returned to West Randor Drive and stopped. The driver, identified as Jenifer Hirl, attempted to walk away but was quickly arrested after a brief struggle. Hirl was taken to Troop 7 and throughout their contact, troopers saw signs of impairment and administered Standardized Field Sobriety Tests.

    At Troop 7, Hirl was charged with the crimes listed below, arraigned by Justice of the Peace Court 7, and committed to Sussex Correctional Institution on a $7,900 cash bond.

    Troopers Arrest Teen for Multiple Gun and Drug Offenses Following Traffic Stop in Camden Wyoming

    The Delaware State Police arrested a 17-year-old male from Dover, Delaware, for multiple gun and drug offenses following a traffic stop that occurred in Camden Wyoming on Friday morning.

    On June 28, 2024, at approximately 9:51 a.m., a trooper on patrol noticed the driver of a black 2007 Lincoln Navigator was not wearing his seatbelt while traveling on South State Street in the area of Troop 3. The trooper conducted a traffic stop and made contact with the Lincoln’s 17-year-old driver, who did not have a valid driver license. During the traffic stop, a search of the driver’s person led to the discovery of approximately 1 gram of marijuana wax. Subsequently, a probable cause search of the Lincoln led to the discovery of a loaded Derringer handgun, and several rounds of .25 caliber ammunition. The driver was taken into custody without incident. A computer check showed that the gun had been reported as stolen in Ohio.

    The 17-year-old was taken to Troop 3, where he was charged with the crimes listed below, arraigned by Justice of the Peace Court 7, and committed to Vision Quest Detention Center on a $16,202 secured bond.

    The Delaware State Police have arrested 18-year-old Tyler Morrison of Delmar, Delaware for a shooting that occurred in Seaford in May.

    On May 29, 2024, at approximately 6:21 p.m., troopers responded to a home on the 26000 block of Kelly Circle in Seaford for a report of a shooting. When troopers arrived, they learned that two unknown suspects fired several rounds at an occupied house and injured a 15-year-old girl. Through investigative means, detectives identified Lukas and Tyler Morrison as the suspects in the shooting. On May 31, 2024, detectives arrested Lukas and continued their search for Tyler.

    On July 3, 2024, Tyler Morrison was arrested and taken to Troop 5, where he was charged with the crimes listed below, arraigned by Justice of the Peace Court 2, and committed to Sussex Correctional Institution on a $131,500 cash bond.

Attempts to contact or locate him have been unsuccessful, and he has made statements that raise concerns for his safety and well-being.

    He is described as a white male, approximately 5’6” tall, weighing about 155 pounds, with blue eyes and short brown hair. His clothing description is currently unknown, and it is unclear whether he is traveling on foot or by car.

    Troopers Arrest Hartly Man for Reckless Endangering After DUI Crash

    Delaware State Police arrested 26-year-old Steven Wolinski of Hartly, Delaware, for several felony offenses following a crash into a Hartly residence yesterday.

    On July 2, 2024, at approximately 6:05 p.m., troopers responded to a report of a Chevrolet Silverado that crashed into an occupied house on the 4000 block of Arthursville Road in Hartly. The driver of the Silverado ran away from the crash scene before troopers arrived. After troopers arrived, they searched the area and found the driver, later identified as Steven Wolinksi. He was arrested and taken to Troop 3. Throughout their contact with Wolinksi, troopers saw multiple signs of impairment and he refused to perform field tests. During the investigation, troopers searched the Silverado and found a loaded firearm and open bottles of alcoholic beverages in the truck. No one was injured as a result of the crash.

    At Troop 3, Wolinski was charged with the crimes listed below, arraigned by Justice of the Peace Court 7, and committed to Sussex Correctional Institution on a $76,102 secured bond.

    The Delaware State Police are investigating an armed carjacking that occurred early this morning at a Wawa in New Castle.

    On July 3, 2024, at approximately 2:18 a.m., troopers responded to a report of an armed carjacking that occurred at the Wawa located at 117 South Dupont Highway in New Castle. Upon arriving, troopers learned that an unknown black male suspect approached the 25-year-old victim in the parking lot and demanded the victim’s car keys while lifting his shirt to show a firearm. The victim complied and the suspect fled towards State Route 273 in the stolen Honda Accord.

    The suspect is described as an unknown black male. Surveillance video and images are not yet available.

    Troopers Arrest Man for 6th Offense DUI in Newark

    Delaware State Police arrested 43-year-old Ronnie Steele of Delaware City, Delaware, for a 6th offense felony DUI on Monday morning in Newark.

    On July 1, 2024, at approximately 8:38a.m., a trooper responded to the Lunch Box Garage, located at 2742 Pulaski Highway, Newark, for a report of a black GMC pickup truck blocking the business’ garage doors. Prior to the trooper arriving, the staff approached the truck and made contact with the male driver, who was slumped over the wheel. After staff woke up the driver, he reversed the truck away from the garage doors and fell asleep again after coming to a stop in the parking lot. Upon arriving, the trooper approached the black 2021 GMC Sierra, which was stopped in the parking lot while still in reverse, and observed a sleeping male driver, later identified as Ronnie Steele. After the trooper woke up Steele, he observed multiple signs of impairment throughout his contact with Steele. Steele refused to perform field tests and was taken into custody without incident. A computer inquiry revealed Steele had five prior DUI-related convictions.

    Steele was transported to Troop 2, where he was charged with the crime listed below, arraigned by Justice of the Peace Court 2, and committed to Howard R. Young Correctional Institution on a $10,000 cash bond.

    On July 2, 2024, at approximately 2:02 p.m., a 2017 Toyota Camry was traveling in the left turn lane on Dupont Parkway northbound at the intersection with the entrance ramp to DE State Route 1 northbound. At the same time, a 2002 Yamaha YZFR1 motorcycle was traveling in the left lane on Dupont Parkway southbound approaching the same intersection. The preliminary investigation revealed the Toyota made a left turn towards the ramp for DE SR 1 northbound at the same time the Yamaha entered the intersection. As a result, the front of the Toyota struck the front of the Yamaha, which caused the motorcyclist to be ejected.

    The operator of the Yamaha, a 54-year-old man from Dover, Delaware, was pronounced dead at the scene. His name is being withheld until his family and relatives are notified.

    The driver of the Toyota, a 26-year-old woman from Bear, Delaware, was not injured.

    The roadway was closed for approximately 4 hours while the scene was investigated and cleared.

    Narrative:

    The Dover Police Department has arrested Agmere Matthews, 32, of Dover, on drug and firearm charges following a shots fired complaint early Wednesday morning. The investigation began at 4:04 a.m., when Dover Police was called to the unit block of South New Street for the report of shots fired. Officers were able to review downtown surveillance and observe a suspect in the area holding a firearm. Officers responded to the area and took the suspect, identified as Matthews, into custody without incident. Officers located 23 grams of crack cocaine, and an undisclosed amount of money on Matthews when he was taken into custody. Officers also located a Walther .38 caliber firearm after canvassing the area that Matthews had come from prior to being taken into custody.

    Matthews was transported to Dover Police Department where he was processed and arraigned.

    Matthews was committed to SCI on $55,000 secured bail on the following charges:
    -Possession of a Firearm During the Commission of a Felony
    -Possession with Intent to Deliver a Controlled Substance in a Tier 2 Quantity
    -Possession of a Firearm by a Person Prohibited

    Matthews is presumed innocent until proven guilty.

  • FTC Warns Companies to Stop Warranty Practices That Harm Consumers’ Right to Repair

    Federal Trade Commission staff sent warning letters to eight companies about their warranty practices that may be standing in the way of consumers’ right to repair products they have purchased.

    The warning letters inform the companies of FTC staff’s concerns that their practices violate the Magnuson-Moss Warranty Act (MMWA), a law that governs consumer product warranties and is enforced by the FTC.

    “These warning letters put companies on notice that restricting consumers’ right to repair violates the law,” said Samuel Levine, Director of the FTC’s Bureau of Consumer Protection. “The Commission will continue our efforts to protect consumers’ right to repair and independent dealers’ right to compete.”

    The letters to five of the companies warn that FTC staff has concerns about the companies’ statements that consumers must use specified parts or service providers to keep their warranties intact. Unless warrantors provide the parts or services for free or receive a waiver from the FTC, such statements are generally prohibited by the MMWA. Similarly, such statements may be deceptive under the FTC Act.

    These letters were issued to air purifier sellers aeris Health, Blueair, Medify Air, and Oransi, along with treadmill company InMovement.

    Letters to three other companies warn against their use of stickers containing “warranty void if removed” or similar language that are placed in locations on products that hinder consumers’ ability to perform routine maintenance and repairs on their products.

    These letters were issued to ASRock, Zotac, and Gigabyte, companies that market and sell gaming PCs, graphics chips, motherboards, and other accessories.

    FTC staff has urged each company to review its promotional and warranty materials to ensure that such materials do not state or imply that warranty coverage is conditioned on the use of specific parts or services. The letters state that FTC staff will review the companies’ websites after 30 days and that failure to correct any potential violations may result in law enforcement action.

    The Delaware State Police are investigating an armed robbery that occurred this morning at a Walgreens in Newark.

    On July 2, 2024, at approximately 8:07 a.m., troopers responded to a report of an armed robbery at the Walgreens located at 2719 Pulaski Highway in Newark. The preliminary investigation revealed that an unknown black male suspect armed with a firearm approached a Walgreens employee and demanded money from the safe. The employee complied and the suspect fled in an unknown direction with an undisclosed amount of cash.

    The suspect is described as a black male wearing dark-colored clothing. Surveillance video and images of the suspect are not available.

    Delaware State Police continue to investigate a shooting that occurred at the Big Chill Surf Cantina parking lot in Rehoboth. Through investigative means, detectives identified the suspect responsible for the shooting as 28-year-old Jonathan Blackwell of Milford, Delaware and obtained a warrant for his arrest for several felony offenses.

    On June 30, 2024, Blackwell was taken into custody in Pennsylvania. Upon extradition to Delaware, he will be charged with the following crimes:

    • Assault 1st Degree (Felony)
    • Possession of a Firearm During the Commission of a Felony (Felony)
    • Carrying a Concealed Deadly Weapon – Firearm (Felony)

    The Delaware State Police are investigating a robbery that occurred early this morning at Red Roof Inn and Suites in New Castle.

    On July 2, 2024, at approximately 3:18 a.m., troopers responded to an armed robbery at Red Roof Inn and Suites, located at 1612 North Dupont Highway in New Castle. The preliminary investigation revealed that an unknown black male and unknown black female suspects entered the business and demanded money. The male suspect then jumped over the counter and threatened the desk clerk with a knife. The clerk complied and the suspects ran away. No one was hurt during the incident.

    The male suspect was last seen wearing all black clothing and the female was last seen wearing a white t-shirt, black mask, and a hat.

The preliminary investigation revealed that an unknown suspect fired several rounds at the house from an unknown passing vehicle. Troopers recovered numerous shell casings at the scene. There were two adults in the home at the time of the shooting. No one was injured, and the motive behind the incident remains under investigation.

    State Police Investigating Three-Vehicle Fatal Crash in Wilmington

    The Delaware State Police are investigating a three-vehicle fatal crash that occurred yesterday afternoon in Wilmington that left one man dead.

    On July 1, 2024, at approximately 3:50 p.m., a gray 2008 Toyota Camry was traveling eastbound on Wilson Road. For unknown reasons, the Toyota failed to remain in its lane and entered the right shoulder, where it struck a mailbox on the 1000 block of Wilson Road. The Toyota then swerved back towards the roadway and crossed the solid double yellow line into the path of travel of a black 2011 Mercedes S550 traveling westbound on Wilson Road. As a result, the front of the Toyota struck the front of the Mercedes. After the collision, the Mercedes rotated counterclockwise and struck an occupied tan 2002 Buick LeSabre parked on the shoulder of westbound Wilson Road.

    The driver of the Toyota, an 89-year-old man from Wilmington, Delaware, was pronounced dead at the scene. His name is being withheld until his family and relatives are notified.

    The driver of the Mercedes, a 62-year-old man from Wilmington, Delaware, was taken by ambulance to an area hospital for non-life-threatening injuries. The Buick’s occupant, a 65-year-old woman from Wilmington, Delaware, was not injured.

    The roadway was closed for approximately 4 hours while the scene was investigated and cleared.

    The Dover Police Department has arrested Tyler Keenan, 32, of Dover, on burglary charges following an incident Monday morning. The investigation began at 9:34 a.m., when Dover Police received a call for a burglary that had occurred at Laundry Lagoon. Officers responded and the ensuing investigation revealed that at approximately 1:00 a.m., a suspect entered an unsecured door at the business and, once inside, damaged a vending machine and stole merchandise before leaving. Keenan was identified as the suspect in this incident and he was taken into custody without incident at a nearby business. 

    Keenan was transported to Dover Police Department to be processed and arraigned.

    He was released on OR bond on the following charges:
    -Burglary Third Degree
    -Theft Under $1,500
    -Criminal Mischief $1,000 – $5,000

    Keenan is presumed innocent until proven guilty.

  • FTC Takes Action Against Online Used Car Dealer Vroom for Deceiving Customers, Failing to Deliver on Time and Provide Required Disclosures

    The Federal Trade Commission has taken action against online used car dealer Vroom for misrepresenting that it thoroughly examined all vehicles before listing them for sale and failing to obtain consumers’ consent to shipment delays or provide prompt refunds when cars weren’t delivered in the time Vroom promised.

    Texas-based Vroom has agreed to a proposed settlement that would require the company to pay $1 million to refund consumers harmed by the company’s conduct and prohibit the company from further misleading consumers and failing to provide required disclosures.

    “Vroom promised the fast deliveries of thoroughly inspected cars, but sped right past compliance,” said Samuel Levine, Director of the FTC’s Bureau of Consumer Protection. “Online car dealers and other Internet sellers must provide required disclosures just like any brick-and-mortar businesses that comply with the law.”

    In its complaint against Vroom, the FTC alleges that the company failed to follow the Used Car Rule, the Pre-Sale Availability Rule and the Mail, Internet, and Telephone Order Rule (MITOR).

    Since 2019, Vroom has sold more than 170,000 vehicles to consumers through its website. In its advertising, Vroom said that its cars underwent “multiple inspections” to ensure they were in good condition in an effort to alleviate consumers’ concerns about buying a used car without being able to inspect it before purchasing. Vroom’s website even listed 184 points of inspection that were checked on every car they sold.

    Consumer complaints about the company told a different story, according to the FTC’s complaint. Numerous consumers complained about the condition of the cars they received from Vroom, with everything from loud grinding noises, bald tires, and worn brakes being reported.

    The complaint also notes that Vroom told consumers that cars purchased from the company would be delivered in 14 days or less in its advertising and on its website. Despite making this clear statement, when it couldn’t meet that delivery timeline, Vroom regularly failed to give consumers the chance to either consent to a longer delivery timeline or cancel their purchase and receive a prompt refund, as required by MITOR. The complaint cites instances where consumers have had to wait as much as three months or longer before their car arrived.

    As a used car dealer, Vroom also is required to follow the FTC’s Used Car Rule, which includes  a requirement that the dealer properly complete and display a “Buyers Guide” on each used car it offers for sale. The Buyers Guide gives consumers important information about whether the used car comes with a warranty or it is being sold “as is.” 

    If the car is sold with a dealer’s warranty, the Used Car Rule requires the Buyers Guide to list its basic terms and conditions, including the duration of coverage, the percentage of total repair costs to be paid by the dealer, and the exact systems covered by the warranty. The complaint alleges that Vroom failed to provide the Buyers Guide until late in the purchase process, and that the Guides were often missing required information.

    Finally, the complaint alleges that Vroom violated the Pre-Sale Availability Rule because it did not post the terms of its warranty on its website in close proximity to the warranted used vehicle. Nor did Vroom inform customers how they could obtain the warranty’s terms prior to the receipt of the sale documents.

    Under the terms of the proposed settlement, Vroom will be required to pay $1 million to the FTC to be used to provide refunds to consumers who were harmed by the company’s unlawful practices.

    The settlement also prohibits the company from making misleading claims to consumers about inspections or shipping, and requires Vroom to document all claims about promises it makes about shipping times to consumers, as well as requiring Vroom to follow the requirements of MITOR, the Used Car Rule, and Pre-Sale Availability Rule.

    The Commission vote authorizing the staff to file the complaint and stipulated final order was 5-0. The FTC filed the complaint and final order in the U.S. District Court for the Southern District of Texas.

    NOTE: The Commission files a complaint when it has “reason to believe” that the named defendants are violating or are about to violate the law and it appears to the Commission that a proceeding is in the public interest. Stipulated final orders have the force of law when approved and signed by the District Court judge.

  • FTC Takes Action Against Gig Work Company Arise Virtual Solutions for Deceiving Consumers About Pay in Marketing Its Business Opportunity

    The Federal Trade Commission is taking action against gig work company Arise Virtual Solutions for misleading consumers about the money they could make on Arise’s platform and marketing its business opportunity without complying with the FTC’s Business Opportunity Rule, including the requirement to truthfully disclose the basis for earnings claims to consumers.

    Under the proposed settlement, Arise would be required to pay $7 million, which will be refunded to consumers harmed by its misconduct, and must be able to back up any earnings claims it makes in the future.

    “Arise lured in workers with false promises about what they could earn while requiring them to pay out-of-pocket for essential equipment, training, and other expenses,” said FTC Chair Lina M. Khan. “Operating in the ‘gig’ economy is no license for evading the law, and the FTC will continue using all its tools to protect Americans from unlawful business practice.”

    In its complaint against Arise, the FTC charges that the company regularly used misleading advertisements saying that consumers who signed up on their platform would have access to jobs that paid “up to $18/hour” doing remote customer service work for major companies. The company heavily promoted this business opportunity online, targeting stay-at-home mothers and others who might be looking for opportunities to support their families by working from home. Most of the gig workers Arise recruited were Black, and almost all of them were women. 

    According to the complaint, when Arise begin citing the $18/hour figure in 2020, its own internal documents showed that the average pay for jobs on its gig work platform was just $12/hour. In fact, from 2019 to 2022, 99.9% of the consumers who joined the Arise platform made less than $18/hour in hourly base pay. The overinflated earnings claims were effective in drawing consumers in; Arise’s market testing showed more consumers responded to these specific claims than those simply advertising “extra income.”

    Arise continued running ads touting earnings of up to $18/hour even after receiving a Notice of Penalty Offenses from the FTC regarding false and unsubstantiated earnings claims in money-making opportunities in 2022.

    In addition to the fact that consumers’ pay was nearly always below the levels Arise advertised, the complaint alleges that the company’s earnings claims did not factor in the substantial fees consumers faced when joining and using the Arise platform.

    According to the complaint, consumers who join the Arise platform are required to make hundreds of dollars in equipment purchases like computers and headsets, including some equipment that is purchased from and financed by Arise. In addition, until July 2022, Arise charged consumers as much as $250 for training programs that were required before consumers could begin money-earning jobs, and only stopped charging for that training after learning of the FTC’s investigation.

    Arise also has failed to provide the documents and disclosures required by the FTC’s Business Opportunity Rule. This is the first case where the Commission has charged a company in the gig economy with violating the Business Opportunity Rule, which requires that prospective workers receive key disclosures about earnings claims and other important information before they decide to invest their time and money in a business opportunity.

    Beyond the startup costs, Arise also charges workers on its platform nearly $40 each month in mandatory fees, which further reduced consumers’ effective earnings. When consumers left the Arise platform after discovering that their pay was not sufficient or equal to what Arise promised, their expenses were not refunded.

    In addition to the $7 million payment, Arise will be permanently prohibited from making any earnings claims to consumers without being able to substantiate those claims as part of the proposed settlement. In addition, Arise will be prohibited from making any false or misleading claims generally and will be required to provide the disclosures mandated by the Business Opportunity Rule.

    The Commission vote authorizing the staff to file the complaint and stipulated final order was 5-0. The FTC filed the complaint and final order in the U.S. District Court for the Southern District of Florida. Chair Lina M. Khan and Commissioners Melissa Holyoak and Andrew Ferguson issued statements.

    Arise also faces concurrent litigation with the U.S. Department of Labor in the U.S. District Court for the Southern District of Florida over separate allegations that it misclassified its workers as independent contractors.

    The Delaware State Police arrested 28-year-old Breana Brooks of Dover, Delaware, for stealing a Nissan from Delaware Park Casino’s parking lot on Friday afternoon.

    On June 28, 2024, at approximately 5:58 p.m., a trooper responded to Delaware Park Casino located at 777 Delaware Park Boulevard, Wilmington, for a report of a black Nissan Altima that was stolen from the parking lot. During the investigation, the trooper discovered an unknown black female suspect stole the victim’s car keys from her jacket while the jacket was left unattended at a slot game. The suspect then went out to the parking lot, located the matching car, and fled in the stolen Nissan. Through investigative means, the trooper identified the suspect as Breana Brooks, and obtained a warrant for her arrest.

    On June 29, 2024, Brooks was located in the stolen Nissan by the Dover Police Department. She was taken into custody and transported to Troop 3, where she was charged with the crimes listed below, arraigned by Justice of the Peace Court 7, and committed to Delores J. Baylor Women’s Correctional Institution on a $2,000 secured bond.

    Troopers Arrest Man for Harassment in Stolen Truck at Rehoboth Mall

    Delaware State Police arrested 38-year-old Jordan Newberry of Delmar, Delaware, for receiving stolen property and harassment following a suspicious person investigation yesterday at Rehoboth Mall.

    On June 30, 2024, at approximately 12:35 p.m., a trooper responded to Walmart, located at 18922 Rehoboth Mall Boulevard in Rehoboth Beach, for a report of a suspicious person. When the trooper arrived, he learned that an unknown male suspect had been following the victim around the store, which caused her to feel alarm. After the victim exited the store, the suspect got into a white GMC Sierra and continued to follow while she was in the parking lot. During the investigation, the victim saw the suspect near the Walmart, and notified the trooper. The trooper contacted the suspect, later identified as Jordan Newberry, at the Grocery Outlet in Rehoboth Mall, and arrested him. The trooper located the suspect’s white GMC Sierra with Maryland registration in the parking lot, and discovered it was reported stolen to the Salisbury Police Department in Maryland on June 29, 2024.

    Newberry was taken to Troop 7, where he was charged with the crimes listed below, arraigned by Justice of the Peace Court 3, and committed to Sussex Correctional Institution on a $6,000 cash bond.

    Troopers Arrest Man for Felony Criminal Mischief of Townsend Business

    The Delaware State Police have arrested 24-year-old Jacob Singleton of Bear, Delaware for felony criminal mischief of a Townsend business that occurred last week.

    On June 27, 2024, at approximately 7:10 p.m., troopers responded to Drake’s Towing, located at 4195 Dupont Parkway, Townsend, for a report of criminal mischief. During the investigation, troopers learned that a man became upset after arriving at the business and discovering it was closed for the day. The suspect proceeded to cause several thousand dollars in damage to the business, including shattering a window with a chair. He then fled from the business in a black sedan. Through investigative means, troopers identified the suspect as Jacob Singleton, and obtained a warrant for his arrest.

    On June 30, 2024, Singleton was taken into custody by the New Castle County Police Department and transported to Troop 2, where he was charged with the crimes listed below, arraigned by Justice of the Peace Court 11, and committed to Howard R. Young Correctional Institution on a $6,001 secured bond.

    Detectives Investigating Shots Fired at a Harrington Residence

    The Delaware State Police are investigating a shooting that occurred yesterday in Harrington.

    On June 30, 2024, at approximately 6:14 p.m., troopers responded to a residence on Yellow Wood Drive in Harrington for a report that a house had been hit by gunfire. The preliminary investigation revealed that an unknown suspect fired a shot from an unknown location and hit the house. There were two adults and two children in the home at the time of the shooting. No one was injured.

    Troop 3 Criminal Investigations Unit continues to investigate this incident. Detectives are asking anyone who witnessed or has information regarding this case to contact Detective S.     FTC Acts to Stop Unauthorized Billing Scams That Have Taken in Over $200 Million from Consumers

    A U.S. district court in central Florida today unsealed a Federal Trade Commission complaint charging two related groups of defendants with defrauding consumers nationwide by enrolling them, without their knowledge, into continuity plans where they are shipped and charged repeatedly for personal care products that they did not agree to purchase.

    The defendants allegedly deceived consumers with ads for “free” CBD and Keto-related personal care products, billing many for products they did not consent to purchase, signing many up for unwanted continuity plans, and debiting money from their bank accounts without prior authorization. In addition, the FTC alleges that some of the defendants laundered credit card payments by setting up bank accounts for shell companies using straw signers.

    “These defendants bilked consumers out of millions of dollars by repeatedly charging them for products they never ordered or agreed to purchase,” said Samuel Levine, Director of the FTC’s Bureau of Consumer Protection. “The FTC is committed to aggressively pursuing companies and individuals involved in these unauthorized billing scams.”

    The FTC’s complaint names two related groups as defendants: 1) U.K. resident Harshil Topiwala, Florida resident Kirtan Patel, and the three companies they operate, Legion Media, LLC, KP Commerce, LLC, and Pinnacle Payments, LLC; and 2) Florida resident Manindra Garg and a company he operates, Sloan Health Products, LLC.

    According to the complaint, the Legion Media defendants have operated two types of unauthorized billing scams. In the first, the defendants market products that supposedly promote weight loss, clear skin, or other health benefits. They then defraud consumers who bought the products by charging them more than the advertised price and enrolling them in continuity plans without their consent in which they are charged for products they never intended or agreed to buy.

    The Legion Media defendants also allegedly participated in business impersonation scams where consumers received communications appearing to be from known businesses inviting them to pay a small shipping fee for a supposedly free “gift” online. However, after consumers used their credit and debit cards to pay a fee, they incurred recurring unauthorized charges on their cards. The Legion Media defendants facilitated the scams by securing numerous merchant accounts using shell entities to process the unauthorized online charges.

    The FTC alleges Sloan Health worked together with Legion Media by labeling and shipping the deceptively marketed personal care products and handling the large volume of customer returns. The complaint states they shared in the profits of the scheme and distributed the products without providing any information that would reveal their identity to consumers, using only the generic name “Fulfillment Center” and a post office box address in Smyrna, Tennessee.

    Based on these allegations, the Commission’s eight-count complaint charges the defendants with violating Section 5 of the FTC Act for misrepresenting that consumers will get free products with their purchases, unfairly charging consumers without their consent, credit card laundering, and business impersonation.

    Three counts allege violations of the Restore Online Shoppers’ Confidence Act (ROSCA) for failing to clearly disclose all material terms before obtaining consumers’ billing information, failing to get consumers’ express informed consent before charging them, and failing to provide a simple method for consumers to cancel unwanted recurring charges.

    Finally, one count alleges violations of the Electronic Funds Transfer Act for debiting from consumers’ back accounts without their consent. Each count names all defendants, except the unfair credit card laundering and business impersonation counts, which only name the Legion Media defendants. A complete list of defendants can be found in the complaint linked to this press release on the FTC’s website. 

    The Commission vote authorizing staff to file the complaint was 5-0. It was filed under seal in the U.S District Court for the Middle District of Florida, Tampa Division, and the seal has now been lifted.

    The FTC recognizes the assistance that the following partners provided in this investigation: the United States Postal Inspection Service in Nashville, Tennessee, the Attorney General’s Offices in Florida and Tennessee, the Better Business Bureau in West Florida, the Florida Department of Law Enforcement, and the Tampa Police.

    Narrative: The Dover Police Department is investigating a burglary that occurred at Sky Vape Smoke Shop, early Sunday morning. The investigation began at 3:51 a.m., when Dover Police were called to the store for the report of a burglary. Officers responded and noticed the front glass window and front door had been shattered. The ensuing investigation revealed that at approximately 3:50 a.m., several suspects broke the front glass to the business and entered. Once inside, the suspects removed an undisclosed amount of merchandise from the store and ran away on foot.

    The Dover Police Department is working to identify the number and description of the suspects.

    There are no leads at this time.

    Detectives Investigating New Castle Area Sunoco Armed Carjacking

    The Delaware State Police are investigating a New Castle area Sunoco gas station armed carjacking that occurred last night.

    On June 28, 2024, at approximately 10:07 p.m., troopers responded to a report of a carjacking that occurred at the Sunoco located at 285 Christiana Road in New Castle. Upon arriving, troopers learned that the 24-year-old victim was at the gas pumps in a Chevrolet Malibu when he was approached by a masked black male suspect who made unknown demands while threatening the victim with a firearm. The victim complied as the suspect stole the victim’s cell phone and car keys. The suspect then fled northbound on Airport Road in the victim’s car. The victim was not injured.

    The suspect is described as an unknown masked black male. Surveillance video and images are not yet available.

    The Delaware State Police Troop 2 Criminal Investigations Unit is still investigating this. Detectives are asking anyone with information about this case to contact Detective R.     Detectives Investigating Shooting at Rehoboth Restaurant Parking Lot

    Delaware State Police are investigating a shooting incident that occurred at the Big Chill Surf Cantina parking lot in Rehoboth early this morning.

    On June 28, 2024, at approximately 12:51 a.m., troopers responded to the Big Chill Surf Cantina located at 19406 Coastal Highway in Rehoboth, for a report of a shooting. While responding to the scene, troopers received reports of a 27-year-old man suffering from a gunshot wound to his leg at a nearby hospital. The preliminary investigation revealed that the victim was among a group of several subjects that were involved in a physical altercation in the parking lot of the restaurant. During the altercation, an unknown black male suspect pulls out a handgun from a bag and fires one shot at the victim. Following the shooting, all of the subjects involved in the altercation fled from the scene.

    Through investigative means, detectives identified the suspect responsible for the shooting as 28-year-old Jonathan Blackwell of Milford, Delaware. Detectives obtained a warrant for Blackwell’s arrest for several felony offenses. Attempts to locate Blackwell (pictured below) remain ongoing.

    *Update – Suspect Arrested* State Police Investigating New Castle Motel Shooting

    Delaware State Police arrested 21-year-old Erickson Acuapa of Reading, Pennsylvania, for a shooting that occurred earlier this month at a Red Roof Inn & Suites in New Castle.

    On June 16, 2024, at approximately 3:33 a.m., troopers responded to a shooting at Red Roof Inn & Suites, located at 1612 N. Dupont Highway, New Castle. When troopers arrived on the scene, they learned that a 20-year-old male victim had been transported to a local hospital for a non-life-threatening gunshot wound to the arm. A preliminary investigation revealed that several individuals gathered at the motel after attending a local concert. During this gathering, the victim and unknown suspect engaged in an argument. The altercation escalated, and the suspect fired a shot at the victim before fleeing the scene.

    Through investigative means, detectives identified the suspect as Erickson Acuapa, and obtained a warrant for his arrest. On June 19, 2024, Acuapa was located in Wyomissing, Pennsylvania, and taken into custody by the Wyomissing Police Department.

    On June 27, 2024, Acuapa was extradited to Delaware and taken to Troop 2. Acuapa was charged with the crimes listed below, arraigned by Justice of the Peace Court 2, and committed to Howard R. Young Correctional Institution on a $138,000 cash bond.

    • Possession of a Firearm During the Commission of a Felony (Felony)
    • Reckless Endanger 1st Degree (Felony) – 3 counts

    The Dover Police Department will once again bring the National Night Out to the Dover community on Tuesday, August 6th from 6-8pm.  The event brings the Dover Police Department, along with several emergency agencies and military personnel to one place where the public can bring their families to meet and greet local heroes and see the equipment used in their jobs while forming a positive relationship with the community.  In addition to appearances and demonstrations by these agencies, Night Out will feature fun activities for all ages along with food and beverages for all while supplies last.  The venue for the event will be Dover High School at 1 Dover High Drive, Dover, DE. 

    The National Night Out  provides a variety of agencies with an opportunity to show our citizens what services they provide, the vehicles and equipment they use, and a chance to interact with personnel in a relaxed atmosphere.

  • FTC Acts to Stop Student Loan Debt Relief Scheme that Took Millions from Consumers in First Case under the Impersonation Rule

    In its first case under the Impersonation Rule, the Federal Trade Commission has stopped a student loan debt relief scheme that bilked more than $20.3 million from consumers seeking debt relief by pretending to be affiliated with the Department of Education.

    federal court temporarily halted the scheme and froze its assets– at the request of the FTC, which seeks to end the defendants’ deceptive practices. The FTC charged that the company also falsely claimed that they would take over consumers’ student loans to get them loan forgiveness that did not exist.

    “These defendants promised to lower student loan payments, but then took millions of dollars from consumers and did nothing, leaving them in deeper debt,” said Samuel Levine, Director of FTC’s Bureau of Consumer Protection. “The FTC will continue taking decisive action against those who exploit Americans struggling with student debt.”

    According to the FTC’s complaint, since at least June 2021, California-based Panda Benefit Services (also doing business as Prosperity Benefit Services), Clarity Support Services, Pacific Quest Services, Prosperity Loan Services, Public Processing Services, Quick Start Services, Select Student Services, Signature Processing Services, and its operators Christopher Hanson, Eduardo Martinez, Emiliano Salinas, and Melissa Salinas, preyed on consumers burdened with student loan debt and tricked them into paying hundreds to thousands of dollars in illegal junk fees towards loan forgiveness that did not exist.

    The FTC says that Prosperity Benefit Services, its affiliated companies, and operators falsely claimed that consumers who paid for their program were guaranteed to receive loan forgiveness and that the program would significantly reduce their loan payments. The operators also falsely claimed to take over the servicing of consumers’ student loans and told consumers that they were affiliated with the Department of Education.

    The complaint notes that in many instances, the operators would send mailers with urgent language like “FINAL NOTICE” and “Time Sensitive,” and boasted benefits like “complete loan forgiveness” and “tax free loan forgiveness” to entice consumers to call them and speak to a telemarketer. When consumers called the number on the mailers, they would speak with telemarketers who then convinced them that if they signed up for the debt relief program, they would be eligible for loan forgiveness after only a few months or years, a substantially shorter time than what is available under federal government repayment programs. Many consumers have reported that after signing up and making payments, they never received loan forgiveness and that the scheme’s operators never applied for loan forgiveness on their behalf.

    In addition, the operators of the scheme falsely claimed that they would take over consumers’ loans and claimed that they buy their loans from consumers’ federal servicers. By falsely claiming they worked with or were affiliated with the Department of Education, the scheme’s operators were able to obtain consumers’ bank account or debit card information, and typically collect hundreds of dollars in illegal upfront fees from consumers, according to the FTC.

    Contrary to their promises, in many instances the operators did not obtain loan forgiveness or lower payments for consumers, and because borrowers of federal student loans were not required to make payments on their loans between March 2020 and October 2023 due to the federal COVID-19 payment pause, many consumers have often gone months or years before finding out that their student loan payments were not lowered and that their loans had not been forgiven.

    The Impersonation Rule, which went into effect April 1, gives the agency stronger tools to combat and deter scammers who impersonate government agencies, such as the Department of Education, and businesses, enabling the FTC to file federal court cases seeking to get money back to injured consumers and civil penalties against rule violators. In addition to the Impersonation Rule, the agency says the defendants also violated the FTC Act, the Telemarketing Sales Rule, and the Gramm-Leach-Bliley Act.

    The Commission vote authorizing the staff to file the complaint was 5-0. The U.S. District Court for the Central District of California entered a temporary restraining order on June 24, 2024.  

    NOTE: The Commission files a complaint when it has “reason to believe” that the named defendants are violating or are about to violate the law and it appears to the Commission that a proceeding is in the public interest. The case will be decided by the court.

    The Delaware State Police Aviation Section is excited to announce the opening of the application process for the next session of the “DSP Women in Aviation and Law Enforcement Seminar.” This engaging and educational seven-week program will begin on Thursday, August 15th, at the Delaware State Police Hangar in Middletown, Delaware.

    Participants will meet every Thursday and will have the unique opportunity to explore the various facets of the Delaware State Police (DSP) and witness firsthand how the Aviation Section serves the residents and visitors of the First State. The seminar will emphasize the contributions of pioneering women in aviation and law enforcement, featuring presentations from several dynamic and inspiring speakers.

    The seminar is open to individuals 18 and older. Class size is limited to ensure a personalized and enriching experience. Participation in the program is free.

  • FTC Finalizes Order with Avast Banning it from Selling or Licensing Web Browsing Data for Advertising and Requiring it to Pay $16.5 Million

    The Federal Trade Commission has finalized an order banning software provider Avast from selling, disclosing, or licensing any web browsing data for advertising purposes to settle charges the company and its subsidiaries sold such information after promising that its products would protect consumers from online tracking. The company also must pay $16.5 million, which is expected to be used to provide redress to consumers.

    In a complaint, first announced in February, the FTC alleged that UK-based Avast Limited via its Czech subsidiary, unfairly collected consumers’ browsing information through the company’s browser extensions and antivirus software, stored it indefinitely, and sold it without adequate notice and without consumer consent. The FTC also charged that Avast deceived users by claiming that the software would protect consumers’ privacy by blocking third party tracking, but it failed to adequately inform consumers that it would sell their detailed, re-identifiable browsing data. The FTC alleged Avast sold that data to more than 100 third parties through its subsidiary, Jumpshot.

    Under the order, Avast and its subsidiaries also must delete the web browsing information transferred to Jumpshot and any products or algorithms derived from that data; must obtain affirmative express consent from consumers before selling or licensing browsing data from non-Avast products to third parties for advertising purposes; notify consumers whose browsing information was sold to third parties without their consent about the FTC’s actions against the company; and implement a comprehensive privacy program that addresses the misconduct highlighted by the FTC.

    After receiving two comments, the Commission voted 3-0-2 to give final approval to the settlement. Commissioners Melissa Holyoak and Andrew N. Ferguson did not participate.

  • FTC Announces Final Eyeglass Rule Implementing Updates to Promote Competition and Expand Consumer Choice

    Concluding a comprehensive multi-year review, the Federal Trade Commission today announced final updates to its Ophthalmic Practice Rules, known as the Eyeglass Rule aimed at promoting competition and consumer choice.

    The updates are designed to increase compliance with the rule’s longstanding requirement that eye doctors (ophthalmologists and optometrists) provide patients with a free copy of their prescription immediately following a refractive eye exam. The revised rule requires that in certain circumstances, prescribers must request a patient’s signature confirming they received their prescription, and prescribers must keep a record of that confirmation for at least three years.

    “For decades, the FTC’s Eyeglass Rule has promoted competition by ensuring that consumers can shop around for lower prices,” said Samuel Levine, Director of the Bureau of Consumer Protection. “The FTC’s updated rule will strengthen compliance and make this market more fair and competitive.”

    Issued in 1978, the FTC’s Eyeglass Rule helps facilitate consumer choice and promote competition in the eyeglass market by requiring that prescribers automatically provide patients with a copy of their eyeglass prescription immediately after any eye exam that includes a vision test, also known as a refraction, even if the patient does not request the prescription.

    Under the existing rule, prescribers cannot require that patients buy eyeglasses before providing them with a copy of their prescription, place a liability waiver on the prescription, require patients to sign a waiver in order to receive their prescription, or require that patients pay an additional fee in exchange for a copy of their prescription. Prescribers also cannot refuse to perform an eye exam unless the patient buys eyeglasses, contact lenses, or other ophthalmic goods from them.

    Rule Review and Final Changes

    Despite the rule’s longstanding existence, prescribers have not always complied with the automatic release requirement. In response to consumer complaints over the past several years, the FTC has sent warning letters to prescribers reminding them that they must provide patients with prescriptions at the end of an exam and cannot charge a fee or require eyeglass purchase for prescription release. But even so, surveys of consumers have repeatedly found that many consumers do not automatically receive their prescription following each refractive eye exam.

    In December 2022, after receiving more than 800 public comments, the Commission proposed updating the rule to address the continued non-compliance. The Commission sought additional comment on the proposed changes and held a public workshop in May 2023.

    The changes announced today require that prescribers, after providing the prescription, request that their patients sign a statement confirming they received their prescription and keep a record of such confirmation for at least three years. These new confirmation requirements—which mostly mirror those already in place for contact lens prescriptions—only apply to optometrists and ophthalmologists who have a financial interest in selling prescription eyewear.

    Other changes to the rule:

    • allows prescribers, with a patient’s verifiable affirmative consent, to provide the patient with a digital copy of a prescription in lieu of a paper copy; if the patient refuses the digital copy, the prescriber must provide a paper copy;
    • explicitly specifies that, whether the patient consents to digital delivery or opts for a paper copy of their prescription, the prescription must be provided immediately after the examination is completed (not after the patient has been sold glasses, for instance). A patient must have their prescription before any offer to sell them glasses.
    • clarifies that presentation of proof of insurance coverage shall be deemed to be a payment for the purpose of determining when a prescription must be provided.
    • changes the term “eye examination” to “refractive eye examination” throughout the text and emphasizes the need for prescribers to educate consumers that there can be a difference between an eye health examination and a refractive eye examination. This is because the automatic release of prescriptions is only required following a refractive eye examination.

    The Commission vote approving the final rule was 5-0, with Commissioner Rebecca Kelly Slaughter issuing a separate statement. It will be published in the Federal Register soon and will become effective 60 days after publication.

    State Police Investigating Two-Vehicle Fatal Crash in Camden

    The Delaware State Police are investigating a two-vehicle fatal crash that occurred this morning in Camden that left one man dead.

    On June 26, 2024, at approximately 5:00 a.m., a 2009 Cadillac Escalade was traveling eastbound on Walnut Shade Road, west of Barney Jenkins Road. At the same time, a 2016 Honda Accord was traveling westbound on Walnut Shade Road, approaching the Cadillac. For unknown reasons, the Cadillac failed to maintain its lane and crossed the centerline into the Honda’s path of travel. As a result, the front of the Cadillac struck the front of the Honda in the westbound lane of Walnut Shade Road.

    The driver of the Honda, identified as 31-year-old Brian Moore of Magnolia, Delaware, was pronounced dead at the scene. His family has been notified.

    The driver of the Cadillac, an 18-year-old man from Bear, Delaware, was taken by ambulance to an area hospital for non-life-threatening injuries. The Cadillac’s passenger, a 19-year-old woman from Harrington, Delaware, was flown to an area hospital for non-life threatening injuries.

    The roadway was closed for approximately 3 hours while the scene was investigated and cleared.

    State Police Arrest Man for Felony Gun Offenses Following Traffic Stop in Dover

    Delaware State Police arrested 35-year-old Michael DiRocco of Claymont, Delaware, for felony gun offenses following a traffic stop on Tuesday afternoon in Dover.

    On June 25, 2024, at approximately 12:49 p.m., a trooper on patrol observed multiple equipment violations on a grey Infiniti Q60 as it was traveling on the P.O.W. /M.I.A. Parkway toward South Dupont Highway in Dover. The trooper conducted a traffic stop, and made contact with the operator, identified as Michael DiRocco. A computer inquiry of DiRocco revealed his license was suspended, and he had a capias for his arrest issued by the Newport Alderman Court 42. DiRocco was subsequently taken into custody without incident. Troopers conducted an inventory search of the Infiniti before it was towed, and discovered a loaded firearm concealed under the driver-side floor mat. DiRocco is a convicted felon, and is prohibited from possessing a firearm or ammunition.

    DiRocco was taken to Troop 3, where he was charged with the crimes listed below, arraigned by Justice of the Peace Court 2, and released on a $5,000 unsecured bond.

    The Delaware State Police have arrested 29-year-old Anthony Hatton of Dover, Delaware for reckless endangering and gun offenses in Dover yesterday afternoon.

    On June 23, 2024, at approximately 12:29 p.m., troopers responded to a report of shots fired in the area of Becky Lane in Dover. During the investigation, troopers learned the suspect, identified as Anthony Hatton, ran into the wooded area near Tidbury Park and fired one round from a firearm after an argument with his neighbors. Troopers made contact with Hatton at the scene, and observed multiple signs of impairment. Hatton was subsequently taken into custody without incident. There were no injuries or property damage reported at this time.

    Hatton was taken to Troop 3, where he was charged with the crimes listed below, arraigned by Justice of the Peace Court 7, and committed to Sussex Correctional Institution on a $22,000 cash bond.

    The Delaware State Police are investigating an armed robbery at a Wilmington area AT&T that occurred on Saturday evening.

    On June 22, 2024, at approximately 8:10 p.m., troopers responded to a report of an armed robbery at the AT&T located at 3601 Concord Pike in Wilmington. The preliminary investigation revealed two unknown male suspects, who were armed with firearms, entered the business and confronted an employee while demanding access to the safe. The employee complied, and the suspects stole a large quantity of electronic merchandise. The suspects then fled in an unknown direction in a white sedan.

    The suspects are described as black males wearing dark-colored clothing and masks covering their faces. There is no further description available for the white sedan. Surveillance video and images of the suspects and suspect vehicle are not available.

    State Police Arrests Man for Felony Gun Charges in Wilmington

    Delaware State Police arrested 40-year-old Larry Austin of Wilmington, Delaware, for felony gun charges following a suspicious activity investigation early Saturday morning in Wilmington.

    On June 22, 2024, at approximately 4:50 a.m., troopers responded to the Wilmington Country Club located at 4825 Kennett Pike for an unknown man sleeping in the back of a Cadillac Escalade. When the trooper arrived, he saw the Escalade parked in the entrance road of the country club with the driver’s door open. The trooper approached the SUV and opened the driver side rear passenger door to make contact with the occupant. Upon opening the door, the occupant, later identified as Larry Austin, fell out onto the concrete. As Austin fell out of the SUV, the trooper saw a black gun on the seat where Austin had been sitting. While speaking with Austin, the trooper observed Austin exhibiting multiple signs of impairment and he was subsequently taken into custody without incident. A computer inquiry of the Taurus G2C 9mm handgun found in the SUV revealed it had been reported stolen by the New Castle County Police Department in May 2022.

    A computer check of Austin revealed he is a convicted felon and is prohibited from possessing a firearm or ammunition. He was taken to Troop 1, where he was charged with the crimes listed below, arraigned by Justice of the Peace Court 11, and released after posting a $13,200 cash bond.

    Narrative:

    The Dover Police Department has arrested Fred Williamson IV, 30, of Dover, on robbery charges following an incident late Saturday night. The investigation began at 10:52 p.m., when Dover Police were called to the area of West Division Street and South Bradford Street for a report of a robbery. Officers responded and contacted the victim. The ensuing investigation revealed that the victim was sitting in a vehicle when he was approached by a female and a group of males. One of the males, Williamson, demanded that he turn over money and property. The victim did not initially comply, and Williamson punched the victim and began assaulting him, causing minor injuries. The victim refused all medical treatment. Williamson took an undisclosed amount of money and property from the victim and left the area.

    While on the scene speaking with the victim, Williamson was observed walking in the area. Officers attempted to contact him; however, he ran away on foot. After a brief foot chase, Williamson was taken into custody without incident. He was transported to the Dover Police Department to be processed and arraigned.

    Williamson was committed to SCI on $15,250 secured bail on the following charges:
    -Robbery Second Degree
    -Conspiracy Second Degree
    -Assault Third Degree
    -Theft Under $1,500
    -Resisting Arrest
    -Criminal Mischief Under $1,000

    Williamson is presumed innocent until proved guilty.

  • FTC Action Leads to Sweepstakes Ban For Three Individuals Who Ran Massive Scheme That Cost Consumers Millions

    As a result of a Federal Trade Commission case, the operators of a sweepstakes scam that cost consumers millions have agreed to settlements that permanently ban them from operating sweepstakes or making claims to consumers about prizes they have won or may win.

    The FTC first filed its complaint against Matthew Pisoni, Marcus Pradel and John Leon in 2015, alleging that they helped operate a sprawling sweepstakes operation that took more than $28 million from consumers throughout the United States and other countries, including Australia, Canada, France, Germany, Japan, and the United Kingdom.

    “While these settlements will keep these defendants from harming more consumers with bogus prize claims, they will unfortunately not return money to consumers,” said Samuel Levine, Director of the FTC’s Bureau of Consumer Protection. “Since the case was first filed, the Supreme Court’s decision in the AMG Capital Management case removed our ability to put the money defendants took back in consumers’ pockets. It is urgent that Congress restore the Commission’s ability to make consumers whole when they are targeted by scammers.”

    The FTC’s complaint charged that the defendants mailed personalized letters falsely telling consumers that they had won large cash prizes, typically more than $2 million. To collect the “guaranteed” money, consumers had to mail the defendants a $20-$30 fee by cash, check or money order typically within 10 days, and the letters warned consumers they would forfeit their winnings if they didn’t pay on time. In reality, consumers had not won anything. The defendants had no connection to any sweepstakes and could not award or pay anyone the promised prizes.

    Under the terms of the settlements, Pisoni, Pradel and Leon are permanently banned from any involvement in any sweepstakes or other form of prize promotion that tells consumers that they either have won or could be eligible to win a prize. In addition, the settlements prohibit the three defendants from any further deception related to any product or service and also prohibit them from making use of any consumer information they acquired through running the sweepstakes scam.

    The Commission vote approving stipulated final orders was 5-0. The FTC filed the proposed orders in the U.S. District Court for the Southern District of Florida. The orders were approved and entered on June 21, 2024.

    Delaware State Police are investigating a shooting that occurred early Saturday morning on I-95 near Exit 141 in New Castle.

    On June 22, 2024, at approximately 1:13 a.m., troopers were called for a shooting where one man was shot. Troopers learned that a 35-year-old male victim was taken to a local hospital for non-life-threatening gunshot wound to his upper back shoulder.

    A preliminary investigation revealed the victim was a passenger of a white Hyundai Sonata. At approximately 1:06 a.m., as the Sonata merged onto I-95 northbound, an unknown light-colored sedan with dark tinted windows and bright fluorescent headlights drove directly next to it. The suspect pointed a gun and shot at the Sonata three times before fleeing the area on I-95 northbound.

    State Police Investigating Fatal Collision Involving Gas-Powered Bike in Wilmington

    The Delaware State Police are investigating a fatal collision involving a gas-powered bike that occurred yesterday afternoon in Wilmington that left one man dead.

    On June 20, 2024, at approximately 2:21 p.m., a grey 2009 Audi A4 was traveling westbound on West Newport Pike, approaching Silview Avenue. As the Audi was in the process of making a right turn into a private parking lot on W. Newport Pike, it was struck by a 4-stroke mini gas-powered bike that was traveling on the shoulder of W. Newport Pike westbound. After the impact, the operator of the bike was ejected from the bike. At the time of the collision, the shoulder of W. Newport Pike westbound was closed off by construction cones for active construction in the vicinity.

    The operator of the bike, a 22-year-old man from Wilmington, Delaware, was taken to an area hospital, where he was pronounced dead. His name is being withheld until his family and relatives are notified.

    The driver of the Audi, a 43-year-old woman from Wilmington, Delaware, was not injured.

    The roadway was closed for approximately 2 hours while the scene was investigated and cleared.

    State Police Arrest Duo for Organized Retail Theft of Cosmetic Products from Multiple Stores in New Castle County

    Delaware State Police arrested 30-year-old Leticia Rodriguez and 29-year-old Danielle Serpe, both of Wilmington, Delaware, for organized retail theft following a series of shopliftings of cosmetic products from multiple stores throughout New Castle County over the last two months.

    On June 20, 2024, at approximately 3:48 p.m., troopers responded to the Target located at 1050 Brandywine Parkway, Wilmington, for a report of two females shoplifting cosmetic products. Upon arriving, troopers were advised the suspects were at the bus stop, where they were both subsequently taken into custody without incident. A search of their person and property led to the discovery of various stolen cosmetic products. While in custody, both suspects initially provided fake names and dates of birth to troopers. The suspects were ultimately positively identified as Leticia Rodriguez and Danielle Serpe, and transported to Troop 1.

    During the investigation, troopers linked Rodriguez and Serpe to additional shopliftings of a similar nature that occurred at multiple Walgreens and CVS locations throughout New Castle County between April 19, 2024, and May 29, 2024. In each shoplifting, an unknown female suspect concealed cosmetic products on her person and/or in bags and left the business without paying. Through investigative means, troopers identified Leticia Rodriguez as the suspect responsible for 7 shopliftings from multiple Walgreens and CVS locations in New Castle County. In 4 of the 7 shopliftings, Rodriguez shoplifted with a coconspirator, identified as Danielle Serpe. The shopliftings, which occurred mostly in May, totaled over $9,500 worth of stolen merchandise.

    At Troop 1, Rodriguez and Serpe were charged with multiple crimes.


    Rodriguez was charged with the crimes listed below, arraigned by Justice of the Peace Court 11, and committed to Delores J. Baylor Women’s Correctional Institution on a $27,550 secured bond.

    State Police Investigating Fatal Pedestrian Crash Near Milton

    The Delaware State Police are investigating a fatal pedestrian crash that occurred early this morning near Milton that left one woman dead.

    On June 21, 2024, at approximately 12:15 a.m., a Nissan Altima was driving northbound in the right lane on Coastal Highway, north of Oyster Rocks Road. At the same time, a Dodge Charger was stopped on the shoulder of Coastal Highway northbound, north of Oyster Rocks Road. The preliminary investigation revealed that a passenger of the Charger was out of the car, looking for her cell phone. While she was looking for her cell phone, she stepped in the roadway, into the Nissan’s path of travel. As a result, the front of the Nissan hit the pedestrian.

    The pedestrian, an 18-year-old woman from Linwood, Pennsylvania, was pronounced dead at the scene. Her name is being withheld until her family is notified.

    The driver of the Nissan, a 34-year-old woman from Dover, Delaware, was not injured.

    The roadway was closed for approximately 4 hours while the scene was investigated and cleared.

    FTC Issues Annual Report on Refunds to Consumers; Agency Returned $324M in 2023

    Federal Trade Commission law enforcement actions resulted in more than $324 million in refunds to consumers in 2023, the agency said in its annual report on refunds.

    The FTC Annual Report on Refunds to Consumers provides a breakdown of the total amount refunded by the FTC nationally, as well as the amount mailed to each state. The report also includes a list of cases in which the agency sent first distribution payments in 2023. For example, the largest first distribution resulted in $99 million sent to consumers who were charged fees after trying to cancel their Vonage phone plans. In addition to statistics about each distribution in 2023, the report also includes information about how the FTC provides refunds and determines who is eligible for a refund in cases where there is money to return to consumers.

    The FTC also has interactive dashboards online with more detailed information about consumer refunds at ftc.gov/exploredata. The dashboards include the ability to search for the number of refunds issued by state for each case as well as breakdowns of the forms of payment used to provide refunds in various cases.

    The Delaware State Police are investigating a robbery that occurred early this morning at a New Castle area Dash In gas station.

    On June 20, 2024, at approximately 4:16 a.m., troopers responded to a report of a robbery at the Dash In located at 154 North Dupont Highway in New Castle. The preliminary investigation revealed an unknown white male suspect entered the Dash In and demanded the employee empty the cash register while implying he was in possession of a firearm. The employee complied and the suspect fled on foot southbound on N. Dupont Highway with an undisclosed amount of cash.

    The suspect is described as a white male wearing dark-colored clothing and a mask. Surveillance video and images are not yet available.

    State Police Investigating Concord Mall Shoplifting Turned Robbery

    The Delaware State Police are investigating a shoplifting turned robbery that occurred Monday afternoon at a Sunglass Hut kiosk within the Macy’s at Concord Mall.

    On June 17, 2024, at approximately 5:40 p.m., troopers responded to a shoplifting turned robbery at the Sunglass Hut kiosk located within the Macy’s at 580 Concord Mall in Wilmington. The investigation revealed that 5 unknown suspects approached the kiosk and grabbed several pairs of eyeglasses. As the suspects fled towards the exit of the store with the unpaid merchandise, they were confronted by an employee. During the confrontation, one of the female suspects dropped a bag containing some of the stolen eyeglasses and pepper sprayed the employee in the face. The suspects then fled in a silver sedan with several pairs of eyeglasses.

    Through investigative means, troopers identified one of the suspects as Itaijiyah Clark (pictured below) and obtained warrants for her arrest. The remaining four suspects are unknown and are described as black females. Surveillance images and video of the suspects and the suspect vehicle are not yet available. Clark has not been located at this time, and is wanted for several felony charges.

    Troopers Arrest Smyrna Man for 7th Offense DUI Following an Injury Crash

    Delaware State Police arrested 53-year-old Paul Rowan of Smyrna, Delaware, for 7th offense felony DUI following an injury crash in Hartly yesterday afternoon.

    On June 18, 2024, at approximately 12:19 p.m., troopers responded to an overturned Isuzu Rodeo on the 2000 block of Slaughter Station Road in Hartly. Before troopers arrived, they were told that the driver and passenger of the Isuzu walked away from the crash. When troopers arrived, they located the driver, later identified as Paul Rowan, and passenger, a 45-year-old woman, walking away from the crash scene. Rowan and the passenger were taken to an area hospital for non-life-threatening injuries. During a search of the Isuzu, troopers found drug paraphernalia.

    When a trooper spoke to Rowan at the hospital, he showed signs of impairment and administered Standardized Field Sobriety Tests. After the tests, Rowan was arrested for driving under the influence and a computer check showed that he had six prior DUI-related convictions.

    After he was released from the hospital, Rowan was taken to Troop 3, where he was charged with the crimes listed below, arraigned by Justice of the Peace Court 2, and committed to Sussex Correctional Institution on a $23,750 cash bond.

    • 1st Degree Vehicular Assault (Felony)
    • Possession of Drug Paraphernalia
    • Leaving the Scene of a Collision Resulting in Injury

Valerie was last seen on June 16, 2024, in the area of Maryland Avenue and Race Street in Wilmington. Attempts to locate her have been unsuccessful. There is a concern for her safety and well-being.

    Valerie is described as a black female, approximately 5’06” tall, with curly brown and gray hair. She was last seen wearing a gray t-shirt, blue jeans, and white sneakers.
