    Judge rules against Seaford’s fetal ordinance

    A fetal tissue ordinance enacted by Seaford City Council late last year has been overturned following a successful legal challenge by Attorney General Kathy Jennings and the Delaware Department of Justice.

    The ordinance, enacted on December 14 with an original effective date of January 22, would have forced anyone who had a surgical abortion at an “abortion facility” or a miscarriage at a “health care facility” to have the fetal tissue interred or cremated at their own expense, despite the hardship on patients and clear preemption by State law.

    .

    In a ruling released Wednesday morning, Vice Chancellor J. Travis Laster of the Delaware Court of Chancery ruled that the City of Seaford, as a junior sovereign, cannot enact a law that conflicts directly with law established by the State as the senior sovereign.

    .

    “The U.S. Supreme Court has unleashed a wave of extremist, draconian laws across our country. That wave stops here,” said Attorney General Kathy Jennings. “This ruling firmly rejects a clearly illegal and harmful attempt to nullify State law and to use dark money to return us to the Dark Ages. It protects residents and visitors of Seaford from a cruel and frankly hateful policy. And it makes clear that Delaware remains a safe haven for choice and reproductive freedom exactly when those sanctuaries are needed most. I am grateful to the Court for its wisdom and to our team for their quick response and tireless work on this case.”

    Jennings filed suit on January 11 after twice warning Seaford City Council that State law preempted the ordinance. Council passed the ordinance despite those warnings, with a promise that an anonymous outside donor would fund the defense against the State’s incoming lawsuit. The Court’s ruling awards costs to the State.

    “Even after last week’s devastating Dobbs decision, abortion remains a codified right in Delaware,” said Mike Brickner, executive director of the ACLU of Delaware. “Yesterday, our General Assembly fortified that right by expanding access to abortion, and today, the Delaware Chancery Court also reinforced that right, making it clear that municipal attacks on our state-guaranteed right to abortion won’t stand. ACLU-DE applauds Attorney General Kathy Jennings, and her team, for their swift and effective legal action against Seaford’s city council to permanently block the city’s illegal fetal remains ordinance.”

    Since the DOJ’s arguments were premised on State law, the State’s case, and the Court of Chancery’s ruling, are unaffected by the U.S. Supreme Court’s recent ruling in Dobbs v. Jackson Women’s Health Organization.

    Seaford Police are investigating several vandalisms involving pink spray paint that occurred overnight on Friday. In each of the cases, pink spray paint with vulgar language was used.

    Seaford Police tells TV Delmarva News today that there were 11 complaints of pink spray paint across areas of areas of 3rd Street, Dover Electric, Peninsula Dry Cleaners, Magnolia Drive and Nylon Blvd. There were also complaints in the Blades area as well.

    .

    As for whether the vandalism were related to planned protests over the reversal of Roe v. Wade by the Supreme Court, to which Seaford Police issued an alert on Friday, we are told that it’s unlikely due to the nature of the vandalism and that the protests were peaceful and officers assisted with providing a secure event.

    Seaford Police say the vandalisms are under investigation. They are asking anyone with surveillance video that could help the investigation by contact them at 302-629-6645.

    Grand Jury indicts Seaford man in January fatal crash

    A 53-year-old Seaford man has been charged with Manslaughter after a crash that killed two children back in January.

    Delaware State Police say Arthur Perdue has been charged with two counts of felony Manslaughter, Vehicular Assault, 3rd offense Driving Under the Influence and other traffic violations in the crash that killed 14-year-old Hope Glasgow and 6-year-old Nathan Glasgow of Seaford.

    Perdue was indicted by a Grand Jury on Tuesday for the charges after an investigation of the crash. Following the indictment, Perdue was contacted by troopers in Delaware City and taken into custody and arraigned. He was committed to Howard R. Young Correctional Institution on $65,203 cash bond.

    Perdue faces the following charges.

    • Manslaughter (Felony) – 2 counts
    • Vehicular Assault First Degree (Felony)
    • 3rd Offense Driving Under the Influence (Felony)
    • Possession of a Controlled Substance
    • Driving on the Wrong Side of the Roadway
    • Passing in a No-Passing Zone
    • Failure to Have Required Insurance

    A Seaford man has been arrested after leading police on a pursuit early Sunday morning.

     

    Delaware State Police say a trooper attempted to stop 37-year-old Dontra Batson after he was observed traveling at a high rate of speed in his blue Ford Escape on southbound Sussex Highway near Concord Road. Batson allegedly led the pursuit down Concord Road, where he struck a home on Haven Drive and fled on foot. Officers chased him down and apprehended him without further incident.

     

    A further investigation determined that Batson was impaired. Officers also found 2.89 grams of marijuana and 15 grams of cocaine. A Ruger 9mm handgun was also found, and computer check showed Batson was a convicted felon prohibited from having a firearm.

     

    Batson was transported to Troop 5 and charged with the following offenses:

    Possession of a Firearm During the Commission of a Felony (Felony)

    Possession of a Firearm by a Person Prohibited (Felony)

    Disregarding a Police Officer Signal (Felony)

    Resisting Arrest

    Possession of a Firearm While Under the Influence

    Possession of a Controlled Substance

    Driving Under the Influence

    Possession of Marijuana

    Numerous traffic offenses

     

    Batson was lodged at Sussex Correctional Institution on $23,850 cash bond.

    Tinted windows violation leads to drug, weapons charges in Seaford

    A Laurel man is facing several drugs and weapons charges after he was pulled over for a tinted windows violation.

    Seaford Police say 44-year-old Carlo Munoz-Barreto was stopped in the area of South Market Street on Sunday evening. The officer spotted a handgun in a door pocket when the door opened, prompting the officer to make an arrest. A further search of the suspect’s vehicle uncovered 58 grams of cocaine, 10 bags of heroin, 519 grams of marijuana, 49 prescription pills, drug paraphernalia, a rifle, ammunition, and over $2,800 in drug proceeds.

    Munoz-Barreto faces several charges, including:

    • Possession of a Firearm during the Commission of a Felony (Felony)
    • Possession of a Deadly Weapon by a person prohibited who also possessed Controlled Substances (Felony) – 3 counts
    • Carrying a Concealed Deadly Weapon (Felony)
    • Manufacture/Deliver/ PWID Controlled Substance (Felony) – 2 counts
    • Possession of a Controlled Substance (Felony) – 2 counts
    • Possess Consume any Prescription drug, not a controlled substance (Misdemeanor) – 8 counts
    • Possess Consume a Controlled or Counterfeit Substance except for Human Growth Hormone without a
    prescription (Misdemeanor)
    • Possession of Drug Paraphernalia Not related to personal use quantity Marijuana or Person Under 18
    (Misdemeanor) -3
    • Operating a vehicle with improper Window Tinting

    He was also wanted on a Delaware State Police warrant for a theft charge as well.

    Munoz-Barreto was arraigned and lodged to SCI on $139,850 cash bond.

    Bridgeville man arrested in connection with Seaford apartment shooting

    Seaford Police have made an arrest in connection with a shooting earlier this month.

    Investigators say 36-year-old Eric Jackson of Bridgeville was developed as a suspect in the February 11 shooting at the Meadowbridge Apartments and a warrant was obtained on February 18.

    The next day, Seaford Police spotted Jackson leaving the very same apartments, and initiated a traffic stop. He was taken into custody without incident. Officers also uncovered 46 grams of marijuana and a loaded handgun.

    In addition to 1st degree attempted assault and firearm charges stemming from the February 11 shooting, Jackson also faces additional charges from his arrest which includes:

    Two counts of Possession of a Firearm or Ammunition by a Person Prohibited, Possession of a Firearm During the Commission of a Felony, Carry a Concealed Deadly Weapon, Possession with Intent to Deliver a Controlled Substance.

    Jackson was arraigned and lodged in the Department of Corrections on a $201,000 cash bond.

    BREAKING | Children, ages 14 and 7, killed in head-on crash near Seaford

    Two children, ages 14 and 7, were killed this afternoon in a serious, head-on crash near Seaford.

    According to the Delaware State Police Department, the crash occurred around 12:33 p.m., Thursday as a 2009 Nissan Altima, operated by a 53-year-old Seaford man, was traveling southbound on Atlanta Road. At the same time, a 2018 Kia Soul, driven by a 36-year-old Seaford woman, was traveling northbound on the same road in the area of the Nissan.

    For unknown reasons, police say the driver of the Nissan crossed the double solid yellow line and struck the Kia head-on in the northbound lane of travel. The driver of the Nissan was properly restrained and airlifted to an area hospital where he was admitted in serious condition.

    The driver of the Kia was properly restrained and transported by ambulance to an area hospital, where she was admitted with non-life-threatening injuries.

    The Kia driver’s 14-year-old daughter was properly restrained in the left rear passenger seat. The driver’s 7-year-old son was properly restrained with a backless booster seat in the right rear passenger seat. Unfortunately, due to injuries sustained during the collision, the juveniles were pronounced dead at the scene.

    Delaware State Police extend their condolences to the victims’ families during this difficult time.     A Millsboro man was arrested after police say a traffic stop turned up drugs and a firearm in Seaford.

    According to Seaford Police, around 1:44 p.m. on Christmas Eve, officers tried to pull over 20-year-old Dajuan Sheppard, for driving on a suspended license.

    Sheppard would not pull the car over and a short chase ensued that ended on Beech Street with his arrest.

    Police say Sheppard was found to be in possession of a loaded 9 mm handgun and a search of the vehicle turned up 46 grams of marijuana.

    Sheppard was arraigned on a slew of charges and committed to the Department of Corrections in lieu of more then $67,000 cash only bail.

    Seaford Police search for suspect who robbed Dunkin Donuts

    Seaford Police are searching for the suspect who robbed a local Dunkin Donuts.

    According to the Seaford Police Department, the incident occurred around 7:30 p.m., Monday as police were called to the Dunkin Donuts on Bridgeville Highway for reports of a robbery.

    Police arrived and learned that an unknown suspect fled the establishment with an undisclosed amount of cash. There were no injuries.

    The robbery is currently being investigated in conjunction with other robberies in Seaford, including one that occurred in early October at the Valero gas station on West Stein Highway. Additional robberies occurred in November and December, according to police.

    In response to the rash of robberies over the holiday season, Seaford Police have conducted surveillance, adding additional patrols, along with collecting latent prints and DNA samples from the scenes of the robberies.

    The search continues for the suspect involved in the crimes. Anyone with any information is urged to contact police.

    A Seaford man was arrested on felony charges after police say he stole a vehicle from a local dealership and then crashed it while driving drunk on Whitesville Road.

    According to Delaware State Police, the incident occurred around 11:30 a.m., Sunday when troopers were called to respond to the area of Whitesville Road, west of Whaley’s Road, for a single-vehicle collision involving a stolen 2011 Chevrolet Suburban.

    Police say the investigation determined that around 9:30 a.m. 29-year-old Taylor W. English, of Seaford, entered the Quality Automotive dealership on Sussex Highway and removed the keys to the Suburban from inside the building.

    English then found the vehicle parked outside and fled the parking lot, according to police. Employees of the business were familiar with him and contacted the owner of the vehicle to report the incident.

    As troopers were responding to the collision on Whitesville Road, the owner of Quality Automotive reported the vehicle stolen to police.

    Police later located English walking in the area of Whaley’s Road and was taken into custody. He reportedly displayed signs of intoxication and a DUI investigation ensued.

    English was transported to Delaware State Police Troop 5 and charged with 4th Offense Driving Under the Influence of Alcohol (Felony), Theft of a Motor Vehicle (Felony), Leaving the Scene of a Collision Resulting in Injury, Driving While Suspended, Failure to Have Insurance ID in Possession, Criminal Trespass Second Degree, Operation of an Unregistered Motor Vehicle, Motor Vehicle Used on Roadway Without Displaying Registration Plates, Driver Must Wear Seatbelt, and Failure to Report a Collision Involving Alcohol. He was arraigned and committed to Sussex Correctional Institution on $6,440.00 cash bond.

    32-year-old Troy Smith, of Delmar, Maryland – Delaware State Police Dept.

    A Delmar man was arrested on drug and weapons charges after police say a traffic stop turned up heroin, pills, and an illegal handgun in Seaford.

    According to Delaware State Police, the incident occurred around 7:51 p.m., Friday when a trooper on routine patrol on Concord Road in the area of Concord Pond Road spotted a red Mitsubishi Eclipse traveling without proper lighting above its registration plate.

    A traffic stop was initiated, at which time police say contact was made with the driver and sole occupant, 32-year-old Troy Smith, of Delmar, Maryland. Suspected drugs were viewed in plain sight inside the vehicle, according to police.

    Police obtained probable cause, searched the vehicle, and allegedly discovered a loaded Smith & Wesson 9mm handgun, .007 grams of heroin, four Hydrocodone pills, and drug paraphernalia. A computer inquiry showed Smith was prohibited from possessing a weapon and has a suspended license, according to police.

    Smith was charged with Possession of a Firearm by Person Prohibited (Felony), Possession of a Controlled Substance – 2 counts, Possession of Drug Paraphernalia- 2 counts, Driving with a Suspended License, and Failure to Have a Registration Plate Light. He was arraigned and committed to the Sussex Correctional Institution on $10,950 cash bond.

    Police chase ends with drug arrests in Seaford

    A high-speed chase ends with the arrest of two people on drug charges in Seaford.

    According to the Seaford Police Department, the incident occurred around 9:30 p.m., Sunday when officers spotted a vehicle being operated by a person wanted on felony warrants.

    When police tried to pull the vehicle over, a chase ensued through downtown Seaford.

    The pursuit continued Northbound on Bridgeville Highway and then onto Hearns Pond Road where police witnessed the suspects throwing items out of the car.

    Delaware State Police were able to assist with road spikes, successfully ending the chase, at which time the driver, Tionne Austin, and passenger, Margarette Derosiers, both of Federalsburg, Maryland, were taken into custody.

    A search of the area where the items were discarded turned up 21 grams of crack cocaine, 84 grams of powder cocaine, 19 grams of marijuana, and a loaded 9 mm handgun.

    Both suspects have been charged with a slew of drug charges and were committed to the Sussex Correctional Institution.

    Murder investigation underway in Seaford

    Delaware State Police have launched a homicide investigation in Seaford after the body of a 39-year-old was found shot to death early this morning by first responders in a home that was set on fire.

    According to the Delaware State Police Department, the incident occurred around 2:11 a.m., Sunday when crews from the Seaford Fire Department were dispatched to a house fire at a home in the 11000 block of Hastings Farm Road.
    Crews arrived and extinguished the fire, at which time they located a person inside dead from an apparent gunshot wound.

    The Delaware State Police Homicide Unit was called to the home, secured the scene, and launched a homicide investigation.

    The investigation revealed that the unidentified 39-year-old victim was found inside of the home when unknown suspects forced through a side door and fired multiple rounds.

    The victim was shot once and fell to the living room floor, according to police. The suspects then set a fire in the living room before fleeing the home on foot.

    The body was turned over to the Delaware Division of Forensic Science for an autopsy. Identification of the victim is pending notification of next of kin.

    There is currently no suspect information available.

    Hastings Farm Road was closed for approximately seven hours while the incident was investigated.

    Seaford man charged with multiple counts of child sex abuse

    A Bridgeville man has been arrested on multiple counts of child sex abuse in Seaford.

    According to the Seaford Police Department, 51-year-old Bryan Willoughby was arrested on Friday following a month and a half long investigation.

    Police say Willoughby allegedly solicited sexual favors from juveniles.

    Willoughby has been charged with five counts of Sexual Solicitation of a Minor and two counts of Patronizing Prostitution.

    He was committed for lack of $160,000 cash bond and ordered to have no contact with the City of Seaford or anyone under the age of 18.
